Brenda Smith (Chair) Item number 11, we have a discussion on the redevelopment plan for block 2 0 1 lot 1.01 and block 2 0 2 lot 42 dash oh two.
James Clark (Foresight Planning) Yes. Good evening. Members of the board, James Clarkin here to present to you all at the South Second Street redevelopment plan. So I believe I'm sharing my screen. So I'm gonna walk through my report that outlines the plan. So the redevelopment area encompasses two lots as well as a portion of the right of way of South Second Street. So we're looking at 1791 and 1776 South second Street, which is block 2 0 1 lot 1.01 and block 2 0 2, lot 42.02. As I mentioned, apologies, this does include a 355 foot right of way of South Second Street because the two lots are on either side of the street. And I'll show you a map in a moment just to give everyone a refresher on my introduction page. You'll, you may notice that we cite two different resolutions. And if you recall, the reason was for that was the first in needs study did most of the area, but there was a portion of the South second Street that we needed to include. So that's what that second resolution is for. So I am going to jump to the map really fast. Right. So we have the two lots on either side of South second Street. So South second Street is basically parallel to the railroad tracks, which are kind of in that northwest corner of the map and it dead ends right into the borough of Dannel. So this PA redevelopment area is definitely right on the border with the borough up down on the edge of Piscataway Township.
James Clark (Foresight Planning) So now that we have reoriented ourselves and now we know which area we're talking about, I wanted to go a little bit of an overview of the plan. So this redevelopment area is zoned for your light industrial one and manufacturing one zones. The character of the surrounding area though is really mostly residential uses single family neighborhoods to the southeast and east are proximate to the redevelopment area, particularly in Piscataway. But then there are some newer residential communities in Dannel. So Dannel at Dannel station and the crossings at Dannel adjoin the redevelopment area within the borough of Dannel. And these are all very close to the existing NJ transit station there as well.
James Clark (Foresight Planning) So the proposed use that we are envisioning for this redevelopment area is also residential in nature and specifically to meet your Fair Housing Act requirements so that affordable units can be provided to meet your fourth round requirements. So residential is the overall land use that we are looking for. And as I mentioned that it's on the border of the borough of Nellon. So it contemplates that the redevelopment area will be developed in conjunction with the adjacent parcel in the borough of Nellon. And in my plan we've dubbed this the dannel and parcel. So the really the vision is to develop the whole project as one residential project even though it will need separate redevelopment plans in the borough of Dannel Township isca, which is what we're here for. And also separate site plan work approvals.
James Clark (Foresight Planning) And just for reference, the Dannel Dannel and Parcel has an existing redevelopment plan that the borough of Dannel adopted in March, 2026. So that was earlier this year. Let's see, page four of my report really just goes over the area boundaries, which I kind of already highlighted when I showed the map. I'm trying to see if there's anything I want. Oh yeah, the, the site overall is 14.4 acres. The one site on the north is the smaller 1.6 acre and the one on the south side of South second Street is the larger par sage, 12.8 acres. When I did the redevelopment or in need study, really the uses there were more truck storage of outdoor vehicles and warehousing, oh sorry, keeps jumping on me. So as I mentioned, we had the, yeah, so we went over the parcel and as I mentioned the redevelopment plan consistency with the borough to is what we're envisioning. I apologize.
James Clark (Foresight Planning) PDF does not want to cooperate. There we go. So because of these, we'll this will act as one overall residential, it's really important that we have these cross access agreements and shared amenities between the two redevelopment plans because they will, in real life, they'll act as one development. So we, on page five I put in cross access agreements that will be required for parking, pedestrian and shared circulation elements and make sure those are reported appropriately as easements for sanitary sewer. It's envisioned that the township has agreed to take the flows for all residential units, both for the Piscataway Township units and also the dannel and parcel units as long as they pay the required connection and use its fees. And then the shared recreational elements I can show in figure two in a moment, which is towards the end of my report. But it's envisioned to include a tot lot a dog run and a walking trail with connections to Columbia Park in and also Hazelwood Park in Piscataway. So I think that the recreational portion of this will be quite robust. And then finally, since they are will be shared cross access agreements, we wanna make sure that police, fire and emergency services are also covered. So that's under H On this page five,
James Clark (Foresight Planning) See I'm gonna go over the goals and objectives of the plan. So we're looking to create land use requirements specific to this redevelopment area that effectuate the development of the underutilized parcels such that they increase tax rateables and are appropriate land uses within Piscataway. As this rule is envisioned to provide 36 affordable housing units, we definitely feel that this is an appropriate land use for the township of Piscataway. And further we're looking to clean up a contaminated brownfield property and transform it into a productive asset, which is definitely always a good goal of any township. So moving on to the land use plan, I'm gonna go over the permitted uses. So principle permitted uses, as I said, residential townhouses. We're actually using the definition that already exists in your zoning ordinance. And then we're adding something called a stacked townhouse. And this shall mean a dwelling unit within a multiple dwelling building consisting of a maximum of three habi habitable floors and separated from any other unit by one or more vertical and ho Yeah, horizontal fire resistant walls.
James Clark (Foresight Planning) Towards the end of my report I can give a little rendering that will kind of show what a stacked townhouse looks, looks like. As I mentioned, I went over parks and outdoor recreation areas. We have bedroom distribution in total we're looking for 164 units as of of which 36 will be affordable units. As I mentioned, the permitted accessory uses and structures are typical for what you would see for residential development of this size. We have the recreation facility as the sidewalks, grass parking lots, et cetera. And actually while we're on this subject, this is the conceptual site plan for the redevelopment plan. This is figure two in my report. So I'm not sure if you can see my mouse, but South second Street comes down here and we will enter the development. So this is the one lot that's 1.6 acres that will have some units on it.
James Clark (Foresight Planning) And then the bulk of it will be on the larger lot, the 12.8 acre lot. And then there is a, an existing creek. So the redeveloper will have to work with DEP for permits and wetland compliance and all that good stuff. And then you can see, it's a little hard to see, but there's a red line that kind of goes around the dog park. This is a dog run and then there's a red pathway that is the nature trail. Try and zoom in a little bit, see if we can help you out. Yeah. So residents would enter from here, walk across and be able to use the nature trail in the dog run. While I'm jumping pages, any questions
Speaker 9 I do Mr. Barlow, I just wanna make sure when we do this plan that we have some language in the plan to that the silt that builds up in that brook where the pipe is for Hazelwood place, that the applicant will have to file something with the DEP to make sure they get that cleaned out. 'cause I know that's always been an ongoing issue and public works couldn't do anything 'cause it's private property. So I just wanna make sure that they're aware of the problem that they, they'll have to maintain that.
Thomas W. Barlow (Planning Atty) Well I, I'm assuming, and Jim will correct me if I'm incorrect, the applicant's still gonna have to file for a site plan and everything else, so they're gonna be back before the board.
Speaker 9 No, no, I understand. But I'd rather,
Thomas W. Barlow (Planning Atty) And at that point that would be a condition of approval obviously,
Speaker 9 So
James Clark (Foresight Planning) Yeah, understood. Mayor, I think that could fit that into either utilities or I think you even have a stormwater section in here somewhere. I can note that problem. Yeah, sure. That's
Speaker 9 Fine. That's fine. Yeah.
James Clark (Foresight Planning) Okay. Okay.
Thomas W. Barlow (Planning Atty) And then we'll just make, make sure we make a note that when they come, the applicant comes back before us, that that can be a condition of approval also. Okay.
James Clark (Foresight Planning) All right. Moving on to parking and loading. So since this is just residential units, we're requiring minimum parking requirements by bedroom unit types. So if a two bedroom unit is constructed, they'll have to build one and a half parking spaces. If it's a three bedroom unit, it'll have to be two spaces per unit and as required, they'll have to follow the state requirements for EV charging. We did put a one small condition where let's say since it's one and a half spaces for two bedroom units, let's say it ends up at like 0.65, we would have them round up, but they are allowed to put that parking space on the Danelle and portion if they so wish. But that, that's probably a minor thing that will be more likely handle that site plan as MS mentioned. Yeah, here's utility. So this is exactly where I can put in the storm water. I am requiring the adding fiber optic cable along South Second Street frontage.
Speaker 9 And also we should probably add in that there should be decorative street lighting in that we have like on the route 18 where we have the, the black lights with the township seal on it.
James Clark (Foresight Planning) Got it. Yeah. Just like we did. Or you asked for in 44 stepton.
Speaker 9 That's correct.
James Clark (Foresight Planning) Got it. Okay. Noted. Okay. The rest of my plan is really covering the odds and ends like solid waste disposal is pretty typical for signage. We're allowing one freestanding monument sign that will be appropriately sized lighting. They are allowed to have up to 25 feet. However, if the light fixtures within 200 feet of any nearby single family home has to be lower to 20 as we wanna make sure there's no light shining into any windows. Landscaping will definitely be an important part of this. We're requiring a landscape buffer along any adjacent residential properties. So this will be a berm wherever grading conditions and constraints allow the idea being that it would be a three to four foot berm in height and would also be planted with evergreen trees, shrubs, and other foliage to make sure we have a good buffer between any existing residential land uses.
James Clark (Foresight Planning) Additional design standards really goes over fencing, which mostly co mirrors your existing ordinance covers roof mounted equipment, which may not apply as much here, but they do have to be properly screened. If they are built, if there's any existing easements, they have to be vacated to effectuate the new redevelopment. Further, this is important, the redeveloper, if they ever include home offices in any of the units, it is required that they not have closets and that the Master D will prohibit the use of home offices as bedrooms. This is really to prevent adding an additional bedroom in any units. I lightly touched on the environmental assessment. The burden really falls on the redeveloper to fall DEP to make sure they have appropriate buffers from the stream and the wetlands. The re I believe this redevelopment, sorry, was there a question? Yeah. Must have been background noise playing consistency roots consistency review. This is in my professional opinion, consistent with your master plan. It's consistent with the redevelopment plan next to next door for the borough of Nel. And further it's consistent with the state development and redevelopment plan.
James Clark (Foresight Planning) Just wanna do a quick conclusion that, so the redevelopment plan has definitely outlined and delineated def definitive relationship to local objectives that are in your master plan. It has a clear permitted use within this redevelop plan that is residential and that 36 affordable housing units will be built and go towards your fourth round affordable housing requirements. A total of 164 townhouse units will be constructed as envisioned. It's substantially consistent with your master plan. And this is a non-con condemnation redevelopment plan. And actually before I take questions, I just wanted to show some of the rendered elevations to give you an idea of the market rate stack townhouses and then also affordable stack townhouses. And this floor plan kind of gives you an idea of what a stacked townhouse is. So the unit in pink is one unit and then the second unit is almost stacked on top of the other one or one unit on the ground floor. One unit is in the rear with stairs to the upstairs and then the other unit is in the front with the upstairs stacked on top of it. So with that, I can take any questions?
Speaker 9 Hmm, Madam, Madam chair. I just have one last comment and question. The provision where we're gonna have in the plan that prohibited with a deep restriction about converting the office space room into a bedroom. I, I think there should be a yearly inspection of that required. And how I, I don't know Mr. Barlow, do we take care of it on both ends? Partly in this and then in the site plan approval?
Thomas W. Barlow (Planning Atty) Sorry, I was muted there. I mean Jim can throw a line in there, but frankly once we need an application and an applicant to agree to it or make it a condition of approval, but if gets in the redevelopment, give it some teeth,
Speaker 9 The redevelop redevelopment plan backs it up. So I'd rather have it in the redevelopment plan also.
Thomas W. Barlow (Planning Atty) That's fine. Jim, you can add that
James Clark (Foresight Planning) Absolutely.
Brenda Smith (Chair) That's in the room that's designated as an office, there's gonna be no closet and a deed restriction.
James Clark (Foresight Planning) Correct.
Speaker 0 So that's what we're adding into the plan.
James Clark (Foresight Planning) That part already exists. The mayor was asking that we add yearly inspection to make sure compliance, but to Mr. Barlow's point, so I'll just add that line in there. And then when the applicant comes before them, you can add the essay condition.
Speaker 0 Really e even if that's a a, a homeowner's house like owned, you can inspect their home for that.
Speaker 9 You wanna make sure they're not in viol violation of the
Speaker 0 No, I'm just saying is that that's, wouldn't it be considered private property? I mean, Jim, do what kind of, oh, I'm sorry. Go ahead. Go ahead Dawn. No, I wasn't
Speaker 10 Sure. Are these, do we know if these are gonna be rentals or for sale units?
James Clark (Foresight Planning) Just asking myself that these may be rentals.
Brenda Smith (Chair) Yeah, I think it, let me confirm it's different for rentals as opposed to ownership.
Thomas W. Barlow (Planning Atty) Well we can put a line in there that's subject to inspection as allowed Yeah. Pursuant to New Jersey law, something of that nature till we get more information.
Brenda Smith (Chair) Okay. Is that your testimony, Mr.
James Clark (Foresight Planning) Clarkin? Yes, I am. Concluded. I said everything I need to say, so happy to take any questions.
Brenda Smith (Chair) Okay. Any questions for Mr. Clarkin?
Speaker 0 Madam Chair? I don't think it's a question, but Mr. Clark and I saw another plan recently that was sort of a similar thing where the, one of the spaces would be a den, but or a, it was maybe a laundry room I think. And in the laundry room was a closet.
James Clark (Foresight Planning) Okay.
Speaker 0 That the shared the wall with a, a home office that did not have a closet. Hmm. So I'm just, you know, like I saw, I, I think that was some new homes that are going up in town. I, I just saw like some floor plan suggestions and I thought, well if somebody really wanted to get creative they could, you know, cut the wall into the closet that's in the laundry room. So I don't, I don't know if you can really do that, but I would just, you know, I just thought it was very interesting. I mean, a couple of ways to, you know, get around things and I thought it was just kind of interesting that a, that a full closet was put into a laundry room that shared the wall with a home office that had no, you know
James Clark (Foresight Planning) Yeah, it was
Speaker 0 Not considered a bedroom in the plans
James Clark (Foresight Planning) But was shared the wall.
Speaker 9 Well the only thing councilwoman I could think of is that somebody they're keeping potentially their, their table linens and stuff
Speaker 0 Like that. No, no, no, no, no. I'm not saying that why you would have it in there. Yeah, I'm just saying is that since the closet shared the wall Yeah, someone wanted to get creative. They just cut the wall, you know, unless it's a rental,
Thomas W. Barlow (Planning Atty) Don't, don't give them any ideas.
Brenda Smith (Chair) You know, people are gonna be creative if they need someplace to sleep or whatever. Yeah.
Speaker 0 But I don't know
Brenda Smith (Chair) What our ways You can only go so far within the limits of the law, let's face it. Right,
Speaker 0 Right.
James Clark (Foresight Planning) Well when the developer comes before the board, definitely take a look at their floor plans.
Brenda Smith (Chair) Okay. Any, any other questions for Mr. Clarkin? Okay. We're gonna open it up to the public at this point. Members of the public, you've heard the testimony of Mr. Clarkin as does this proposed, proposed building development. If you have any questions, would you please indicate by raising your hand or dialing the number?
Speaker 0 You could dial star six if you're on the phone or raise your hand and I'd give permission to speak. I now one Madam chair.
Brenda Smith (Chair) Okay. Close to the public if you've got any. No more questions. What is your pleasure? Members of the board for this motion, which would is for a non condemnation redevelopment plan proposal to go before the town council.
Speaker 0 Madam Chair, I'll make the motion that the board vote to approve this non condemnation redevelopment plan to go to town Council,
Brenda Smith (Chair) Do we have a second?
Speaker 0 Reverend Kenney? I'll second that
Brenda Smith (Chair) Motion. Thank you. Roll, roll call Mayor. And with any of its attendant,
Thomas W. Barlow (Planning Atty) Madam Chair, just before Laura calls the role, I just would like the record to reflect Mr. Foster is now present, but I don't think he was here for the whole presentation. So out of abundance of caution, I would just instruct Laura not to call for Mr. Foster's vote on this matter. Just the eight members who were here for the whole presentation. Okay. Thank you.
Brenda Smith (Chair) So instructed roll call please. Ms. Buckle.
Speaker 0 Mayor. Mayor Wahler? Yes. Councilwoman Cahill? Yes. Ms. Corcoran? Yes. Ms. Saunders? Yes. Reverend Kenney? Yes. Mr. Adkins? Yes. Mr. Echevarria?
Thomas W. Barlow (Planning Atty) Yes.
Speaker 0 And Madam Chair?
Brenda Smith (Chair) Yes.
Thomas W. Barlow (Planning Atty) And we have a resolution
Brenda Smith (Chair) For Ms. Saunders.
Speaker 3 Yes. Madam Chairman, I'd like to moralize the resolution for recommending adoption of the redevelopment plan for South Second Street in Piscataway Township, New Jersey.
Speaker 0 I'll second that. Thank you. Mayor Wahler? Yes. Councilwoman Cahill? Yes. Ms. Corcoran? Yes. Ms. Saunders? Yes. Reverend Kenney? Yes. Mr. Adkins? Yes. Mr. Cheveria? Yes. And Madam Chair?
Brenda Smith (Chair) Yes. Okay. Item number TH 13. There's a courtesy review of the Quibble Town Middle School Solar Projects. Someone here to cover that.
Speaker 11 Yes. My name is Anji Braxton. I am the design engineer for the project in question. And I just want to review this with the town here. Let me share my screen for our plans. Let me know that everyone can see my screen. Yes. Yes.
Speaker 0 Okay.
Speaker 11 So this is going to be a rooftop solar installation at the Cool Town. Middle school is approximately going to be 553 modules with the size of 342.9 kilowatts DC It's going to consist of multiple roof locations, specifically looking like this. This is a actual zoning map of the surrounding area. All property and zoning setbacks have been observed as the front setback is 50 feet. The side setback is 50 feet, the rear is 50 feet and the building setback in total is 25 feet. No other outliers around the building will be disturbed. It is specifically a rooftop insulation to replace what was already there previously. As that has been removed,
Speaker 11 And again we are follows the same methodology, we are maintaining our setback in the fire pathways of any fire lanes with any, with the applicable IFC 2021. And again, this just goes through what we plan to do. All the installation and all the installation will occur on the roof terminating into the electrical area in the electric room in the building. It will attach directly to the existing electrical service interconnecting. That way it follows all applicable codes of the NEC, the National Electric Code. And again, it goes through specifics. I would want to go back to the zoning aspect of, and reiterate, no property will be disturbed as all the setbacks have been maintained from any point of the building. Again, this is a new installation for the Cual Town Middle School that will occur pending the approval of the board for the courtesy review.
Speaker 12 Okay.
Speaker 11 So I will, does anyone have any questions on the parameters? Anything about the system itself, anything about the installation or surrounding area? Please feel free,
Speaker 9 Madam Chair. I just have a very brief question in regards how much energy you're expecting to generate in the savings with this project that was costed out
Speaker 11 The energy. I can bring that up. Gimme one second. Okay. For, for this system, we're estimating that it will approximately produce 479,770 kilowatt hours a year based on the system size and estimation. If you would like to see something else, we can submit a production report for you so you can see what that the system is going to be capable of. But that's the approximate estimation for the system in its entirety.
Speaker 9 All right. And, and then Madam Chair, just outta curiosity, who, what, who, who are the, the electricians that are gonna be installing this,
Speaker 11 That would be Supreme Solutions? They are on,
Speaker 9 What's the name of the company? Supreme
Speaker 11 CPR Solutions. They're represented on this call as well. Oh,
Speaker 9 Okay. Alright.
Speaker 13 Yeah. Hi, my name's Andy Musser. I'm the project manager for CPR Solutions, the electrical installer for this project. We're currently working over at Piscataway High School right now, installing solar on the, we've top there. If you have any questions regarding the installation, I could probably help you out with that.
Speaker 9 No, I just wanted to outta curiosity what you know are, are they localized union electricians or they from the area? What's the story on that?
Speaker 13 We're actually from, from out of the area. We're located in Central Pennsylvania. Okay. We, we were hired by the Piscataway Board of Education to perform the work. We've got a pretty long history of electrical installations and focusing within the last five years on institutional solar installs
Speaker 9 In the state of New Jersey.
Speaker 13 The state of Pennsylvania and New Jersey. We are, we are licensed in the state of New Jersey.
Speaker 9 Okay. I might just, I I'm, I'm just saying I know this has nothing to do with the application. It would've been nice if we had some local unionized electricians on the job instead of no offense to folks in Pennsylvania. But you know, we like to keep our tax dollars here locally, so
Speaker 13 Understood.
Brenda Smith (Chair) In a, a meeting I'll call you back
Speaker 9 That, that's the only question I have. Madam Chair.
Brenda Smith (Chair) Any other questions for members of the board? Okay. Here is, we don't, do we need to Yes. Open it to the public. Okay. Members of the public, you've heard the testimony given by Mr. Oje? I think his name was. Yeah. Mr. Braxton. Mr. Braxton, if you have any questions you may do so by either waving your hands or dialing the star. Nine I think
Speaker 0 Star six. Star six. We have Richard Sche.
Brenda Smith (Chair) Okay. There's a question Mr. Schein, come forward and give your name and your address please
Speaker 3 And swear in Mr. Sche.
Speaker 0 He's muted.
Speaker 5 Go ahead. There he Hello? Can you hear me? Yes. Okay. My name is, my name is Edward SoFi Richie's setting it up for me. I represent the Middlesex County building trades, all the union building trades. I am personally an electrician, 50 years of service. I wanna let your people know that. Sir,
Thomas W. Barlow (Planning Atty) Sir, before you go on, if you could just give us your name and address so Saunders can swear you in. Okay.
Speaker 5 Yes sir. Edward SoFi 5 65 Colgate Avenue, Perth Amboy, New Jersey oh 8 8 6 1.
Thomas W. Barlow (Planning Atty) Thank you
Speaker 5 Sir. Member local 4 5 6 electricians Union.
Speaker 3 Can you please raise your right hand? Do you swear that the testimony you're about to give will be the truth and nothing but the truth?
Speaker 5 I swear to God.
Speaker 3 Okay. Thank you.
Speaker 5 Y the floor is yours, sir. Thank you sir. I wanna let people know that these are outta state workers that must obtain a New Jersey electrical license within New Jersey. They have to have, each worker has to have proof of apprenticeship training and is required on the application. Now there's a New Jersey bill that was passed and signed by Governor Murphy in 2022. And it became active in January 18th, 2022. In the past, business owners holding a New Jersey electrical contractor's license was all that was dated to do work in New Jersey. Now as of 2022 Act of January 18th in New Jersey, all individuals performing electrical work in New Jersey must hold a journeyman state issued license to do work. Any licensing in Pennsylvania for these workers is not reciprocal in New Jersey, we are not reciprocal with New Jersey. Each worker has to have a New Jersey license. They have to apply for it with the Board of Examiners contractors in Newark.
Speaker 5 Now also, I also wanna point out to you that these people coming outta the job don't have New Jersey licenses. The contractor does have a license that's not good enough anymore. Also, Wayne DeAngelo, the assemblyman in New Jersey, had passed in 2021. He passed two laws. These laws were to, to change what was going on with POAs Up to now up to 2021, POAs were required and mandated on any building project that exceeded $5 million. This was mandatory in the state of Jer, New Jersey. Now because of two laws that were passed, and I have the the laws here, I can get you information on the laws. Now it's completely permissible for New Jersey school boards and municipalities and county authorities to draft contracts on any amount of money below $5 billion. If you have a contract for $5, you can put it is discretionary and not mandatory. But if you have a contract for $5, you could put a PLA on the, on the project.
Speaker 5 The purpose of this bill and POAs is to advance New Jersey State. Now New j New Jersey is paying prevailing wage rate. They went the best workers. They pay prevailing wage rate, which is the top rate that is afforded by all the trade unions in the area. The purpose of this bill is to advance New Jersey's state goals for efficiency, quality and work safety. It was also designed to create jobs for the people living in the community where the work was to be done and not in Pennsylvania. Now, prevailing wage laws in New Jersey requires that that contractors and subcontractors pay hourly wages based on the fringe benefits and the pay rate of the local unions. These, these contracts are determined to be the best skilled trade workers available. That's why they use prevailing wage. This applies to all public work projects valued at $2,000 or more. So if you have a, a project that's $2,000 minimum or more, you have to pay per billing wage, which is the union rate.
Speaker 5 And the union rate is the pay and the benefits. And 90% of my guys in the building trades are making $52 an hour cash. And with the benefit package and the end lease and the pension, they're going to make $105 per hour. Okay? Today we use, today we use POAs and prevailing ways to ensure that local people and taxpayers get the jobs and quality and safety by union skilled labor rather than union. Non-union people that are outta state like Pennsylvania, most large non-union contractors like Cion use workers that live outside the com, the communities and outta state, these non-union contractors in general use non-union laborers for the pay scale. So what we find out, 'cause we go to Trenton every year with these jobs and and complain, is that they use the laborers Union pay scale and they, these people are doing electrical work and not paying the electrical prevailing weight.
Speaker 5 Also, the money they appear to lose in this bill that they take the low bid is made up later by getting this money back and, and change orders. And also by paying the lower labor scale, when in fact the people are doing electrical union work and iron work. The solution is for the boarded to put a POA on all contracts so that a contractor will bid the work based on hiring local Piscataway people out of the building trades. Local unions, a non-union contractor, likeum from Pennsylvania can then submit his low bid and use union labor. We didn't care if Supreme gets the job, but we wanna put a project labor agreement. So we hire local people from Piscataway and then they can get their low bid and take the job with union labor. The problem we've had with the Piscataway Board of Education for the last five years that I know is that every job that the Piscataway board of Ed has given out has been to a non contractor because they choose a low bid.
Speaker 5 Now, I guess explained to you that now with the new law, $5 million or less, you can put a project labor agreement on the job. This would solve the problem and the board of education can then take the low bid and make everybody happy. You can go to a non-union contractor and give 'em the job, but we're gonna hire all people with a project labor agreement outta the unions and everybody will get the best work and the taxpayers will be happy. Now, the majority of school work, it comes in, Piscataway comes from state and local sources and not federal sources. So the prevailing wage rate is what's happening here. 62% of the funding from local comes from local taxpayers, not Pennsylvania 62. But the funding for this, 62% of the funding for this job comes from the local taxpayers, not Pennsylvania people. Fagon license, Fagon Electric, which is one block away from the school.
Speaker 5 It's a union contractor that hires all local people. Union has a, has a license number of 8 39 cion solutions. License number is 12,893. He has a license in New Jersey, but fagon, which is one block away from this job site, can't even put a bid in because he can't bid against a low contractor that's non-union that's hurting us with a low bid. And he's not using the right people as far as we're concerned. And how about the kids that graduate from, from Piscataway High School, what chance do they have to come with the building trades? We have 15 union building trades. Our men get between 150,000, $200,000 a year. They get $2 million in annuity when they retire. They get $10,000 a month on their pensions. We give 'em all the medical and we put 'em to school for five years. What chance does a kid outta Pisco?
Speaker 5 We have when you're bringing a contractor from out of town and what are you doing for the kids in town? Sir, you gotta labor agreement on the job. You gotta hire the local people with the unions to state of New Jersey, giving your a prevailing wage rate to get the best people. I guarantee you that the unions are the best people, not people that are coming from outta state that are working as laborers, don't electrical work and everything else. We, we have these suits every year with the, with the Trenton Department of Labor and we win and we back charge this contractor hundreds of thousands of dollars. But the people get a bad job. If you pay $10,000 for a sidewalk job and you have a choice of a 5,000 job, two years later, the concrete's gonna disappear and you're gonna have Stelton here and you're gonna have cracks. You gotta get the best labor, you gotta help the people in Piscataway. Is there any other questions?
Thomas W. Barlow (Planning Atty) Well, sir, I, I appreciate that it was very informative, but just understand that under the municipal land use law, the law is the state of New Jersey. When the, the Board of Ed's gonna do a capital project, they have to come before the planning board as a courtesy. The planning board, unlike a regular application, has no power to redesign the project or do anything like that. This is just a courtesy that they have to come before the board to explain what they're doing.
Speaker 5 You
Thomas W. Barlow (Planning Atty) Make you, you make a lot of good points. Just understand that they need to be directed to the Board of Education because the board of education is the one making these decisions in terms of who they hire, sir, who they use, things of that nature.
Speaker 5 Yes sir. Please lemme make one more point for the people at Piscataway. I wanna
Thomas W. Barlow (Planning Atty) Tell you, I'm just saying that the, the board of ed is the, the entity that can address your concerns, I guess is what I meant. I
Speaker 5 Made this argument in front of the board on two separate occasions over the past couple years. Okay. I want to tell you that the county free holders and Middlesex County College and New Brunswick and all projects use project labor agreements. 100%.
Thomas W. Barlow (Planning Atty) We understood, I'm aware of that
Speaker 5 In Middlesex County. Every job is a project labor agreement. And the entire county, except for the Board of Education and Piscataway. And I went before them and I said, do this for your kids and do it for the people in the town who pay the taxes. It's not fair for this community to have a board of education that doesn't allow the use of the laws. The law says you can put a project labor agreement on a contract that's $2,000 or more and hire local people and give them a chance and not get people from Pennsylvania or don't have the training, the safety training and the opportunities for people. Piscataway.
Thomas W. Barlow (Planning Atty) Sir, a again, appreciate your comments, but just understand that this board has absolutely no control over that and we have a very busy meeting tonight. Yeah, and we
Speaker 9 Have, I think Mr. Barlow, I think with the fact is obviously there's a lot of long history here where the board of Ed of course hasn't done anything like that. And I think rightfully so, the, you know, the local trade unions are very upset at that.
Thomas W. Barlow (Planning Atty) Understood. Completely understood completely. I
Speaker 9 Understand. And they have an extremely valid point and I just wish at some point, members of the board of Ed and no fed, fed to the folks that are presenting on behalf of the board of Ed here tonight. But as a local taxpayer, I'd rather see our dollars being spent employed by local people. No. 'cause it's our tax dollars
Speaker 5 Pretty. So
Speaker 9 You might wanna take that back to the folks who are gonna be paying your bill that they should seriously hire. I'll finish up folks
Speaker 5 In the area violating the laws by not having journeyman official journeyman status in the state of New Jersey. 'cause New Jersey is not reciprocal in Pennsylvania. And these people are coming in here and they're not licensed. Do electrical work, which was passed by New Jersey and 22 20 22 and signed by the governor of Jersey. They're illegal. They shouldn't be here. Thank you
Speaker 13 With all, with all due respect, sir, I have six, six men on the project. I don't intend to staff it any further. All six of those men currently live in New Jersey. Three of those men are journeymen electrician, the other three are apprentices.
Speaker 5 They have to have a license, they have to have a New Jersey license. I don't give to journeymen. They're journeymen in Pennsylvania. Not here. They have to have a license,
Speaker 13 Sir. They're, they're all from New Jersey. They have New Jersey licenses.
Speaker 5 Okay. Okay. Thank you. Okay.
Thomas W. Barlow (Planning Atty) All all good points. I just don't want the board to get sidetracked in a labor issue when we have a very busy meeting. I don't know if there's anyone else that has any questions.
Speaker 5 There's no one else from the
Thomas W. Barlow (Planning Atty) Public. Okay.
Brenda Smith (Chair) Thank you. Close to the public.
Speaker 14 Okay,
Brenda Smith (Chair) That's fine.
Speaker 5 That's it.
Brenda Smith (Chair) Yeah, we don't, there is no, there is no nothing to vote on then since that, correct. Okay. Our next item is item number 14 for which Mr. Barlow will leave and Mr. Kinneally will replace for item number 1426 PB 12 slash 13 V as in Victor am repeat cower, minor subdivision and bulk variances. Appearing for them is Mr. Kevin Morse. Kevin Morse
Speaker 15 Present.
Brenda Smith (Chair) Thank you. Step forward. Mr. Kinneally. Are you Yes,
Speaker 15 I I'm here Madam Chair.
Brenda Smith (Chair) I'm looking for a
Speaker 16 Mr. Morse. I'm here. Okay,
Brenda Smith (Chair) Thank you. Hello Mr. Morris. We're all here.
Speaker 16 Yes. Alright. So thank you Madam Chairwoman. Members of the board again, Kevin Morris on behalf of the applicant, Amate Creek Coer. The subject property is 1 55 Summers Avenue. As you may recall, we appeared before you last month at your October 14th meeting presented our case. You heard testimony from our professional engineer and planner, Paul Fletcher, who's available this evening if necessary. We proposed a two lot minor subdivision of the property for the construction of two new single family homes on each lot. Both lots are conforming in size. That proposed house fronting on Eva Street was also conforming. With regard to the setbacks, we did request for the second house, which is on the corner lot corner of Eva and Summers front yard variance because corner lots always have two front yards. And based upon some feedback we received from the board, we asked you to carry our case to this evening so the applicant could reconsider the location of that proposed house.
Speaker 16 I'm happy to report that he looked at his plans. We do continue to propose that same house. However, the applicant is moved that house back entirely within the building envelope, meaning both the house and the front porch are now compliant with all of the front yard, side yard, rear yard setbacks within the building envelopes. We have eliminated the one variance that was necessary and we're now absolutely a total conforming minor subdivision application. We did present a sketch of that house to Ms. Corcoran just to let her know she could see that, that where the house will be located and if the board, of course looks favor favorably on the application, the plans would be so amended and also to comply with any other conditions of approval that may be issued by the board. By way of housekeeping, the mayor had requested two items just to refresh everyone's recollection.
Speaker 16 One, that there be a deed restriction for the two lots with regard to the seepage pits that they must remain on the property. And the second is really a deed notice. Apparently there is a street that closes during some type of organization's parade annually. And the mayor thought it'd be a good idea to have a deed notice as well. And those, both of those items are not objectionable to this applicant. This application would be perfected if approved of the two lots by subdivision deed and both of those items could be included in the subdivision deed. So that being said, were now before you with a totally conforming application and we request your consideration and approval of the application at this time. And the record should reflect. We did go through all the items of the various professional letters. My review memo was the last time and addressed all that. So the one item was just the location of the house and we've, we've changed that to eliminate the variance.
Speaker 10 Madam Chair, if I may, this is Dawn Corcoran. I have reviewed the exhibit that was emailed to me this afternoon and the plan is acceptable. As Mr. Moore stated. They did, they moved the house back. The porch now complies with the setback requirement. The steps do not encroach more than five feet into the setback. So what has been shown to us again is acceptable. The only additional thing I would add is that these homes cannot exceed the maximum building coverage requirement of 20% on the plans as shown they don't. But I think we should put a condition on the approval if the board looks favorably, that they can't come back for bulk variance relief when they actually go do, you know, go forward to construct the homes.
Brenda Smith (Chair) Okay. Is that
Speaker 15 Acceptable, Mr. Morse?
Speaker 16 Yeah. Look, and the board should know we, we propose larger homes and we, and this is this, this generation of the plan, we reduced the size of these homes so that they were in compliance with your, your lot coverage. So we could now appear before you this evening is a totally compliant application. So I agree. So I don't think we have an objection to, to that because we're complying right now.
Speaker 10 Agree. And I just wanted to put that on the record. Okay. I just didn't want this to become another application before the zoning board for building coverage, so thank you.
Brenda Smith (Chair) All right. Do we need to present it to the public if the, if the board has no more questions, if the board is satisfied now, can we put it before the public? Do we need to Yes. Yes.
Speaker 15 Madam Chair. We need to open it to the public.
Brenda Smith (Chair) Okay. Members of the public, you've heard the comments in the testimony. It's no testimony. The comments by the members of the board and by Mr. Mr. Morse. Does anyone in the public have any comments about this application? If you do, please indicate by raising your hand or dialing star.
Speaker 0 Six.
Brenda Smith (Chair) Six.
Speaker 0 I'll get you one day. No one. Madam chair.
Brenda Smith (Chair) I want it to be nine. So bad.
Speaker 0 I know you're trying, you're close. Yes. No one from the public.
Brenda Smith (Chair) Okay. Close to the public members of the board. It's your opportunity to accept this application or reject it. What's your pleasure?
Speaker 5 Madam Chair? Madam Chair, Reverend Kenney, I, I would like to approve this application. He has met the requirements that we required of last time, the setbacks and so forth that this application go forth and be approved.
Brenda Smith (Chair) Do we have any a second that might list any of the conditions?
Speaker 0 Yeah, I can just second Mr. Adkins? Yes. Okay. All right. Mayor Wahler? Yes. Councilwoman Cahill? Yes. Ms. Corcoran? Yes. Ms. Saunders?
Speaker 3 Yes.
Speaker 0 Reverend Kenney? Yes. Mr. Adkins? Yes. Mr. Foster? Yes. Mr. Echevarria? Yes. And Madam Chair?
Brenda Smith (Chair) Yes. Thank you
Speaker 15 Mr. Morris. Your application has been approved, will be memorialized at the next meeting.
Speaker 0 Alright, thank you ladies and gentlemen. Okay.
Speaker 17 Have a pleasant
Speaker 0 Rest your evening. Goodnight.
Speaker 15 You too. And I'll turn the meeting back over to Mr.
Speaker 0 Barlow. Bye Mr. Kinneally. Have a good night everyone. Thank you Jim. Good night. Thank you. Have a good night.
Brenda Smith (Chair) Item number 1526 PB 10 slash 11 V as in Victor, 6 0 5 Fairview properties LLC for a minor subdivision and bulk variance being represented by Mr. Larry Sack.
Speaker 17 Yes, good evening everybody. My name is Thomas. Good
Brenda Smith (Chair) Evening.
Speaker 17 My name is Thomas Roseli from Rose and Roseli. I am sitting in for Larry Sachs tonight who could not make it due to other commitments but we are ready to go forward. This is the application for 6 0 5 Fairview Avenue Lot 1406 block, I'm sorry, lot Block 1406, lot 10.01 on pages eight and 14 of the tax map. It's an R 75 zone. We have a number of witnesses tonight. We also have Dwayne Ings here who is the managing member of 6 0 5 Fairview Properties, LLC. If the board is willing, I'll be ready to call my first witness. First witness will be our engineer and planner Babai dui,
Speaker 3 I, I don't see him. I'm sorry. Got the
Speaker 0 Light
Speaker 17 Blue shirt.
Speaker 3 Oh, I see him now. Okay. Can you please raise your right hand? Do you swear that the testimony I'm about to give truth and nothing but the truth?
Brenda Smith (Chair) We can't hear you Mr. Wo.
Speaker 11 I didn't know that I wasn't mute anyway but I was just waiting for the question to swear.
Speaker 3 Oh, do you swear that the testimony you're about to give be the truth and nothing but the truth?
Speaker 11 I do.
Speaker 3 Okay. Can you please state and spell your name for the record and your company's name?
Speaker 11 My name is Bae Aade. Spell B-A-B-A-T-U-N-D-E. And the last name is A-D-E-W-U-N-M-I. I'm the principal of Babs Engineering pc. We are located in Union New Jersey.
Thomas W. Barlow (Planning Atty) Okay,
Speaker 11 Thank you
Speaker 17 Mr. Dr. Boley, could you please give the board the benefit of your education experience and licenses?
Speaker 11 I'm a professional engineer in the state of New Jersey and New York, a registered architect in the state of New Jersey, a professional planner in the state of New Jersey and also a pro professional and survey in the state of New Jersey. I'm an MI of New Jersey of TE Technology, class of Edison with Masters in structures.
Speaker 17 And your New Jersey licenses are current and active?
Speaker 11 They're all current.
Speaker 17 Oh, okay.
Brenda Smith (Chair) How long have you been in practice, Mr. Otter? One day.
Speaker 11 Wow. That will be about 40 years now.
Brenda Smith (Chair) Okay. You're acceptable
Thomas W. Barlow (Planning Atty) Mr. Roselli, can I just ask, are you're offering him as a engineer and planner? Planner
Speaker 17 And a planner? Yes, both.
Thomas W. Barlow (Planning Atty) Okay. Yes. Thank you.
Speaker 17 Could you please give the bene, have you visited the site in question?
Speaker 11 I did. Could you
Speaker 17 Please give the board the benefit of what you observed and what is being proposed by our applicant?
Speaker 11 The applicant is proposing to subdivide the property into two with the existing structure remaining on the less property that will be a lot 10.02 and the newly created other lot would be 10.03. I took the liberty to visit the site because I was concerned about the drainage problem that we having because the proposed P may not be enough to, to take the required runoff. So we are, we are planning in the future to connect the roof drain to the, to the street.
Speaker 17 And could you give an overview of the project itself?
Speaker 11 The overview of the project? Can I share my screen?
Speaker 17 Yes
Speaker 11 We am. Now I can't see the green button to share. Okay. I've seen it.
Thomas W. Barlow (Planning Atty) Tom, is he only gonna use the plans that were submitted?
Speaker 17 I believe
Speaker 11 Yes.
Thomas W. Barlow (Planning Atty) Okay. Yes, if, if you're gonna use anything that you know, you highlighted you, you changed it anyway, just let us know and we'll mark it as an exhibit. Otherwise if you could just tell us, you know, when you're referencing something, the sheet and the date. Okay.
Speaker 11 Okay. This was the plan that we submitted that we didn't put the revision box and then I have to write a letter mentioned that the revision box, how the revision box will look like. And then based on that the planner wrote a comment in which he called number three. And then when we submitted a letter, we called it is report number four. So it's still the same comments but they have number three and number four. I will start by more or less like go through each of the plans to explain what we have on each plan sheet. The first plan, which, which is CC one pretty much encompasses the whole description of the location map, which is at the center. And on the left is the 200 foot radius map and to the bottom is the area map. And further to the bottom is the flood map by the national flood has that layer which we call the farm. To the far right is the most important thing, which pretty much we refers to as the project data. The site is located within an active coastal land use with NJ EMS sites refer to as any, which is site ID number of 7 5 7 5 4 1 and a PID of 1 2 1 7 dash 25 dash
Speaker 11 0 0 1 I believe one 3.1. For this particular project in trying to subdivide this property, there had some couple of things that needed to be taken care of, which is pretty much,
Speaker 11 Which is pretty much the variances, which is why we are really here to make sure that hopefully the, the town will grant the variance if you look at the property in question is located in the R dash 7.5 zone, which is a one family residential zone. We are not doing anything unique. We are proposing another one family on the newly created lot. The original lot which is lot 10.01 will be, I mean 10.02, which is formally 10.01. But we'll be using 10.02 which is the current lot number, which is the existing one. And then after subdivision, the lots will be subdivided into lot 10.02 and 10.03. I took the liberty of trying to put up the variances of the one that is required. Minimum lot area, not required, minimum lot width not required. And then minimum lot front lot for one of them is required. I mean the last one two was required minimum lot debt depth not required. Minimum frontier setback principle required for both properties. Front porch required front, front, front thing. The garage below the a TT stand for, again, not required accessory discharge garage minimum rear yard principal and transit area. Lot required assets, wood garage, there are a couple of them there. The assets wood garage, which was the original situation.
Thomas W. Barlow (Planning Atty) Sir, I, I don't wanna cut off your testimony but you, you only need to dis tell us the variances that you need. You don't need to go over all the ones where you're meeting it as part of your testimony.
Speaker 11 One second, let me get that
Speaker 17 On. Proposal 10.023 requirements is 75 foot
Speaker 11 Walk width. We pretty much have it here on the 10.02. We, it's required at 75 foot lot wheat. We proposing 50 foot lot wheat and we'll be requiring a variance for that. And then also required is the 25 foot frontier setback. And then we also required also the 10 for 10.02, the frontier setback, which is from the step that is existing condition. The last one I just mentioned. And also section 21 point dash 6 0 6. They were proposing pavers and driveway located within the right, right away that's existing. But our proposed stuff would not require us to have a variance for that because we are going to, we already moved the paver and stone driveway about a foot to the left of the property on 21 dash 6.6 13, which require is on 75 foot lot frontage. We proposing 50 foot long, long frontage. And then for the 21 dash 1 1 0 1 0.3, which is a paved driveway, we proposing a stone driveway.
Speaker 11 In reality for lot 10.02, we'll be requiring four variances because we have already moved the paved driveway out of the right of the line. For lot 10.03 we'll be requiring for the 10 foot lot width and also for the 50 foot, I mean the 50 foot lot width and 50 foot lot frontage. So there are going to be four variances for 10.02 and two 10.03. In addition to this, there was something that we did not identify on the, on the plan, which we later did. The requirements are by RSIS indicate that for the parking we should have two parking spaces for a four bedroom unit and then we wholly are proposing a one car garage for each of the lot. So that pretty much covers the lots, the variances requirement.
Speaker 17 Mr. Barlow, would you like him to review the professional's reports before he goes into his planning testimony?
Speaker 11 I did. I had reviewed all of them because the report of the planner, we, he would have already written a point to point respond to it, but we comply with all the proposed comments. The same thing in reference to the engineer comment, we're going to comply with all their comments. The only thing I would like to identify also in, in terms of what has been done, the permeability tests have been done. The, the drainage plan was revised and then, and then we have a documentation regarding the baseline for flood and et cetera. But we'll be complying with all their comments.
Thomas W. Barlow (Planning Atty) Okay. So Mr. Roseli, to put that in a nutshell, the applicant's agreeing to comply with the AON planning report, planning review number four dated October 9th, 2006, along with the staff report from the division of Engineering and Planning last revised November 4th. And I believe is there a, there a, a Delaware report, Ms. Corcoran? Yes, there is. There, there is. Okay. Yeah. And you're gonna comply with that also, correct? That's correct.
Speaker 10 Okay. And there's also a report from Public Works. It just basically says no issues with DPW, but make sure there are sanitary sewer cleanouts outside by the curb
Thomas W. Barlow (Planning Atty) We comply with. We will
Speaker 17 Comply with that.
Speaker 10 Okay, great. And just so I'm clear, I'm sure I, I'm sorry if I missed it, but for proposed law, 10.02 is, is your client's intent to pave the entire driveway? Is that what I heard?
Speaker 11 No, that's why we're requesting for a variance also.
Speaker 10 But the zoning. Okay, but the zoning board put a condition on the prior approval that at least the first 20 feet had to be paved.
Speaker 11 We will comply with that.
Speaker 10 So you're gonna have 20, I'm sorry, 20 feet page, then you're gonna have a stone driveway and then you also show now in front of the garage a paved driveway.
Speaker 11 That's correct.
Speaker 10 Why not just pave the whole thing?
Speaker 11 We could also,
Thomas W. Barlow (Planning Atty) I, I, I think that might be from a
Speaker 10 Staff I would recommend, I mean to have pavement, stone and then pavement, it just makes sense in my opinion, to pave the entire length of the driveway.
Thomas W. Barlow (Planning Atty) It would also do away with one of the bulk variances, you guess? Correct.
Speaker 9 Madam Chair, the applicant just needs to pave it all. You, you building a new house next door, you're gonna have pave machines there. Just, just take care of it while it's there.
Thomas W. Barlow (Planning Atty) Mr. Elli, will the applicant agree to that?
Speaker 17 I believe the applicant will be the, the applicant is here. We could ask him, but I believe he will agree to that. Mr. Ings.
Thomas W. Barlow (Planning Atty) Well, but before we, if you're gonna
Speaker 17 Swear him in for that question, we could swear him in.
Thomas W. Barlow (Planning Atty) Yeah. Yeah, let's swear him in it. Mr. Omi, if you could just unshare your screen makes Ms. Saunders's life a little easier so she can find the, okay, find the square. There you go.
Speaker 3 Yeah. Mr.
Thomas W. Barlow (Planning Atty) How
Speaker 18 You doing?
Speaker 3 Hi, can you please? I'm here. Raise your right hand. Do you swear that the testimony you're about to give will be truth and nothing but the truth?
Speaker 18 I do.
Speaker 3 Can you please state and spell your name for the record?
Speaker 18 Dwayne Ings. D-W-A-Y-N-E, ings, E-D-D-I-N-G-S.
Speaker 3 Okay,
Thomas W. Barlow (Planning Atty) Sir, can you just give me your professional address or your address?
Speaker 18 6 6 0 100 Lakeview Avenue rear Piscataway, New Jersey.
Thomas W. Barlow (Planning Atty) 100 Lakeview Avenue in Piscataway. And you're a principal member of 6 0 5 Fairview, LLC.
Speaker 17 Fairview Property. LLC.
Thomas W. Barlow (Planning Atty) I'm sorry. Fairview Properties LC, correct?
Speaker 18 That's correct.
Thomas W. Barlow (Planning Atty) Thank you. Your witness? Well, I guess Ms. Reddens, you heard the discussion, you'll agree to pave the entire driveway as requested?
Speaker 18 Yeah, actually the driveway's already paved, the whole driveway's paved as we're talking.
Thomas W. Barlow (Planning Atty) Okay.
Speaker 17 That resolves that issue and that resolves that variance.
Speaker 10 And when you revise the plans, please be sure to just show that on the
Speaker 17 Plans that will be shown on any revis, any revised plans if the application is approved.
Speaker 10 And have the pavers also been removed from the right of way?
Speaker 11 Yes.
Thomas W. Barlow (Planning Atty) Okay. You, we don't need that variance. Great. Look at that. We cut that in half. Okay.
Speaker 17 Babai, could you please review your planning testimony with the board?
Speaker 11 The applicant, Fairview Avenue LLC, seek an approval to subdivide and its same block, 1406 lot 10.02 into two lots, lot 10.02 and lot 10.03 precisely. The new created lot 10.03 has a one family building on, we have a one family building on it and then the existing 10.02 will have the existing one family building on it. The property is located in the R dash 7.5 residential zone district. The proposed use is permitted for boat lots. The new J, the property contained in New Jersey. Environmental manager system, N-J-E-M-S, site id. Site ID, N-J-E-M-S sites, points representing, sites regulated by D New Jersey, DEP under one or more regulatory permitting or enforcement program or sites that are otherwise of some interest to A-D-D-E-P program. There is one program interest PI number associated with the New Jersey EMS site outlined below with the site ID 7 5 4 1 0 1 and PIID 1 21 7 dash 25 0 3 0.1 coastal and land use, I already itegrated the above variance that will be requiring requiring so I won't be repeating them. The board must find that there is either an undue hardship or practical hardship with a strict application of zoning requirement as stipulated in the zoning and land use regulation as a result of exceptional narrowness shallowness or shape of a specific property. By di dividing subdividing this property, which will not make the frontage to be 50 feet without an approval from the board, it would be hard for us to build anything on it
Speaker 11 Under receipt. Go ahead. The board must find that the proposed aviation from the zoning and land use regulation will advance the purpose of the municipal land use law and that the variance can be granted without detriment to the public good. That the benefit of the derivation will substantially outway any detriment and that the variance will not substantially impact the intent and purpose of the zone plan and zoning ordinance. The property was purchased by the applicant in July 22, 25. The laws have been used as a one family residence prior to the proposed subdivision. The improvement created by the subdivision of this property. We provide a positive visual environment to the neighbor. The improvement of this property, we benefit the community as a whole, not only the applicant property owner. In addition, the asserted of housing in New Jersey. And by building a new residential house, we contribute or elevate the housing shortage in New Jersey, thereby the variance can be granted with without substantial detriment to the public good and without substantial impairment to the intent and purpose of the zone plan and zoning ordinance of the township.
Speaker 11 The special reason why the variance should be granted is that the proposed development fits into the character of the neighborhood. What the applicant is proposing is not unique to the neighborhood. Within the intersection of Lakeview Avenue and Fairview Avenue and Academic Street and Fairview Avenue Mo, most of the lot has a 50 foot frontage. So what we're proposing is just a 50 foot vic, which is consistent with what we have in that area. Therefore, the proposed ation fits into the character of the neighborhood. Without any impairment size suitability, the property is uniquely suited for a one family residence and closer to Lake Avenue, a major Al Road UE hardship economy, innu in utility, the property cannot reasonably be adapted to a conforming use because of the proposed locked frontage promotion of the zoning purpose. The project advances general welfare and or promote a specific purpose of the municipal land use. Though the CE of positive outweigh any apparent detriment to the public good, therefore the variance should be granted.
Speaker 11 Balancing test density consistency, the proposed lot from the salvation will not abate on this size lot. The site is not really on the size, but we have a frantic problem and will not include the density and it fits within the neighborhood contest parking solution. We are providing one parking space for each of the proposed subdivision architectural compatibility. The building is three, is compar to the building on, on Fairview Avenue, and it fits into the character of the neighbor transition, Bo Buffer showing that the lot is a, is a transition and not an intrusion into the zone by price. And ELLC two 14, NJ 2 63 20 13 decided super for the single family home Tow Brother Inc. Versus Township of West Window 1 73 NJ 5 0 2 2001. The proposed Salvation E address addresses the outage shortage of New Jersey by Medici vs. B Pico 1 0 7 NJ 1987. The proposed submission would not destroy the R dash 7.5 zone character by Mei versus BR Eco.
Speaker 11 We have made the policy criteria and by the municipal land, land use law 40 50 dash one. The proposed development meets the intent and purpose of this act to encourage municipal action to guide the pro, to guide the appropriate use of development of all land in the state in a manner which you promote the public health, safety, moral and general welfare. C, to provide adequate light here and open space D to ensure that the development of individual municipality does not conflict with the development and general welfare of neighboring municipality, the con, the country and the state as a whole to promote e to promote the establishment of appropriate population density and constitution that will contribute to the wellbeing of persons, neighborhood, community and regions and preservation of the environment to promote a desirable visual environment to creative development techniques and good civil design arrangement. That is I negative criteria. I have reviewed the master plan, the zoning ordinance, the zone plan, the proposed submission remain adequate without creating any UE impact. The proposed development does not provide any impact to the adjusting property or neighborhood. No detriment will resolve from the granting of these variances. The granting of these vari variances will not provide any substation detriment to the public good or impaired intent of the master plan or the ordinance.
Speaker 11 That con complete my planning testimony.
Speaker 17 Does anyone have any questions?
Thomas W. Barlow (Planning Atty) I, Mr. Rosa, I just by way of, I guess expanding or just clarifying sir, the, the existing lot in the 7,500 square foot zone is over 18,000, correct? So it's oversized? Yes, that's correct. And even with the subdivision, both lots will be over 7,500 square feet, correct?
Speaker 11 That's correct.
Thomas W. Barlow (Planning Atty) Okay. And just to clarify something about parking, both houses have garages, correct?
Speaker 11 Yeah, they are one car garage.
Thomas W. Barlow (Planning Atty) Okay. And both of 'em have driveways, right?
Speaker 11 That's correct.
Thomas W. Barlow (Planning Atty) So you can park more than one car, each house, one in the garage and one in the driveway. I about three
Speaker 11 Or four, yes
Thomas W. Barlow (Planning Atty) Sir. Okay. So you can easily meet the two parking spots if not more, correct?
Speaker 11 That's correct.
Thomas W. Barlow (Planning Atty) Okay, thank you.
Speaker 11 Are you thinking that we should emit one of the variances, which is the parking variances also
Thomas W. Barlow (Planning Atty) Because No, no, you don't need a parking variance. You have enough parking? I need a parking
Speaker 17 Variance.
Thomas W. Barlow (Planning Atty) Okay. I that, that's why when you said you only have one car garage, but you have a driveway, so Yes. Okay. I'm sorry Mr. Rose, I don't know if I cut you off. That was, I just wanted to clarify that.
Speaker 17 No, you didn't. I was gonna bring up the same points, but thank you very much Ms. Barlow. If you would like him to review the staff engineer, the staff planner's report, we could, yes. But I believe we are in agreement with everything that's on there.
Speaker 11 That's correct.
Thomas W. Barlow (Planning Atty) Okay. Mr. Corcoran, do you have any questions?
Speaker 10 I don't, Tom, they agreed to all of the reports. Thank, so,
Thomas W. Barlow (Planning Atty) Perfect. Okay.
Speaker 17 I do not, we were originally gonna call Mr. Hughes, Kermit Hughes, the architect, to go over the houses, but I did not see if he is here. Is Mr. Hughes or someone from his company here?
Speaker 19 Yes.
Speaker 17 There we go. I would like to have Mr. Hughes sworn in.
Speaker 3 Mr. Hughes, can you please raise your right hand? Do you swear that the testimony you're about to give will be the truth and nothing but the truth?
Speaker 19 I do.
Speaker 17 Mr. Hughes,
Speaker 3 And please state,
Speaker 17 I'm sorry, go ahead. Excuse me.
Speaker 3 Can you please state and spell your name, the of the record and your company and their address?
Speaker 19 Kermit Hughes. Kermit Hughes Architect. Kermit is K-E-R-M-I-T. Hughes is H-U-G-H-E-S.
Speaker 3 And the company and
Speaker 19 Address? Kermit Hughes Architect.
Speaker 3 The address?
Speaker 19 180 5 Myrtle Street, Franklin Township, New Jersey.
Speaker 3 Thank you.
Speaker 17 Mr. Hughes, could you please give the board the benefit of your education and licenses in the state of New Jersey?
Speaker 19 I have a master's degree in architecture from University of Florida. I am a registered architect in Florida and I'm a registered architect in New Jersey.
Speaker 17 And how long have you been an architect now?
Speaker 19 Since oh five 2005.
Speaker 17 I would ask that Mr. Hughes be accepted as an expert architect.
Brenda Smith (Chair) Has he testified in any court situations or boards before?
Speaker 19 Yes. Yes.
Brenda Smith (Chair) About how many?
Speaker 19 I've been for zoning board and maybe eight or nine times.
Brenda Smith (Chair) Okay, thank you. You he's, he's qualified.
Speaker 17 Mr. Hughes, could you just review the architectural of the new building that is going to be built on lock? 10.03, I believe.
Speaker 19 Okay. Let's see. Hopefully we can see screen.
Thomas W. Barlow (Planning Atty) Mr. Hughes, is this a colorized rendering of the, your architectural plans?
Speaker 19 No sir, it is not. It's, I have a floor plan and elevations, but generally black and white.
Thomas W. Barlow (Planning Atty) Oh. 'cause on my screen it's coming up like yellow and has red marks, that's all.
Speaker 19 Oh, okay. Yeah, they, they are but they're not significant. Those, I mean, they're, they're there, they're helpful, but, oh,
Thomas W. Barlow (Planning Atty) Okay. We'll, we'll just mark it just for sake of completeness as a one and if you could just identify what it is.
Speaker 19 Okay. Okay. You, we are looking now at both the floor plan, first floor plan and second floor planned. And I'll show the elevations in the second. We'll walk through the first floor and then up the stairs here we have a, first we have a, a garage, one car garage. And that garage is 12 four inside and 21, 3 and a half. Clear back to the steps. If, if access is by walking, then it's up the stairs and the height of that will, will be determined a little bit later. But it will be two at minimum, three or four steps to a porch and through the front door into a living room. That living room space has access to a, a small room that could be an office space or small den bedroom just to the right of the living room. And then this area, it's not marked, but it's, this would be dining room. Dining room space. Right here we're looking at a, a raised bar. And to the left along this line are kitchen appliances and refrigerator behind with the one bathroom on the first floor at the back.
Speaker 19 Access to the second floor is through the stairs up to here, which is the second floor arriving at this point with the bathroom to the right, this one for the, for the guest's bedroom's, bedroom here with the walk-in closet down the hallway, bedroom, walk-in closet to the left. If you're walking down the hallway, primary bedroom with a primary bath, we will go. Now that one is labeled as a 1 0 1. We'll go now to the elevation sheet, which has the four elevations on it. This being the street elevation, front elevation, the garage door, garages in this space, this is the porch and this is the primary front elevation side. Elevations left side garage. This is the bulk of, main part of the house. Living area of the house and then rear of the house and right side of the house.
Speaker 17 What type of material will be used for the finishing of the exterior of the house?
Speaker 19 That is most likely going to be it, it's going to be a siding. It'll most likely be a vinyl siding, but that is typically a owner's choice decision that he hasn't made just yet.
Speaker 17 Are there any questions for Mr. Hughes?
Speaker 0 Madam chair? It's Councilmember Uhrin Cahill. What are, what are the, the roughly the square footage of these homes? I, I think it was mentioned earlier, but I, my audio was in and out.
Speaker 19 Okay, lemme, lemme swing back to condition space second floor nine 90. First floor nine 90, total 1980 condition space. And then there's a garage at three 19 and then our front porch.
Speaker 0 Thank you.
Speaker 17 Any other questions for Mr. Hughes? Hearing none, we have no more witnesses.
Brenda Smith (Chair) Okay. Members of the board, do you have any questions of this witness? If not, we can open it up to the board. I believe we didn't open it to the, I'm not the board. We can open it up to the public for both witnesses. I don't believe we asked the previous witness in, opened it up to the public for the previous witness. E either. Okay.
Speaker 0 Do you have any comments or questions? You can raise your hand or hit star six to unmute if you're on the phone for the public.
Brenda Smith (Chair) Any response?
Speaker 0 No. And Madam chair,
Brenda Smith (Chair) Close to the public. Is there any closing that you want or should we pose to question to the board?
Speaker 17 Just to summarize, we, it's basically a minor subdivision. We have agreed to all the conditions that were requested by both the plan, the planner, and the engineer. As a result of the same, we are asking that the board approve the application as presented.
Brenda Smith (Chair) Thank you. Members of the board, you've heard the petition of the of council for this application. What is your pleasure?
Speaker 10 Madam Chair? Dawn Corcoran. I'd like to make a motion that we approve the application subject to the board professionals reports subject to the applicant. Well the applicant already paved the driveway, so just subject to the board
Brenda Smith (Chair) Professional.
Speaker 10 Sorry about that.
Brenda Smith (Chair) Do I have a second? Reverend Kenney? I'll second that. Okay, roll call.
