Speaker 2     00:05:46    Hi, my name is petite 29 redbud road of this is regarding the agenda item for the library budget and I see automation work and a few other things in the line items. So the question that I have is how much of that is just ongoing maintenance and how much of that is actual real capital investment. And the second question is with respect to, since the township dollars do create jobs in local community, how many jobs that actually created for high school students and our any local members of the community, because this, this, this institutions are kind of very tightly knit in the community that they serve. So outside of the budget dollars, and I understand the R and D spending that goes with it. But outside of that, if somebody can bring some clarity or transparency, please, thank you.

And if you need a book that's not available in Piscataway, they'll get it from Woodbridge, for instance, or east Brunswick. And they also have a link all the customers use. So that's what that is. Two year contract for that resolution. Each is the buy books and monoprint materials for one vendor and I as the buy books and non-print materials from other than another vendor. And Jay is also to buy non-print materials for a two year contract. There are there at the end of their contracts down. This is for 2022 and 2023. And the libraries do employ local residents and they have great opportunities for pages, for the teenagers who work either in high school or colleges we page. And if you have anybody that's interested in this, the fatality giveaways contact the library cause they are, you know, pages come and go as a graduate high school or graduate college. However, it does give them that opportunity to learn about the workings of the library.

Speaker 5     00:12:09    I'm happy to answer that. Council President petique beginning 10 to 12 years ago, the township sold several small portions of property to a local church. They were deed restricted only to be used for church purposes. The churches indicated to the mayor and council that they no longer have them for church purposes, need them for church purposes. And they would like the restrictions to be lifted, but because they were sold at a reduced price because of the deed restriction, the council can't just lift the restrictions. They can only lift the restriction as the church pays the difference in the value between the deed restricted value and the fair and appropriate value. So that's, that's what this is.

Second by law, the town cannot just lift the restriction without receiving a fair value. So that's a requirement of the law. See, this change is intended to allow the construction of two new warehouses at 1690 south Washington avenue.  
Speaker 1     00:20:00    This 25 acre parcel is currently zoned as rural residential, and is one of the last wooded areas for low density land use in our community, M and M Realty representing a mega developer and campaign owner wants a more profitable venture than the 20 single family home is originally intended. The 1690 south Washington parcel borders. The Randolphville elementary school with 500 students and 45 teachers and staff. The town has already allowed 186 truck bays to be developed on the schools north side, ignoring the risks that truck emissions post to children's lung development and health. This property is across the street from the long promised ecological park, AKA the helper farm it's just north of the lake Nelson residential neighborhood. The parcel only access to highways via neighborhoods streets like Mettler's lane. Our community saw so much flooding after hurricane Ida and this area contains wetlands. We need for climate protection.  
Speaker 1     00:20:57    It also provides an air quality buffer zone in an area increasingly polluted by trucking missions from Piscataway five new warehouse complexes. There is no proof that this development will provide good jobs to residents, and there is no need to provide this zoning change just to meet the wishes of a developer. The rezoning proposal does not serve the best interest of our community. And there has been strong opposition to this development for more than a year. I hope you will protect our school children and staff, our residential neighborhoods and our open space by voting against this proposal. Thank you for your time. Okay. And then in addition to that, some of the individuals I'll read their names and the additional statements that they've made. In addition to, to that statement, Rhea or RIAA badge, that I'm a lifelong resident of Piscataway 20 years in counting. I went to Randolphville elementary school and loved my time there, especially playing under the Walnut trees during recess Kiersten, Wendolyn included the quality of life of each of our citizens.  
Speaker 1     00:21:59    Those that commute to work in town, as well as the wildlife and nature is being negatively affected Winston Sheck states. There was enough trough track truck traffic on south Washington avenue and associated streets. It's like a parking lot on Stilton road during rush hour and the exits and entrances to route 2 87 north and south can't support the additional truck traffic. Think about the additional truck traffic, which will occur on Mettler's land, route 18 Centennial avenue and river road. Again, a truck driver will use any route available during a traffic jam. Patricia Brown also indicates please recognize that getting around Piscataway recently has become a nightmare. It takes 15 to 20 minutes more to navigate the streets than it has than it. Then before this is because of the trucks and trailers on the road, gigantic 18 wheelers encompass the roads. Cars with families are more in danger in this town than ever before.  
Speaker 1     00:22:52    It's not the Piscataway that I grew to love. Samantha Hutchin states. Most of the roads and Piscataway are filled with trucks and traffic going to, and from new warehouses, it makes it hard to get around town. The town was not built for this kind of traffic, not to mention the emissions. Washington avenue is a main one lane road and is backed up. A lot of the times other towns could share the warehousing or we do away with them completely. There must be a better way. My child goes to Randolphville and he deserves clean air. We all do. The Skyway is a lovely town and I've been here most of my life. And I'd like to continue to raise my children here. The town has changed a lot, and I understand that needs to happen, but it should not harm or gravely inconvenience anyone, especially the community that supports it.

We need a town that is more greener and environmental friendly as is the intent of elected officials for a greener society for the future of our kids. Brian Pang, I believe I've written to you previously about my series on the social cost of reliance on long distance trade, more broadly, but to reiterate if, if stimulating the local economy is the goal, perhaps farms or other sites of local actual production, by which I do not mean to give my blessing for more factories or other industrial monstrosities would be more appropriate to cultivate rather than further cementing our current statuses as just another stopping point for trucks or cheap locale for corporate offices. The question ultimately seems to be what kind of world do we want to live in to quote Rachel Carlson silent spring? We would prefer the road we have long been traveling, deceptively easiest, smooth superhighway on which we progress with great speed, but at its end lies disaster or the other fork in the road, the one less traveled by which offers our last, our only chance to reach a destination that assures the preservation of our earth.  
Speaker 1     00:24:55    Before you dismiss me as a sappy tree-hugger may I remind you that the original tree-huggers were heroes, Indian women who put their bodies in the line of literal chain to protect the forest that granted them sustenance. Do you really want to be on the other side of that conflict? Is that truly who you want to be? Rachel Sai writes this potential development would make our day to day activities, including grocery shopping and going to parks polluted with additional toxic fumes and more dangerous traffic conditions. Jay Sy writes personally, as faculty at Rutgers, these warehouses will only make the travel around Bush and Livingston campuses, more congested as trucks, Claude, the local streets and pollute our air. Margaret Doyle ball writes all the warehouses and Piscataway haven't lowered our taxes. And when their incentives time out there will only be more empty buildings in this town. Patricia Kearns writes thanks to the ridiculous increase of 18 wheelers on hose lane.  
Speaker 1     00:25:57    My commute time to work doubles. I've lived here since 1977, and it's sad to see P way turn from a nice residential community to a commercial town over one by trucks and pollution, not to mention our race taxes. Gabriel Lopez writes, this is pure corruption at a local level Maggie. And I apologize if I mispronounce anybody's name. I should've said this before. Maggie drove that truck. Traffic is bad enough in this town and our children deserve some open space and cleaner air. If you are the Democrats that you claim to be, and that I voted for, then you too should prioritize environmental action and agreeing community over money, money, money, Wendy Kutch, Nikki writes the additional truck traffic from the current warehouses has already caused additional road congestion and noise. That is also disruptive to our neighborhoods. The warehouses have made Piscataway a less desirable place for many of us to live. And I have only seen my property taxes increase over the past five years, despite assurances from you and Mayor Wahler that I will benefit from industrial development, which is not true. Also you have already told us our source system is overloaded. Shouldn't we address that first before more warehouses and other developments are added to it.  
Speaker 1     00:27:14    And I have a few more email statements that I will read now. Good morning. My name is Jennifer Sheila, and I'm a resident of the POS town section of Piscataway. I'm writing to ask you to vote no to the new warehouse proposal next to the Randolphville elementary school across from the planned ecological park. Piscataway is running out of open space. Bob's warehouse, possum town, old new Brunswick road apartments are a few recent examples or wooded areas are being taken down. The wildlife has nowhere to go and are moving into our neighborhoods and the roads are becoming more congested. Please help keep our town beautiful and vote. No, some more warehouses and new building encourage businesses to renovate existing buildings that are no longer in use critique Patel sent in his comments. Hello, council members. Please find the note as an objection to rezoning of land on Washington avenue, I verbally spoke with many residents in neighborhoods impact in past and many are against this many, if educated and made aware of this will not allow this to happen.  
Speaker 1     00:28:18    And we'll definitely object to this. I personally believe the council is not representing in best interest of its residents by allowing rezoning. I'm not even sure how it went into second reading on one side, you all complain that we don't have enough land for residents, and yet you want to take more residential land away with this rezoning. This is next to already agreed and approved ecological park, a freshwater lake, a school I would like to, I would like to reconsider your decision and vote against it. This is not only my wish, but wish of many of my neighbors and their kids. And also future of kids who are yet to be born in this town. We don't have any scarcity of warehouses warehouse space as per utilization ratio in this county. So why more next to a school freshwater lake to create more pollution? I urge you to vote no for rezoning.  
Speaker 1     00:29:09    And I have another statement from ed marsh council members of the Piscataway Township council greetings. My name is ed marsh from one 13 white cost avenue and Piscataway. I am writing to urge you to vote against the proposed zoning change to allow construction of two new warehouses at 1690 Washington avenue. The parcel is currently on the rural residential. It consists of wooded wetlands, which provide clean air, clean water, climate protection, wildlife habitat, and a buffer zone detract the tract borders Randolphville elementary school, which already has 186 truck bays on its north side. More warehouses next door to the school would add even more diesel fumes, noise and traffic to the area.  
Speaker 1     00:29:48    There was no proof that the warehouse would provide good jobs to residents, more warehouses and more people working in the town could also increase affordable housing obligations leading to more apartment construction. In addition, these developments are often given tax breaks in the form of pilots, which exempts them from paying taxes for our schools and libraries. Many residents have opposed to these warehouses and have filed a lawsuit against them. The warehouses are clearly not in the best interest of the community. Just say no. And then the last statement I have is your council members. This is, this is a statement presented in formal opposition of the proposal to build yet another large warehouse in the near vicinity of the Randolph, K to three elementary school, as you well know, the school's already in close proximity to several other warehouses, the combined diesel exhaust from the trucks entering and exiting the neighbor hood near the school presents an obvious hazard health hazard for the school's 500 students over the course of their four years of attendance and to the adult staff at the school for many years on it.  
Speaker 1     00:30:52    It is truly shocking to think that that the members of the Piscataway Township council would have sent to adding to that health burden by construction of another warehouse. According to the American lung association, diesel exhaust is a mixture of many gases and ultra small particles containing more than 40 toxic air contaminants, including benzine, arsenic, and formaldehyde these substances penetrate deeply into lungs and the bloodstream, and can contribute to cell mutations that cause cancer. In fact, long-term exposure to diesel exhaust particles poses, the highest cancer risk of any toxic air contaminants evaluated by the office of environmental health hazard assessment. So-called evidence for benefits to residents at Piscataway of building another warehouse failed to be convincing in the slightest degree. Furthermore, building the warehouse negates a prior township commitment to utilize the location, which is now in a natural state for an ecological park of obvious health benefits to the neighborhood and the township as a whole.

It is in clear contradiction of a democratic governing bodies, paramount responsibility to advance the common good of its constituents to allow the construction of the proposed warehouse for these reasons then to touch and Edison Piscataway area branch of the NAACP stands with the Vernal vulnerable Randolph elementary school community and staunchly opposing the warehouse project and consideration this evening by the council respectfully submitted Keith moose share environmental justice committee for them to touch in Edison, Piscataway area branch of the NAACP. That concludes the statements I received in lieu of their public comment tonight. And now I will ask the first individual with their hand raised. Speaker 7     00:32:52    Yeah. Brian req 1247 Brookside road. I'm a, I'm just disappointed in this. I was listening to the planning testimony about it. The planner never bothered dimension the school next door, the senior housing that the adjacent zone is zone four or the upcoming ecological part. It was all just, oh, we're going to build warehouses here because there's already warehouses next door. I mean, I would have brought this up on the planning board meeting, but the lawyer for the town began that meeting by saying how there will be no opportunities for public comment or question. So I never actually got a chance to ask this of the engineer that came up with this zoning plan.  
Speaker 7     00:33:31    I I'm just disappointed that the planning board didn't do this and that we're having this conversation. Now I'd also like to read some quotes from the town council and mayor. And when it came to getting the trucks off river road, which a number of them live on Mayor Wahler states. We finally got the green lights to give trucks on this long section of river road, the red light. We never stopped pushing for the quality of life in our neighborhoods. And we always believed it could happen. Senator Bob Smith read we're going to save lives, improve the quality of life. This was a major accomplishment for this township and you should all be congratulated for your hard work. Even Khan said residents on river road and adjacent streets have voiced concerns about noise and air pollution. He said it's also a safety hazard river road is a residential community member of the zoning board said it's been a long time coming.  
Speaker 7     00:34:16    Your house vibrates. When the trucks go by, the trucks are traveling throughout the evening and morning hours. We have to run a machine in our bedroom to try and keep the noise down. They made terrific progress and keeping the town safe. Now we have sidewalks. People can walk and don't have to worry about the trucks going 60 miles per hour. Councilman Councilwoman Cahill stated this means the ability to move out of my driveway without fear of potentially being hit by a tractor trailer. My mailbox has been taken out twice. It will generally be a more peaceful neighborhood. I don't know how you can make these statements two years ago and then come and say, oh, we're going to put more trucks in your neighborhood. It's fine because we don't live over there. That's really what it sounds like you're doing to me. I would suggest that we maintain this as open space and not try and shove a warehouse in here. And the way that this entire process has been rolled out is not nothing short of stunning. The agenda that people are looking at, doesn't mention the property address. There was no significant public notice. Mr. Khan mentioned last meeting, the public hearing and public forum that was held to talk about the ecological preserve, which he said was a year or two ago. It was actually four years ago or four years ago when a number of people were running for reelection and election to the council. And that was the last time this body had any kind of public engagement and people really liked it. They wanted to be heard. They had great ideas, nothing ever came of those ideas, being heard by the council, but people in our community really do want to be heard.

Not only that, the next area down south Washington is the on ramp or the ramp coming onto south Washington is also an area of congestion. So I would ask respectfully that you vote against this and that you take into consideration the wetland. That's there as well as the Nash natural wildlife that's there. That you're planning for that lovely park that has yet to come to frutation and take into consideration that the traffic in that whole area around that entire block is ridiculous already.

There's a number of reasons that I've heard for zoning and repurposing of the land across from Harper's farm. As it stands right now, I am almost in a position that I, I hate commuting. I hate coming out of the Woodlake section onto Mettler's lane. There's always so many tractor trailers and, and traffic just coming down that road as a dance right now, every morning and every using. So it makes my queue horrible just to think of additional warehouse space pain being put up there.

I think it's, it's very surprising to me that the township is interested in promoting warehouses being built next to K through three schools. Well rather, I'm sorry, more warehouses being built because children are the most susceptible to developing asthma as the result of air pollution, the increased noise and traffic kind of go without saying a lot of people have mentioned it already, that it's difficult to get around here.

So I would like to first say that I've heard some folks say that there is a choice that the, the town council is facing between developing, you know, some large quantity of residential units, which would result in a large number of commuter traffic versus warehouses. And I'm here to say that that's not the choice before you is right, is zoned as roll residential. That's it that's all that can be built there. I understand that there was a previously entered into a settlement agreements between the zoning board and a developer in what's called a whispering woods settlement. That developer is still a contract purchaser. There is no way that they could put quote unquote shovels in the ground tomorrow without becoming the actual owner and without filing for and receiving a wetlands permit.

So a new permit would need to be issued in order for any kind of residential use. But as I said, the choice is not binary. It's not warehouses or residential use. We have an alternative, the New Jersey conservation foundation and DEP is green acres program. Both have funding available so that the town, if the town wished could acquire that funding and use it to purchase this property from the current owner outright, I can give you the contact name, Tim Brill at New Jersey conservation foundation and Rennie Jones at DEP is green acres program. They are both ready and willing to help the town acquire this parcel so that it does not fall into the hands of developers.

So the choice, you know, this board has before it is not binary, it's not warehouses or residences. They can choose to buy it and add it to the ecological park, which I would like to note the 2005 master plan page 45 explicitly mentioned this parcel, this block, and lot as being ripe for conservation, the 2020 revision did not edit that. It reinforced the general conservation goals of the 2005 plan. So in order to grant this, this rezoning, it would be contrary to your own master plan. So I implore you at minimum to adjourn this reach out to timbrel at New Jersey conservation foundation, reach out to Renee Jones at green acres. See what kinds of funds they can offer so that we have other options available to us. This is a prime habitat that has wetlands and it's at it's. Nearly our house is right off of Mettler's lane, our bedroom overlooks Mettler's lane on the curve, and we are pretty used to the traffic noise, but the trucks are an entirely different story. There is almost zero enforcement of any engine breaking rules. And when trucks go by with an engine brake on the curves, they literally shake our entire house. So truck traffic is extremely disruptive and should be taken into account when looking to develop a warehouse and what is on the edge of that residential area. Also, I would like to echo Mr. Noblock comments that this area a hundred percent should be conserved. It is right next to the ecological park that the town has been so proud of to talk about all the benefits of, there are a lot of animals that live in this area.

There's a lot of wildlife in this area that people don't realize, cause you don't see it on a regular basis, but all that wildlife will be forced to elsewhere or out of existence. If that area is developed. And one of my main concerns is the pervious services that'll be introduced. So all that water run off won't be soaking into the ground. It'll be running off into our local creeks and rivers. As you all may know, we had a fatality right on Staunton road during Ida due to swollen creeks and rivers and tributaries that eventually drained to the Raritan, but were unable handle the rainfall. And that's not the first time we've seen flooding like that. And that's going to most likely become a more common occurrence. We shouldn't be exacerbating the problem by making more impervious surfaces, a have such a huge scale that are going to cause runoff. I vote. I strongly recommend you vote no at this time or put it off until a future time where more information can be gathered and whether this area can be conserved. The council has not only a, a duty to listen to their residents. And it seems that all the residents are almost unanimous on this, that nobody's in favor of this. Thank you.

As of today, it appears that once these companies get in there, they just do what they want to do. So I agree with everyone that's against changing the ordinance to add more warehouses and closing on November the 30th.

And I think that's partly because of a lot of businesses in Piscataway and I, while I'm not a hundred percent opposed to changing the ordinance for business use, I am opposed to more warehouses. I do feel like Piscataway does have a large number of warehouses and while I was kind of looking into Piscataway, you know, I found a couple of articles that almost referred to it as silicone valley.

If I may, before the council votes, whether to adopt this ordinance on second reading, I'd like to provide to you some historical background and context. The rezoning of the 1690 south Washington avenue property can be seen to be in the best interest of the township for several reasons. First and foremost, if a warehouse is not permitted on this property, then the contract purchaser and partners would have the right, the legal right to build 101,000 square feet of retail and commercial space and 242 residential units on the property. Let me repeat that 101,000 square feet of retail and 242 residential units can be built on this site. This retail space and residential unit mixed use was the result of a prior superior court settlement. Let me give you the brief history.  
Speaker 21    01:22:12    Eminent partners filed an application with the zoning board for that mixed juice. The zoning board denied it. M and M partners then filed the prerogative written lawsuit in the superior court and a court settlement resulted. That's why you have facing you the potential for that much development. Unfortunately, the public submissions tonight, whether oral or written opposing the rezoning ignore what could be built on this property. The public comment tonight also ignores the fact that the existing one acre residential zoning is really totally out of character considering recent development in the area in particular, as we all know, a warehouse has existed for a number of years on one side of this property, on the other side, the township earlier this year, we zoned that parcel for senior housing. The township has received a report from our outside planning expert that the current zoning is no longer appropriate.  
Speaker 21    01:23:21    And that a rezoning for warehouse use is appropriate. The 1690 south Washington avenue property is particularly suitable for warehouse use most importantly, because it is located just four tenths of a mile from a full route 2 87 interchange. In addition, no tractor trailers will enter or exit the site utilizing Mettler's lane. Whereas we know there's a stretch on it, where there are all single family homes on both sides of the roadway. In addition, the 1690 south Washington avenue property is really quite a distance from the lake Nelson residential neighborhood and is not next to it as has been suggested. The warehouse option is also superior from a traffic perspective. The warehouse use will generate less trips than a mixed juice of retail, commercial space and 242 residential units. In addition, the trips that would be generated by the warehouse are much more evenly spread over the course of the day and evening and are not concentrated at peak periods.  
Speaker 21    01:24:34    I would also like to add the site is not needed in order for the Tatcha to comply with its affordable housing obligations. The TAship already has a surplus of Koa units after the third round. Some other brief additional reasons why rezoning this property for a warehouse is in the best interest of the township. The warehouse use will have for less of a sanitary sewer demand, as opposed to the large mixed use project that can be built on the site. This reduces infrastructure cost and environmental impact. The warehouse use will also further the townships master plan goal to provide for the continued expansion of the economic base and the tax base of the township. The project is also consistent with the state of New Jersey development and redevelopment plan because this property is located within metropolitan planning area P a one where the state envisions much of the state's future development and redevelopment to occur. So in summary, what this issue comes down to is a choice between either high density housing, with a large retail and commercial component or a warehouse. He was the township attorney for a long time and handles the land use work. That's his area of specialty for the town. And there's just a couple of things that I think really need to be pointed out. And I don't know how many folks are still on the line or not on the line, but the, the, the statement made by certain people who have their own agenda, that this is not an issue of there'll be housing built.  
Speaker 22    01:27:12    If we don't rezone it for warehousing are simply misleading. The public. It's very simple to say I'm against a warehouse development and I'm for open space. Everybody's for that. If that was the choice, I would vote every time to maintain open space instead of developing it for a warehouse every time. But that's not the issue here as Mr. Clark and laid it out. The developer came in and paid a lot contracts for an awful lot of money for that piece of property. And it's a property by the way, if we go back 20 years, we attempted to buy for open space and frankly couldn't afford it. So this is not something we didn't explore, but the developer came in and he wanted to build, let's be clear about it. Folks. He wanted to build a strip mall and 150 units, or maybe even I think it was actually 248 units.  
Speaker 22    01:28:14    So swimming even drops the strip mall component and just builds housing. That piece of property could hold 400 units. So their bill choice is for us. If we turn this down, if we say, we're not going to approve rezoning this for a warehouse, not going to remain open space, that's just not true. And you're being told that, but it's just not accurate. The reality of it is the developer. Who's already filed a lawsuit against the town. It was a lawsuit we were going to lose. We'll develop the property. It will be, it will be identity housing and potentially a strip mall or more high density housing. So those are really our choices. It is a binary choice is one color suggested it was not, there is a lawsuit pending. Some, some of the folks with their own agenda have sued the town, attempting to prohibit the town from providing a variance to allow warehouse development on that site.  
Speaker 22    01:29:19    I don't know how that'll be worked out, but assuming the court grants that assuming the court says that the, there were some vision by the zoning board that was inappropriate. You'll see, what's going to come there. Developer's not going to let it remain open space. Developer's going to build exactly what he wants there. Cause that's what he does. So, you know, those are the choices we're faced with, and those are just the realities of it. I mean, I, I, I don't disagree with anybody who called and nobody wants to see overdeveloped, but we don't have the choice at this point. That's the reality of the legal situation as it is. We don't have the choice of saying we're going to just simply vote. No, and it will remain open space. So w you haven't called for a vote yet, but I just wanted to take the opportunity to explain why I feel it's necessary for us to do this rezoning. Not something we that I do, I'm thrilled to do. I would much rather see it have been preserved the way we originally intended it 20 years ago, but that was just something that we weren't able to do. So I appreciate Council President. You've given me the opportunity to make a few comments. Thank you,

Speaker 23    01:30:56    Thank you, Council President. So I like Councilman con, you know, and I think my colleagues know this from me. I I've hated the application. That first came before zoning many years ago. I hated the idea of it completely. The, the idea that we, you know, have that beautiful park there and then to have to ask counseling con rightfully said, this is a binary choice. And I spoke to a couple of people who called me today, Mr. Noblock I spoke to, he actually told me something. I didn't know. He told me that the folks that he suggested we speak to about gaining dollars to potentially assist the town with the purchase of the property, which I mean, this property is like, I think we're talking like $20 million here for, for this particular piece of property, but let's set that aside.  
Speaker 23    01:32:02    And, and that argument, but actually Mr. Noblock mentioned to me that M and M is in contract with the owner of the land and is not releasing the owner of the land. So that said the township does not get into dispute with private entities on their contracts. So I don't know how in a perfect world, we were going to go ahead and postpone or delay how in the world we would get in the middle of a contract. If Mr. Noblock was correct in saying that MNM is not releasing the owner of the property from this agreement. So all would be for not regardless if that in fact is true, which Mr. Noblock told me today. Now that said again, getting back to my point, I do not like either option here, but I did do some investigating and we have some paperwork here. I'm looking at the lawsuit.  
Speaker 23    01:33:04    In fact, also too, I just confirmed that the developer of the property did apply for his DEP permit. They may need to be revised is my understanding, but did get approval for, I believe in industrial industrial zoning to industrial standards. So those DEP approvals, which somebody said that the developer did not have, in fact, he was approved for it may still have to go back for revision of those, but did receive DEP approvals. So want to set that aside, I'm not looking to get high density, housing or strip mall here. A grocery store, the size of ShopRite was also the intention when he first came before the zoning board. And I don't like that idea either, but that said, everybody knows that most homes have. I think it's calculated at one and a half cars. I don't know how the calculation comes to one and a half.  
Speaker 23    01:34:09    You either have one or you have two cars, but that said, I mean, you're talking roughly, you know, more than 560 close to 600 cars that could potentially always be coming and going from the residential only piece of what M and M would be entitled to get, if we voted no on this, then let's take into consideration the retail piece. In fact, as Mr. Clark and stated, you're talking about tremendous amount of trip generations, there will be limitations to my knowledge on the trucks going into the Mettler's lane area. They'll not be able leave the property to head in that direction. And, and of course the owner would have to be before zoning again anyway, for all site approval. So he doesn't get to just build anything. He would have to come back, but that said, I'm not willing to allow this contractor. Then if we say no, and if this lawsuit is successful in denying him the warehouse, he's got every right to go and build that residential and retail that mixed residential and retail, he's got every right to do that.  
Speaker 23    01:35:40    And we don't have those funds that Mr. Noblock talked about to go ahead and just buy and nor do we have the ability, I guess, to break a contract that he told me M and M will not release the owner of the property from that said, you know, no one on this board to my knowledge is jumping up and down and super thrilled about this at all. And as far as location to the school, the, the applicant still would have to have a certain amount of distance buffer from the school building buffer, similarly to a development that was put on river road. And that is all I have to say about that piece. I do want to make one comment when somebody was quoting us. I think it was Mr. Rec about taking the trucks off river road. I think I live on river road. And so that would be one council person who lives on river road. There are others who live in close proximity, but I am the only one who lives on river road. So I just wanted to clarify that piece of it as well. Thank you, Council President.

What they have asked of the town is to be allowed to have a small retail showrooms so that Piscataway residents can come in and look at plumbing supply, similar to what the office supply company WB Mason has at their facility in order to be able to have that retail small outlet in the building, they needed an amendment to the redevelopment plan. The other thing they had asked for was they wanted to store their materials out doors. The mayor, the planning department, and, and others felt that an outdoor display was inappropriate and they are requiring if they're going to have an outdoor display, that there be a three-sided building with a roof solid materials to match the existing buildings. And we looked at this, I had some questions about it and I don't know why that is. So I think that's why the resolution is drafted the way it is. Think of most public officials I believe should be rewarded, but we are at a juncture in this country where in some cases the public compensation are actually exceeding cyber compensation and public compensation that are built on tax rolls. So if your public compensation is higher than private compensation, I think we are going to distort the whole tax system in this country. And on top of it, public officials have the luxury of lifetime pensions along with six figures and sometimes a higher six-figure salaries. So what we are doing is essentially inflating their salaries. This eventually would lead to inflation that we are seeing in real economy, debasing our currency. And also it's going to create a lot of leverage into the stock market, which our future kids and grandkids are going to pay for which you are making decision today. So I want to be very mindful when public salaries are talked and I understand the risk for fire. So certainly they would be, they should be rewarded, but it should be designed in a way by accounting, private and public salaries, rather than just comparing public to public salaries. Thank you,

And the concern was that we didn't have enough information to recommend to the council for the council to feel comfortable approving someone's salary, who was doubled what the other salaries were. And that's the reason we're doing it this way.

I've talked to a number of residents in the last week or so about this issue, you know, a lot of them, and I don't mean this as a negative comment, so please don't take it that way, but many of them have not been fully informed. And I know I'm sure that caller's gonna call back and say I was wrong. It's not a simple choice of one or the other, but you know, th the management of the town with respect to zoning and land use and where our tax base is going to come from and where housing is going to be developed and how much housing are complicated matters.

I don't profess to be an expert because I think the issues are so complex that not one person could be an expert in all of these things, but I just want to assure the public that we're not a group of folks who are not in favor of protecting the environment. We've taken many steps in that direction. And we really do have a choice. The reality of is we have an aggressive developer who by the way, is not a campaign con contributor, as, as many have said, who is going to develop that property. And he's either going to build housing and, and retail in an area where that, I think that would be terrible, or he's going to build something else that we've approved the zoning for it tonight.

I spoke to somebody at the community center tonight on the issue, but, but I would urge folks to get more information beyond what they may have seen on Facebook, or they may have received in a text message or a robo call, or some other message that had a political agenda and then, and then think the issues through. So I just wanted to make that, that, that comment, I don't want folks to think. And I, I, my colleagues can speak for themselves, but I don't want folks to think that we don't appreciate hearing from the public because we do so that, that said once again, happy holidays to everybody. I could say that, you know, our emergency management and our volunteers are well versed in all aspects of an emergency, but when you have a, a large tornadoes that tear through level whole towns, that's a whole nother issue when you really need mutual aid. So I hope, you know, I'm glad to see that the president Biden's going to be coming into that, that region tomorrow, as well as the federal government coming in to help our fellow citizens out in that part of the country.

This is again when Jack mod is field fill anyone, I think to a certain extent mirror and the zoning is missing to Jack Morris had to provide 3000 people rent relief. So if you guys gave him whatever property tax abatements and all that kind of stuff to generate this income, how come this 3000 people were not able to pay rent during COVID in last two years? So the economic policy is totally bogus. Second part of it is when we are talking about political contribution, whether to township or whatnot, I would like complete transparency. And if, if, if it leads to providing his tax returns and, and, and make it public, that how much money has he been given as tax abatement versus actual revenue generated from his promises? And the third thing is by just giving big developers tax abatements, and right up to a certain extent, it does bring some benefits, but in today's day and age, I think what's happening with pension funds and whatnot.  
Speaker 2     02:18:16    We are getting into an area of equity, this distortion, and also creating social inequity with tax abatement and, and, and, and to a certain extent, allowing certain people to play with inside information that the public is not aware of it, thereby just excluding them from participating in real economy. So I think what is happening is think of it as a forest with big trees end up in the end and the young kid can not develop because they are in the shadows so much big trees that they can't see anything. Or if they're trying to do meaningful projects, they can't do it because of all these bottlenecks that are posed to them. And if Jack Morris owns bulldozes, I'm sure those will lose, can be used for better use than just building warehouses are or housing or residential construction, because this is, this is one land that if you look at it as a heritage, 50 years down the road coming to Piscataway, if it's left open, I don't think 20 million in, in Jack Maurice's pocket would make any difference, but it would make a whole lot of difference for four 50, 4,000 residents who called Piscataway as home.

Can you tell me as chief Mosher on the call Bali, you've got three minutes to talk. So keep going. Okay. It's a mystery. If the chief is on the call, he wrote a letter though, on January 19th to a resident Ms. Council in it, he writes dear Ms. Council, I write in response to your letter dated January 7th, 2021. I regret any lack of oversight that allowed Mr. Jones to utilize his Piscataway police sign in to the website. After the termination of his employment, he goes on to make more excuses and then has this quote quote, his error in judgment was a criminal act.  
Speaker 17    02:20:47    And my department took swift action to charge him with a crime. It is a crime that is against the state and not an individual. I just want to be clear. He's talking about ex dispatcher for the Piscataway police department, Mr. Ronald Jones, who is now in the Middlesex county jail, serving a sentence for that criminal act. This letter concludes with a statement, quote, I want to assure you that steps have been taken to prevent this type of breach from occurring. Again, I think the public has a right to know, and I, for one, want to know what steps have been taken to prevent overzealous police from abusing their privileges in this case, apparently even after they've been terminated. And let's clear up the record right now tonight was dispatcher Ronald Jones fired or did he resign in disgrace? Does the mayor slash public safety director have any comment on Mr. Jones, guilty plea for his computer crime or for his sentence and jailing? How can the public have confidence in the township cyber security practices after multiple major failures like this? Isn't it true? The township lied to the state on their best practices, worksheet regarding cybersecurity practices and has the, the municipality corrected those errors in their false statements in the best practices, worksheet mayor, public safety director while, or what do you have to say for yourself and

And despite what Councilman content you, no one at this council took the opportunity to reach out to timber hill, that New Jersey conservation foundation, to see how much money they were willing to contribute, to reach out to Renee Jones of NJ DEP his green acres program, to see how much money they were willing to contribute, to reach out to Rick laser up of Rutgers university, this experimental forest, to see how much they are willing to contribute Richard Leer of Middlesex, county's parks and recreation to see what operational assistance they're willing to offer. And yes, I did say that that M Realty was not willing to let the, the current property owner out of the contract, but that's because that the, the, that entity would suffer some penalties, some breach provision that we don't know what it is.  
Speaker 12    02:26:27    If that breach provision is purely a financial penalty, perhaps then perhaps Kim real Renee Jones, wrinkly it's hard for any of the other folks would figure out a resolution. That's something that we don't know because no one from the town investigated it. So our choice was not binary and echoing what someone else here said that they're experts testified under oath, that it was an economic hardship for them to do sanitary sewer for residential development. There was no risk and there remains no risk that this property would be developed into residential uses because of that economic hardship that they swore under oath, they would face and to correct Ms. Kay hill, there is no DEP permit for any residential developments.

But they would need an entirely separate permit, a new application and a new public comment period, an entirely separate permit for a residential use. It would be fundamentally different and they would have to start all over. Some of the things that council members have said tonight have been manifestly incorrect. I, I, you know, I I'm at a loss for words, and except that I just want to express my extreme disappointment and to correct the, the false things that were said tonight. You're disingenuous clients that somehow a warehouse is better than in a feasible high density. Housing were only made after the residents came out and forced to oppose the measure rather than postpone the decision to allow an open dialogue with the residents of this town. You ignored our concerns and claimed we have no idea what we're talking about saying that you have no choice. And that this development is the lesser of two. Evils is an absolute cop out. I am betting that if this were house attempt, we're in the close proximity to where you live near river road. There would've been a different outcome. Additionally, your insult about our grassroots community organizing against powerful development and your faceless corrupt local government will not soon be forgotten. Good night

I am disappointed, but not at all surprised that the folks who've spoken out about the warehouse and twisted yourself into logical pretzels to try to make sense of what you've done tonight. Is it, your, your behavior is really just in incomprehensible. You are elected to do a job for the people of this community. More than 70 people participated tonight and not one single solitary person spoke out in favor of this proposal. And yet you went ahead with no timeframe. There's nothing that says you had to do this tonight. You absolutely could have had a public hearing. You could have had a debate. Mr. Khan says that people have their own personal agenda as if he doesn't come to this council meeting was his own personal agenda or that all of you don't come here with your own personal agenda.  
Speaker 4     02:31:23    Many of you are either have either business interests or your family or other people have business interests in our community. And you come with quite a long list of agenda, agenda items. And so to imply that people are doing something other than coming to this discussion as resident community is really, I'm sorry, Mr. Khan, I'm speaking. I come to come to this meeting with something other than the best interest of our neighbors and our neighborhoods is really just disgraceful. If you don't want to listen to people and you don't want to do the work and find out what the facts are, then maybe this isn't really the right job for you. Maybe you should step out and do something different, but there are actual facts in this case. And Mr. Clark and grossly misrepresented them, there is nothing in the current zoning that requires, or even permits 242 homes to be built, that that deal was gutted and is not going to happen as testified to by the developer themselves.

But assuming that you got some sort of information from them, or maybe you just rely on Mr. Clark and information, but what he, what he said is not accurate, and you could do your own due diligence, which we know from previous experience is very important to this council. So you could have looked up all of the facts of the case, and you could have followed up on some of the opportunities. Mr. Khan likes to say that 20 years ago,

I called by a Catholic decision tonight, but to move away from this development, I can't believe that out of 20 fire district commissioners out of 2020 by our district commissioner, that's five commissioners and every district four districts in the town, he only commissioner the stipend that was refused tonight was Mr. Omax the, the commissioner from north Stellan from district number four. He person who sat in, I believe the meeting with the township where they asked to meet with JFK. Then the service provider for EMS, where they were told that they could not meet with that service provider. The same meeting where river raid was not invited. Even though it's section 2.2 of your contract that states that you guys already had meetings with all the emergency services organizations in town, which is a gross misrepresentation of what's happened.  
Speaker 28    02:35:05    I cannot believe that you guys have taken another shot across the bow. People have gone out. They have voted. There has been a petition item that passed it is ordinance. Now it's soon will be, if it's not already, like we need to stop playing these games with our residents. Your residents are speaking to you directly through legislation through these meetings. I don't know how you guys are going to continue to go on this path. Once everything goes back in person, at least for Piscataway now, most other communities have. I don't know why we haven't yet, but we're going to continue to. She keeps showing up in math. Our residents deserve what our residents deserve. Stop taking the land, stop taking, stop taking people's land for no reason. Stop redeveloping land for usage that the county, the community doesn't want to see and let us, let us be involved. Let us serve our community. There is a massive shortage of healthcare providers in this country on every single level, every day, EMS one gem, CNN, MSNBC, Fox. They keep putting out publications. There's huge shortages of EMS providers. Huge. And you guys are banning us a functional entity, and you guys never say that it's river road that can't stay in service.

And because I cold called the police, we're getting punished. The residents are getting punished. Stop punishing us. If you guys don't want to be an office redesign, this is unfair. This is not right. And it's all documented. I cannot believe that the mayor went to the league of municipalities and attempted to make it harder for us to legislate via petition. The only sponsor of that resolution to petition our legislator, Mr. Schakowsky, your time is done.

Speaker 21    02:37:28    Council President of the, the public portion close. I just want to comment on one or two quick items here. You know, when Mr. Costello called in earlier today, you know, he made a valid point about diversifying, you know, the economy and everything to that effect. One of the things that the council and the planning department has done over the last, oh, I'd say six or seven years, is that we've really tried to take a hard look at diversifying. Now, back when I was growing up in town as a kid, I hear, you know, we were heavy manufacturing, petrochemical sites. We now have morphed into big time telecommunications, data centers, cosmetics, food, science, transportation, data centers in other entities, like for instance, transportation, we have Kinka shero and strata, which does a lot of train parts and putting trains together. But I just want to read a quick list of a lot of the companies that have moved in town within the last several years of, yeah.  
Speaker 21    02:38:34    Bob's furniture. You have a cooling Nagy Fujitsu, human scale, best buy kiss, AC Shi cascade. You have also Cambridge farm pharma, which did a major expansion or pharmaceutical company dream on me, which is a very, a large communications company in Fisher Pikal for those folks that like high-end kitchen appliances right there. And then we also have a national manufacturing company and a general supply company. And then also we have a new company that did during the pandemic on circle drive is making roughly several hundreds of thousands is a 95 mass every day for, for use for people around the country. So we've really tried to diversify. And what has allowed our town to do is that we've been over the last four years, we've been able to rebuild approximately 60 roads. We've installed more sidewalks, you know, in the last several years in the prior 10 years added more bike lanes for people to use.  
Speaker 21    02:39:40    Approximately two thirds of our parks have been retrofitted and now are all federal ADA compliant. The last third, and we'll be done in 2022 more amenities are in the parks like pickleball courts, volleyball courts, additional basketball and other amenities, as well as benches and things of that nature. And then this allowed us to retrofit and improve the new market pond area. Whereas many people know we have the summer concert series and now we have additional parking and scenic overlooks and allow for wheelchair accessibility there along the walkways and the path. And the last phase will be finished up probably sometime next year, you know, and that is in conjunction with the revenue that a lot of economic development does allow great recreational programming to happen recreation department, and as always the, our beautiful community center and which also access as many people know as an emergency evacuation site and despite park that has allowed also for have a national award-winning senior citizen programs that are senior centers to be done with. So during the pandemic and the downturn, you've had a lot of surrounding communities that basically either had to lay off teachers or police, fire, or other government workers.  
Speaker 21    02:41:10    And you know what Piscataway, we didn't have to do that to do that because we were well diversified and position to handle a downturn, even during the pandemic. So I think that the council and the planning should continue along that line to continue to bring in more revenue in and potentially more jobs into our community. Given the fact that our state has the second highest unemployment rate in nationally. I, I, I think it's disingenuous of a couple of people saying that we shouldn't bring jobs in. So I think we will continue to try to keep our town affordable as best we can and continuing providing services and more jobs and more revenue. You know what, because I don't want to be like other towns where they've had to lay off teachers and police and fire, because I believe that all those jobs are very important for the economic liability in the lifeblood of our community.  
Speaker 21    02:42:13    I would like to mention though, there was a couple of people that did make some comments. I know Ms. Berger just made some comments saying that, you know, some of the council members don't know what the heck they're doing and things like this is coming from the individual who swore up and down that people were going to save on average between a hundred and $150 a year during the aggregation that they peddled that the voters did pass. And now the voters solely rejected by opting out two thirds. You know, obviously they're saying that the town fumbled the roll out of that, which is absolutely not true, that was followed to the letter of the law. It was just an utter failure for the word go. And then the credit zero credibility from her. And I know Mr. Johnson did call in as a private citizen, but allegedly, but it was very interesting that him and two other board of education members did sign on to the lawsuit.

So I'm assuming that as far as Mr. Schiff, Evan's Chevelle calling up, I think he should get more sleep at night because instead of going down to Muellenberg hospital and putting shining lights into the buildings down there, I think he should stop doing that and get some more sleep at night.
