Pledge of Allegiance and Agenda Changes
AI
00:01:02 – 00:01:53
Board stands for Pledge of Allegiance. Clerk announces two applications postponed to May 27, 2021: G Vendor Patel (23 Joanna Court) and Makeup Patel (14 Linden Avenue).
Speaker 0Here. We'll never win. Please stand for the salute to the flag. The United States of America stands one nation under God, indivisible with Liberty and justice for all chameleon. Are there any changes to tonight's agenda? Yes.
Speaker 2The application of G vendor Patel 23, Joanna court has been postponed until May 27th, 2021. The applicant must notice, uh, the application of makeup Patel 14 Linden avenue is postponed until May 27th, 2021. There's no further notice except for one individual that was supposed to be noticed. That was not, those were all the changes that have.
Case 20-ZB-49V — Wilhammad (Fence Variance)
20-ZB-49V
AI
00:01:53 – 00:06:26
Application for fence with black metal fencing between concrete/stone pillars. Engineer recommended removal of seven pillars; applicant requested board reconsider after site visit, arguing the fence is an improvement over previous overgrowth. Board voted unanimously to approve with condition that all seven pillars be removed as recommended by engineer.
Speaker 0Okay. Let's start with number five 20 dash ZB dash 49 V while Hammad.
Speaker 3Uh, thank you. Uh, members of the board, um, professionals. Uh, my name is Tim arch. I'm an attorney licensed in the state of New Jersey. Uh, as you will recall, uh, last time that we were here, we, uh, provided testimony. We went through, um, Mr. <inaudible> report. Um, we did agree to, uh, there were three major conditions in that one was removal of the, uh, of pickets from the fence, which we, uh, agreed to that condition. Uh, there was another, uh, that was a, uh, um, granting of in the report. It indicated a deed of dedication. Although we discussed that to modify that to an easement for municipal purposes, um, to track along, um, the front of the property where a sewer easement already existed. Uh, and then the third condition is what we're back here for, which was there was a, uh, we had discussed removing, uh, seven pillars.
Speaker 3This is a, uh, application again, a, a fence, uh, where the, uh, we are proposing, uh, basically a metal black metal fencing in between, uh, concrete or stone pillars. Um, and, uh, Mr. <inaudible>, uh, uh, recommendation was to remove seven pillars, which we identified at the previous hearing. Um, and, uh, on the behalf of my client, we, we asked that we, um, uh, carry it to give the board an opportunity to, um, if they chose to drive by the site to see the, uh, um, uh, the site as it is now, uh, and to possibly reconsider that condition, um, because we really believe that that hopefully we made a compelling case that it's, it's really not an issue in terms of, uh, in terms of site, uh, any issues with site coverage. And actually, if you look at the site, as it, as it previously was, it's really a big improvement to the overgrowth of foliage, which was there before to really does, uh, open up the sight line much, much better than what was there previously.
Speaker 3And you were generous enough to, to, um, postpone to the decision on this, uh, to, to potentially reconsider that condition. Although I will note that that as, uh, as Mr Ahmed indicated last time, we will abide by whatever conditions, uh, the board, uh, uh, ultimately decides. Um, and we thank you for the, uh, for the additional time and attention, uh, in postponing this and, and, and hopefully looking at the site and, uh, and reconsidering that condition. Um, but I believe, uh, we have no further testimony, I believe we're, um, we're at a point of, uh, of voting, uh, tonight.
Speaker 0Thank you, Mr. Archer, does anyone have any other questions? They want to go out to the site? I went out, I did. Okay. And I'm, I'm leaning towards Henry's recommendation. It, uh, it looks like a bit of a fortress out there with all those, those, the size of those columns. Number one. And I appreciate the, um, the applicant's concern about safety, but I live on river road and it's twice as trafficked in terms of, uh, trucks and cars as that particular location. And, uh, there was no one with anything near the, um, the front fencing that is currently there at the applicant's, um, home or residence. So, uh, if no one has any other comments, I'm going to make a motion to approve the application, but with the changes and the modifications that Henry outlined at this last meeting, Mr. Chairman, I'll move to the second time. Thank you, sir. Laura, please call the roll, but wait a minute. No, that's okay. Jim, is there any, any specific language that we need or I'll incorporate the language from Henry's report and, uh, the last meeting, uh, with regards to the removal of those seven pillars. Outstanding. Thank you. Okay, Laura, your turn, Mr. Zimmerman. Yes. Mr. Weissman,
Speaker 1Mr. Reggio Patel. Yes. Rondo yes. And chairman Cahill. Yes.
Speaker 2Mr. Archer we'll have a resolution for you after the next meeting.
Speaker 3Uh, thank you. If I can just ask to, uh, if, if it's not too much trouble, get a draft copy of that. Um, just to make sure that the modifications from the, uh, from the original letter are, uh, are reflected in there, but I thank everybody for their time and their, uh, continued attention on this.
Speaker 1Excuse me, chairman K. I just want to note that Mr. Blount is with us. Great. Thank you.
Case 21-ZB-14V — Braginsky (Sunroom Variance)
21-ZB-14V
AI
00:06:33 – 00:10:18
Applicant Francis Cole requested variance to install sunroom over existing deck with roof extending over covered patio, increasing lot coverage from 20% to approximately 21.4–22%. Board recommended and applicant agreed to condition that covered patio remain open (not enclosed). Application approved unanimously.
Speaker 0Okay. Let's move on to item number 8 21 dash ZB dash 14 V. Alexei. Braginsky
Speaker 2The applicant present?
Speaker 4Yes, I am.
Speaker 2I need to swear you in, could you raise your right hand? Do you swear or affirm that the testimony you're about to give shall be the truth? Yes. Your name and address
Speaker 4Please. Francis Cole, 1631 Meister street, Ms. Galloway, New Jersey.
Speaker 2Thank you. Could you explain to the board what you'd like to do here?
Speaker 4We are seeking to, uh, install a sunroom over our existing deck with the roof, um, extending over a, uh, a covered patio and the, uh, the variant is that, um, instead of being 20% of the coverage of the property, it's going to with the total, um, coverage with the covered patio will be 20.1, uh, 21.4% coverage.
Speaker 0Henry, do you have any concerns or issues
Speaker 5Now, Mr. Chairman, uh, looking at this application, uh, I think, uh, I'm in agreement that deviation from the coverages is minimal. Um, I think you could, uh, look at this. I think the, the one condition may be to just that the covered patio remain open, not enclosed, so that, that little portion of the patio remains open simply just the roof over it. I think you could look upon the application in a favorable manner.
Speaker 0Are you okay with that?
Speaker 4Yes, that is our intent to leave it open. Got it.
Speaker 2And Mr. Henderson, if I could just ask, uh, is the coverage 22% or 21 point something that, uh, Reverend called referenced
Speaker 5The zoning officer has it at 22. So I'm going to assume that she did her calculation. And I would say we go with the 22%. I did not look at it.
Speaker 0Anyone else, any other members of the board have any questions about this application? Hearing none. I'm going to open it to the public. Anyone in the public portion of any questions about this application or comments? All comments.
Speaker 1I don't know. I mean is raising his hand, but that was from before
Speaker 0Alexi is actually, that is my
Speaker 1Contractor. Yes, yes. I remember.
Speaker 6I just want to bring goalie, uh, we not building anything extra <inaudible> and then apply to a COVID existing tool. Pretty much just replacing.
Speaker 0Yeah, no problem. That's fine. Uh, seeing no one else in the public portion, I'm going to close the public portion. Um, I'd like to make a motion to approve this application a second. Thank you. Please call the roll.
Speaker 1Mr. Zimmerman. Yes. Mr. Wasteman. Yes. Mr. Ratio. Yes. Mr. Patel, Mr. Mirando. Yes. And chairman Kao.
Speaker 0Yes.
Speaker 2Your application has been approved. We will memorialize it in a written document at our next meeting. You don't need to be present for that. We'll mail a copy of that document to you. Thank you very much.
Case 21-ZB-15V — Harker (Shed Variance)
21-ZB-15V
AI
00:10:18 – 00:13:37
Raymond Harker sought variance for 12×12 shed located 1 foot from rear and side setbacks. Shed and deck have existed for many years; applicant planning to sell. Board approved with conditions: temporary canopy structures must be removed, and if shed is damaged or rebuilt in future, applicant must return to board for new variance. Variance valid for life of existing shed only.
Speaker 0Well, have a good night. Thank you. Let's move along to item number 9 21 dash ZB dash 15 V. Raymond and Lucille Harker.
Speaker 2Is the applicant present? Yes. Yes. I need to swear you in. Could you raise your right hand? Do you swear the testimony you're about to give shall be the truth, so help you God? Yes. Your name and address please.
Speaker 71 32 Hamilton Boulevard, Raymond Hart
Speaker 2Car. Thank you. Could you explain to the board and what you'd like to do here?
Speaker 7Um, I have a shed. That's a foot by a foot and it's a 12 by 12 sheds. I'm looking for a variant.
Speaker 2Okay. When you say, and when you say a foot by a foot, you mean it's, it's a one foot off the rear setback and one foot off the side setback. That's correct.
Speaker 0Henry, could you please tell us your concerns?
Speaker 5Yeah, I mean, the shed's been there for awhile, um, as are some of the other conditions here, um, that came to our knowledge that the, uh, the coverage is also, uh, I believe, um, quite substantially over on coverage again, how that came about again, I don't know. I know the deck on the home and the shed had been there for quite some time. And that, um, Mr. Harker is, I think, trying to legitimize this cause he's planning on selling. I don't have a big issue due to the fact that this has been here for such long time. Again, am I going to get into, you know, 20 year history or 30 year history of the property, but, um, my only concern would be as long as any temp there, there were some other temporary, uh, canopies on the property, um, at different times, as long as you know, it's agreed upon that any temporary canopy structures removed and, um, a condition that if the shed burns down or gets dilapidated, that, you know, once it's lifespan is gone, I think that anybody who wants to rebuild that shed is going to have to come back to the board, um, if they seek to rebuild it.
Speaker 5So the variance is good for the life of tad existing shed. And then I think after that, they'll have to come back to the board as a condition. They want it to rebuild it or replace it.
Speaker 0Are you in agreement with that? Just comes to the hardcore? Yes. Okay. And what else have any other questions for this applicant hearing? None. I'm going to open it to the public portion. Anyone in the public portion have any questions or comments? This application?
Speaker 1I do not see anyone.
Speaker 0Chairman public portion is closed. I'd make a motion to approve this application with the conditions that, um, Henry outlined in his testimony. Thank you, Mr. Chairman,
Speaker 1Mr. Zimmerman. Yes. Mr. Weissman? Yes. Yes. Mr. Patel, Mr. Blount? Yes. Mr. Mirando? Yes. And chairman Cahill. Yes.
Speaker 2Your application has been approved. We will memorialize our next meeting and send a copy to you.
