AI
00:01:42 – 00:02:09
Three cases postponed: nor could car (postponed to October 8, 2020 with notice required); Dane Reeves (postponed to September 24 with newspaper notice); Kevin Herrick (postponed to September 24 with no notice required).
Speaker 2Yes, we have quite a few adjournments. The application of nor could car is postponed until October 8th, 2020. They must serve. Notice The application of Dane Reeves is postponed until September 24th. They must notice the newspaper only. And Kevin Herrick is postpone till September 24th with no further notice required by the applicant. Those are all those changes that I have.
Speaker 1Okay. Very good. I believe we start with item number six. That's correct?
Item 6: Ms. Soriano - Metal Carport Variance
AI
00:02:28 – 00:10:10
Ms. Soriano at 989 Sunset Road sought variance for metal carport structure to protect vehicles. Board engineer Henry Hinterstein recommended moving carport back 3 feet to achieve 53-foot setback from property line. Applicant agreed to add 6-inch concrete pad. Revised plan to be submitted. Approved unanimously with amended setback requirement.
Speaker 2Yes, we can hear you. Are you present? Okay. You can hear us. Yes. Okay. I need to swear you in, could you raise your right hand? Do you swear that the testimony you're about to give should be the truth, so help you God,
Speaker 1Your name 9, 8, 9 sunset road. Piscataway.
Speaker 2Could you explain to the board what you would like to do?
Speaker 3I would like to have a variance to, to be able to have a metal carport built near my house to protect our cars.
Speaker 2Okay. Have you seen Mr. Hinterstein report of September 9th, 2020 Henry the may not have received the reports. Could you go over your report? Witness Oriana?
Speaker 4Yeah, I basically, you know, at this point, the majority of the veterans that are being sought for the application are preexisting in nature. The really only variances that, that are, are the ones for the proposed setback of an accessory structure within this case is our port. They show on the planes, going to the setback. I believe if I'm not mistaken. But when I took a look at the drawing, other side of the garage was actually closer and it is 50 feet away from the front yard right away. So my report, what I recommended that they do is they moved the cardboard back just slightly so that it wasn't aligned with the edge of their driveway. And that would give them a setback of 53 degrees to that, which is close to where they originally were, I think at the exception of to make it closer. And, and I think that would be an accepted setback.
Speaker 2Ms. Soriano, do you understand what Mr Hinterstein has recommended?
Speaker 3My, my understanding is it's from the step back from the, from the front, what do you call that
Speaker 4Property line?
Speaker 3Yes, sir. It will be 53 feet from there. Is that what this is?
Speaker 4Yes. That is closest point, which is the right side. You look at your drawing, you have a dimension on the left side. That that is actually not 54 feet. It's actually probably closer to 50 feet if you move it back just slightly. So that it's even with the edge of your pavement on your driveway. Yeah. That'll make the closest point, which is the right side of the far forth, because the property line sort of as a curve, it'll make it 53 from your 53 feet from the right of way line to the property line, which I think would be an acceptable distance. It'll be even with the edge of your driveway. And, and I don't really think it's gonna change your application that much, other than the fact that we're just going to slide it back about three feet from where you show it now
Speaker 2Is Serrano, is that acceptable?
Speaker 3Yes.
Speaker 4And what surfer is the year you plan on at least putting stone down underneath the, the car court
Speaker 3Planning to have a concrete pad?
Speaker 4Yeah, because it's a page surface that's preferable so that you don't attract mud out, but you do have a pretty large aid driveway. So, so it will be a concrete pad down. Yes. Okay.
Speaker 3Do I need a guidance from public works on how I should get to build this concrete pad? If there is any township, guidance or rules that I need to follow
Speaker 4Third driveway, there really is not. I would recommend that at a minimum for vehicle, you should use a six inch thick concrete if you're going to be parking vehicles on it. So that would be my only guidance. I would recommend at least 4,000 pounds, 4,000 PSI free, and at least six inches thick for, for a driveway slashed parking pad of this nature, or it could be blacktop. And for blacktop, you know, the recommendation will be at least the minimum two inches of blacktop on six inches. So I'll leave that up to you as acquirement under the building code, you know, that's that's for your own. I would recommend that for your protection getting into, or you would just need a building permit for the car port itself.
Speaker 3Okay, cool. Appreciate the guidance. Thank you,
Speaker 4Brianna, do you have anything else that you want to discuss with the board?
Speaker 3Would I be given a, it a, an actual update on the drawing that I sent out or it's just going to be a verbal, I have, we will have an official notice of the updated plan for the cardboard. I mean,
Speaker 4Henry, if the board agrees to your recommendation, would she need to supply a revised plan? She will. She'll have to just show a revision showing that that the setback would be that square representing the car port. Is he even with the driveway. And that, that imagined on the right hand side of that cardboard is 53 feet. And that's what the resolution will probably represent our imagined.
Speaker 3Okay. Say the edge of the carpet will be 50 free from the front,
Speaker 4Right? The right front edge. Correct. Pretty much even with your driveway.
Speaker 3Okay. Thank you.
Speaker 4Questioned your comments from the board members regarding draft location, the public, anyone in the public
Speaker 1Forest and have any questions or comments regarding the patient
Speaker 2Ms. Buckley, do you see anybody that wishes to be heard? No, sir.
Speaker 1You have any emotions on the floor? Well, mayor can insert the public, no comments or questions from the public will have the full report. Can colors. Yeah. I'll make
Speaker 2A motion.
Speaker 1Then I'll make a motion. Steve wise, Monica motion to accept the, the request with the provision. The 63 foot change changed the negative eight <inaudible> <inaudible> see wisely. I don't remember. I noticed you were in bay by miss your wife's been said anybody missing Zimmerman, peripheries, coral, Mr. Kao. Yes. Mr. Weissman. Yes. Mr. Zimmerman, Mr. Patel. Yes. Yes.
Speaker 2Yeah. I mean, Soriano, your application has been approved as amended. We'll memorialize it in a written document at our meeting in two weeks. You don't need to be present for that. We'll mail that document to you, but in the meantime, you should get your revised drawing to the zoning board.
Speaker 1Thank you. I appreciate that approval. Good luck. Good luck to you. Thanks next. I mean, pardon me? Goodnight. Tonight. Next January have find a number seven. <inaudible>
Item 7: Fence Over Stream Easement and Playhouse Removal
AI
00:10:50 – 00:15:21
Applicant at 61 Colton Port requested replacement of existing fence over stream easement. Engineer Hinterstein noted playhouse structure shown on survey must be removed or relocated outside stream encroachment area before permit issuance. Applicant agreed to remove playhouse. Approved unanimously with condition to resolve structures within 2 weeks.
Speaker 5Yes. I couldn't even name, this is a green world.
Speaker 2Are you both going to be testifying tonight or just one of
Speaker 5You?
Speaker 2Okay. Could you raise your right hand? Do you swear the testimony you're about to give should be the truth so help you God?
Speaker 5Yes. I swear that that testimony to be the truth and I got,
Speaker 2Yep. Thank you. Your name and address please.
Speaker 5My name is <inaudible> and my address is 61 Colton port, Piscataway, New Jersey.
Speaker 2Thank you. Put your hand down and explain to the board what you'd like to do here.
Speaker 5Okay. So the current property has a fence. The fence has been there for almost three years, which was built by the previous owner around the 1990. So now it is a broken, so we want to replace it at the same location. Yeah. Yeah. And that's what you want to get.
Speaker 2And you understand that this is over an easement.
Speaker 5A yes, yes. Our initial, you know, application permission
Speaker 2Was denied and I, I, yeah, I wasn't made aware that, that. Okay. Do you also understand if the township ever needs access to that easement, the removal and replacement of that fence will be your responsibility?
Speaker 5Yes. So we, when we made the application for this appearance, we put, we put that we understand we, we long, we, we don't want to affect any politic surveys or any public interests. So we wrote down that. Yup.
Speaker 2Henry, I'm not sure this applicant has received your report either. Perhaps you want to go over at least paragraph one.
Speaker 4Yeah. Are you aware that the, you have that little on your survey and shows up a plank, a structure or a little Playhouse? Is that still there?
Speaker 5Yes. The Playhouse was what's there. And also by a previous owner, I mean even needed that we can totally tear it down.
Speaker 4Yeah. I mean, it's up to you. You can either remove it or you can take it outside of the streaming, frozen area, as long as it's not in the streaming Grossman area, which is that line that shown on your survey that goes from your, your shed basically sort of like on a 45 degree angle or down to the other side, as long as it's not within the streaming approachment area, you can really, the only people that the only, the only jurisdiction on this treatment area would be the New Jersey department of environmental protection, the N G E P. So it's just a lot easier if you move it outside that, or just take it down. So whichever you prefer, as long as it's, before they'll issue the permit down, you'll have to either have it removed or relocated outside that stream approach.
Speaker 5We will. You mean the, the small, like the Playhouse? Yeah. Correct. Feed from the shed. Yeah. We
Speaker 4Were heading in the morning back line.
Speaker 5I'm sorry.
Speaker 4It's a warning. The back property line and shows. Yeah. Yeah. That, that's where it has to be removed the relocated.
Speaker 5Okay. Yeah. So we, we gonna remove that print out. Yeah. We really tend to do that.
Speaker 4Okay. Yeah. You could do that. You know, you can start doing that tomorrow. If you want it to this way. When this gets Mo this resolution gets memorialized. If it gets approved, it'll be, you'll be ready to go. You can put it for your permits and it won't slow you down. So you have probably two weeks before you'll get the resolution before you could get the permit for the fence. So in the meantime, if you want to have that play out, you'll be all ready to go once, once permitted.
Speaker 5Okay. Thank you. Yeah, we, we, we can start working on it through to get people help. If you do that in a <inaudible>
Speaker 1To
Speaker 2Mr. Chairman, I don't believe there are any other issues, unless the board has questions
Speaker 1And you want to open her up. Now, if we're up here, public, anywhere in the public portion, have any questions or comments when you send application,
Speaker 2Ms. Buckley, do you see anybody that wishes to be heard? No, I
Speaker 1Do not hear any motions on the floor or I make a motion to approve the application on a second post page over here. This is called Facebook. Second round two is made by Mr. White, but yeah. So please call the role Mr. Kao. Yes. Mr. Weisman, Mr. Zimmerman. Yes. Mr.. Yes. Chairman. Yes.
Speaker 2Your application has been approved subject to some conditions that we just discussed. We will memorialize it in a written document two weeks from tonight. You don't need to be present for that. You will need that document to get your permits. We will mail that document to you. Goodbye.
Item 9: James Genteel - Fence Variance
AI
00:16:30 – 00:18:25
James Genteel at 14 Runyon Avenue requested variance for fence around yard across sanitary sewer line. Applicant acknowledged township's right to access sewer and responsibility for removal and replacement if needed. Application approved unanimously.
Speaker 1Thank you. Thank you. Thank you. Next on the agenda we have going on James genteel, 14 Runyon avenue,
Speaker 2Don and James genteel present. Are you both going to testify this evening?
Speaker 1No, it's fine.
Speaker 2Would you raise your right hand? You swear the testimony you're about to give shall be the truth. So help you God. Yes. Your name and address please.
Speaker 1James genteel 14, Ronnie avenue, Scotto, integers.
Speaker 2Thank you. Could you explain to the board what you'd like to do here?
Speaker 1We'd like to get a variance, but a fence around our yard.
Speaker 2And you understand that a part of that fence is across a sanitary stories, man. Yes.
Speaker 1If it needs to be taken down at any time, it's not an issue. We'll get it ticket.
Speaker 2No. And it would be your responsibility to take it down and replace it. Yes. Mr. Chairman, I don't have any other questions.
Speaker 1Any questions from the board members this morning? The public, anyone in the public portion? Have any questions or comments regarding your application?
Speaker 2Ms. Buckley? Did you see anybody who wishes to be heard? No, I do
Speaker 0Not.
Speaker 1Probably fortunate as close to the chairman, John Cahill. I'd like to make a lotion of food. The application, Steve Weisman, I'll say in that emotion, making the food by Mr. Neil. Second by Mr. Weitzman, the clerk, please call the role
Speaker 0Mr. Cahill. Yes. Mr. Weissman. Yes. Mr. Zimmerman, Mr. Patel. Yes. And
Speaker 1Chairman Blake.
Speaker 2Your application has been approved. We will memorialize it in a written document two weeks from tonight or next meeting. You don't need to be present for that. We will mail that document to you and you need that document to get your permit.
Speaker 1Thank you very much. Good luck.
Speaker 1Pardon me if I'm wrong, but next is your boy self story. Number 11. Yes. Okay.
Speaker 2Is Ms. Gallardo present? Ms. Gallardo was present earlier. Is she muted?
Speaker 0Yes. I asked her to get there. She is.
Speaker 2Ms. Go ARDA.
Speaker 1Mr. Ferrara.
Speaker 2It's not, it's not Mr. Ferrara's application yet. It's Mrs. Gallardo. She appears to be un-muted
Speaker 6Having difficulties.
Speaker 2Is anybody present on AAA budget? Self storage attorney is Aiyana Gallardo.
Speaker 1Yes, sir. This is Matt Novello. I'm going to be happy. I'm one of the applicants I'm trying to contact the skalara at the moment to let her know that
Speaker 0Her hands raised. So she is here.
Speaker 1Get the 12 and bubble back.
Speaker 2The chairman would like to move on. We can do that there. No problem with that.
Speaker 1Yeah. I remember the problem with my answers of expediting the process. Why don't we get the 12 and then double back to Ms. Fuller. Yes. Yes it is.
Item 12: T-Mobile Northeast LLC - Rooftop Antenna Interpretation
AI
00:21:03 – 00:26:26
T-Mobile Northeast LLC sought interpretation/exemption from site plan review for antenna facility upgrade at 1551 South Washington Avenue. Proposes adding 3 antennas (to reach original 12-antenna approval), replacing 2 equipment cabinets, and adding fiber box. No increase in height or footprint. Attorney Frank Ferrara cited 47 USC §1455 and FCC Order 14-153 establishing exemption for non-substantial changes to existing telecom facilities. Structural analysis and RF report submitted showing compliance. Board found all criteria met. Approved unanimously as interpretation/exemption.
Speaker 7Yes, it was the chairman. Hello everyone. Frank Ferraro attorney on behalf of the applicant, T-Mobile Northeast LLC also on the line is Robert Morris SAC or professional architect to review the plan and answer any questions. The board may have. This is an application for an interpretation. T-Mobile is looking to upgrade their existing rooftop. Why was SLT at 1551 south Washington avenue before it is probably earned a couple of these already at this location we were at, I was actually before the forward 16, asked them for a similar interpretation to upgrade. The facility was originally approved by the zoning board back in 2002, 2003. T-Mobile right now has nine antennas on the building rooftop, six of those antennas that located behind spraining. The other three antennas are flashed map it to the building penthouse. When this application was originally approved back in 2003, the board approved it for up to 12 antennas.
Speaker 7Currently T-Mobile only has nine antennas and this upgrade their install, the additional three different back to the original approval of 12 antennas. So it'd be basically be one additional antenna per sector. In addition, there are three equipment cabinets. There T-Mobile would be sloppy out. Two of them went to a new cab and it's on the rooftop and a proposed fiber, a small fiber box or fiber service connection. That would be on an existing platform on the roof. None of the antennas that are being proposed are going to be any taller than what's there that have to be taller than the screening, which is currently on the rooftop, but not, but he told her then the 10, they just kind of house they're going to be installed in essentially the same fashion as what's currently there. So we did file for this interpretation under 47, USC, a 1455 and FCC ordered 14 dash 1 53.
Speaker 7It says, once you have established an insistent telecommunication facility at a site qualifies as an editable eligible facility request, that it can be exempt from formal zoning provided not a substantial change being proposed. And we believe as outlined in my legal memo and submitted to the board, we do believe that we meet all the criteria in there for the interpretation. There'll be no increase in the height of the facility, no increase in the width. We're not proposing more than four equipment cabinets at the site. We're not doing anything. That's going to defeat the can see them in elements of the site. The antennas are being installed right next to the existing ones, and then the same fashion as the existing ones. And you know, there's not going to be an expansion of the equipment facility. The new equipment cabinets are replacing the existing ones. They're going right on the same equipment platform on the group top. There's no conditions in the prior of approvals, but this would, which is really exceed. Essentially. We're bringing the facility more in line with what was originally approved a number of years ago in order to provide better service to the public. Mr. Morris sack is our architect. He's here and talk to the plans that the board was like or answering.
Speaker 2If you don't mind, could I jump in here? I've heard a number of these applications for interpretation, for exemption, from site plan, and they're, they're quite familiar with them. I have reviewed the applicant's package. It does not appear that there are any variances necessary, but it does not appear that they violate any of the strictures of the statutes that grant the exemption from site plan. Mr. Ferraro has also submitted a structural analysis that shows that the building and this, the intend amounts can handle the weight of the antennas. And they have also submitted an RF report saying that the new incentives comply with all regulations, unless the board has questions of the architect. Then I don't believe his testimony is necessary since it appears on paper that the applicant has satisfied the requirements for an exemption from cyclic,
Speaker 8Mr. Chairman, this is Sean kale. I agree with <inaudible>. We've heard enough of these over the last couple of years, where as long as there's no drastic Candace, I believe we will follow.
Speaker 2If that's the consensus of the board, I would recommend that you open it to the public in case anybody has an opinion. And at that point, if there's no public, then you can entertain a motion.
Speaker 1Okay. Thank you for your, from the board. Have any questions or comments regarding this application? They open up to the public everywhere in the public for she didn't have any questions or comments at this time. I'm hearing none. The public portion is closed.
Speaker 8Mr. Chairman, that she's joined KL. I'd like to make a motion to approve the application
Speaker 1Psychotic. And Mr. <inaudible> Mr. Kao. Yes. Mr. Weitzman? Yes. Zimmermann. Yes. Mr. Patel. Yes. Chairman. Yes.
Speaker 2Mr. Ferrara, we will memorialize this in two weeks.
Speaker 1Thank you very much, everybody have a good night tonight. <inaudible>
Item 11: AAA Budget Self Storage - 90-Day Extension
AI
00:27:19 – 00:30:58
AAA Budget Self Storage (Block 8801, Lot 5701) requested 90-day extension of subdivision approval originally granted November 14, 2019 (180-day period expired). Extension needed to finalize reciprocal access and utility easement agreements with property owner. Delays attributed to COVID and complex multi-party negotiations. Board found applicant diligently pursuing approvals. Approved unanimously with 90-day extension granted.
Speaker 9Hi, I'm on. Can you hear me now? I'm sorry. I had to switch computers for whatever reason it would let me unmute.
Speaker 1Okay.
Speaker 9I'm sorry about that. Hi. I, I would worry about for the board in October, I represent a triple a budget, self storage. We are doing a subdivision on the property based on a ground lease that is going to eventually be terminated. My client received approval for this subdivision, which memorialized on November 14th, 2019 for block 8, 8 0 1 lot 57 0 1 in the approval. There was a requirement for a reciprocal parking easement, which we came back before the board in February four to remove that requirement. And since then, my client, who is the tenant list left the of on the ground lease. And the property owner have been negotiating the reciprocal access and utility easements. Those have since been finalized and the subdivision deed has, but as you're aware, the 180 day approval period has expired. So we're back before the board for a 90 day extension to just finalize all those documents, to present them to the board so that we can sign off on them.
Speaker 1And you think that the 90 days would be sufficient? Yes.
Speaker 2Okay. Basically the board, if the board believes that the applicant has been diligently pursuing all of the approvals that they need, then they should grant the application for that
Speaker 1Expansion original application time, you have a return extension, but what was the original price comes out a 180 days. They want 80 and you want another 90 with me? Yeah, no, I think it's a, their concerns are legitimate. They had some things they had to work out because of the county Google. Some of these are separable easements. So I don't see an issue with an additional 90 days to protect the Sabina. Okay. Okay. Anyone else on my board have any questions, your comments and your sample here. Let's see why nothing
Speaker 10In general, given the situation with the COVID I think you should be quite lenient here. Been very hard to get things done and all different levels.
Speaker 8I agree with just the absolutely. I would open it up to the public outfits
Speaker 1Anywhere in the public portion of your questions. Your comments will be burning application, hearing none, the public. Unfortunately,
Speaker 8Mr. Chairman, I might defer to see Weissman to obsessive ethics. He's very happy and passionate about his cause. So go ahead. See,
Speaker 10Thank you, son. I'll make a motion to accept this extension of 90 days.
Speaker 1She made by Mr. Weitzman to improve the application for the extension. And second years, Mr. Cato, please call Mr. Cahill. Mr. Weissman, Mr. Zimmerman, Mr. Patel, Chairman white. Yes.
Speaker 2Ms. Guevara. We will memorialize this a resolution of extension of time in two weeks and send it to you.
Speaker 1Thank you for your time. And everyone stay healthy. Thank you. Good luck. We have
