He's not proposing to really exacerbate that the, uh, the addition is going pretty much straight up on the existing foundation. Um, he does propose a, again, a garage in two story addition to the, to the right, but he's stepping that back so that it, uh, meets the, the setback requirements, uh, to the greatest extent possible, uh, in keeping with the existing architecture of the house. That being said, there is one issue that that road lodge street is under a moratorium right now. So that means is that you will not get a road opening permit until, uh, June of next year when that moratorium expires. So just want you to be aware, you cannot, uh, change the configuration of the driveway because you will not be allowed to probably receive a road opening permit to do so until June of next year, you can do it at that point, once that moratorium expires. So just be aware of that, but otherwise there's really no other considered.

So that it's at least eight feet off of that rear property line and, uh, 10 feet from the side property line. Uh, I think that the board can look at at the, the application, um, favorably and not have to, you know, make you move the entire pool, which I do think that would be excessive. Uh, the other issue is, is that there is a future road improvement project planned for PO place. And I was asked for a, uh, as to get in five foot temporary construction easement, uh, along the roadway, uh, the easement documents would be prepared by the town. Um, and again, it's a temporary, it would just be so that, uh, when they repair the road, they may damage some grass or something of that nature. Uh, so they, they ask for a temporary construction easement, uh, for that purpose. So again, there would be no costs, uh, incurred, uh, by you for that easement. It would just be something you'd be providing to the township and the township would be preparing the documentation for that if you're in agreement.

Speaker 7Right. And that's what we're talking about is because the pool equipment wasn't shown, we weren't sure we weren't sure if the variance was going to be needed or not. Um, in your explanation. And from what I see on the picture, the pool equipment is between the pool and the rear property line. Uh, you're asking for a variance, I believe of six feet from the rear property line, which means the pool equipment's actually closer than six feet to that rear property line. Um, the reason for that ordinance is so that pool of equipment is a little bit further away from the neighbor and property lines, so that the noise from the pool equipment and when you backwash the system, doesn't impact the neighbors. So although the pool itself, it can be a little bit of leaning on it. And we understand that what's involved with moving the pool of the pool equipment is I think a much simpler process of moving that to a conforming location. And again, we're trying to work with beyond that. Again, the requirement is 10 feet. I think if we can get it to about eight feet us a little bit further away from the property line, I think that's a good compromise of in making you do it the full 10 feet.

Speaker 7We can approve the application. We'll say that the equipment is to be relocated to eight feet. If you have a problem, not being able to do that. And for some reason you cannot, you're gonna probably have to come back to the board and explain why you can't, you can't move it.

Whenever that comes down the line, it could be a year. It could be five years down the line. I'm not really sure, but it's basically an, uh, a document that the township attorney would prepare stating that, you know, if, if we damage the five feet of grass, they're going to repair it and restore it in kind, but we ha we have permission to work in the, in that rate of way area. That's only adjacent to the capture property or the frontage of the street.

Speaker 7I'm not really too many issues with this. Uh, again, it's, it's a tough lot. You know, obviously the foundation is where it is. Uh, she's looking to reconstruct the home pretty much in the existing configuration. Um, the law is very Archie triangular, uh, tracked on west fourth street in Rushmore. Um, is that portion of Rushmore avenue, uh, actually developed or is it a paper street? There's a road it's there next to your property?
Speaker 11I don't understand. Wait, I'm new to this. <inaudible> my house is the only house. That's one that side of the block. It's very weird because when you go around that block, you see all the houses, but if you walk down the street a little, you see a church and it's around the corner.
Speaker 7Gotcha. Like I said, I mean, the only issue I have is that, um, again, that one little portion of your house that you're showing is as the new entrance for your area, um, is, is very close to the street. And I was wondering if there was a way you could just, um, if you look at the, the, the plan of the foyer, um, pretty, it's a decent sized boy with a big closet in the back. If you just took like a foot off the foyer and the foot off the closet, you would improve the setback by two feet, or you put the closet on the side of the foyer and then pushed it back to where the closet is. Now you would, you would improve that setback quite a bit and you really wouldn't lose any space. So if you just reconfigured it a little bit, uh, you could improve that setback, um, against, you know, the street, which is really that's, that's the only really severe issue that I see is your house is literally like five feet from the property that I'm right now. So by just tweaking the foyer, maybe taking the foot off the foyer or the closet, or taking the closet and putting in on the side of the foyer and pushing the foyer back a little bit, you could pick up a couple of feet, um, of back and it would be more compliant with that front yard, except back a bit something you could work on with your architect.

Speaker 7Nine, 9.9 0.08 feet wherein it's actually four and a half feet. Right. And what I'm asking for is for them to move the steps, uh, back. So the, the landing outside the rear porch cut that down so that it's three foot by three foot out of the back door and then have the steps off of that landing. So you'll pick up about oh two or three feet. And, uh, again, that setback, then we'll be closer to seven, seven and a half feet versus the, not really the four and a half feet, which is what you have now, again, that again, should not be an issue. Um, but yeah, four and a half feet to the rear property lines. When, when, when the leave 25 feet is required is appointed quite a varied. So again, improving that, improving the front a little bit will help out, but I really don't see. I mean, these are all very minor items that I think the architect would be able to take care of her.
