The individual I'd like to elect was on the board when I started, and I started over 20 years ago. And he helps us out in the dark waters and navigates us through most of these app applications when they become a little obscure. Put it in layman's terms. Happy to nominate. I'm happy to nominate Jim Kinneally to be the board attorney. Can I get a second?
Speaker 3I'll second. I'll
Speaker 1Roll please.

Speaker 3Thank you for your support. Appreciate
Speaker 1It. You're welcome. John. Well deserved. This next appointment is for a recording clerk. This individual is the, the heart and soul behind our board. Without her, I mean, we show up on Thursday nights and we, we have paperwork in front of us and we, we know what's laid out, but we don't know the intricacies and the hard work behind the scenes. That makes it so simple for us to pre continue as a zoning board. And I would like to ask Laura Buckley to continue as our, our clear.
Speaker 3I'll second.
Speaker 1Oh, jumping it all in. Everyone wants a second now. One.
Speaker 3I appreciate it. Thank you.
Speaker 1Much love. Alright. I won't call on that one,
Speaker 3Please. Mr. Weisman? Yes. Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Reggio? Yes. Mr.. Blan?

Speaker 1I guess
Speaker 3You, thank you.
Speaker 1Happy New Year. Happy to hear you as well. We are gonna look at some committee appointments. Laura, I was gonna ask for the subdivision committee and the sitelink committee are the people that were on it the last time, are there any changes in personnel? Could we just have them?
Speaker 3No. Yeah, we could have the same ones I could actually pull out from last year and just
Speaker 1Let, let's just do that in any, any interest of simplicity. Okay. Okay. Number I, number 12 is move to adjourn. Can I get a all in favor of a German? Say aye. All opposed. Okay. Meeting is adjourned.
Speaker 3Welcome back everyone.
Regular Meeting Opening, Roll Call & Pledge AI  00:07:04 – 00:08:40
The regular zoning board meeting was called to order with roll call and Pledge of Allegiance. The chairman noted the board had many applications on the agenda and requested applicants be prepared to expedite if their cases proceed well.
Speaker 1Okay. Well be, gimme like a five second little break here and we'll start the next meeting. All right. Zoning. Board of adjustment meeting will please come to order. Adequate notice of this meeting was provided in the following ways. Notice published in the Courier News notice posted on the bulletin board in the municipal building notice made available to the Township clerk. Notice sent to the Courier News and the star ledger. Will the clerk please call the roll?

Speaker 1Here. Will everyone please stand? Salute the flag.
Speaker 4My pledge allegiance to the flag. United States. United States of America. And to the Republican nation. Invisible liberty and justice for
Speaker 1Before we start the meeting, Mr. Kinneally, we've got quite a few applications on the agenda tonight. In the interest of expediting these and not wasting the public's time, I would ask that the applicants, if you, if you get notification from me or any other members of the board that the application is going well, we, we might, we might expedite that process quicker than we normally would. So that being said, Mr. Kinneally, do we have any changes to the agenda?
Agenda Announcements & Postponements AI  00:08:41 – 00:09:08
The board attorney announced one postponement: the Horton application at 1697 West Fourth Street was unavailable and was postponed to January 26th.
Speaker 0I'm only aware of one change issue of Horton. 1697 West fourth Street is unavailable tonight, so that matter's gonna be carried to Jan 26th. Ms. Buckley, did she notice?
Speaker 3She told me she did, but she didn't have a chance to drop them
Speaker 0Off. Okay. So if anybody's here on the Horton application, there will be no further notice If they did notice, if she did not notice, there will be notices for January 26th. Those are all the changes I'm aware of. Mr.
22-ZB-103V - Dish Wireless LLC 22-ZB-103V AI  00:09:08 – 00:11:26
Dish Wireless applied to add antennas to an existing cell tower. The applicant demonstrated compliance with federal and state zoning exemption requirements per the planner's review letter. The board approved the application with a condition for site maintenance.
Speaker 1Chair. Thank you. Thank you Mr. Kinneally. Let's move on to item number 5 22 ZB 1 0 3 V. Dish Wireless, L L C
Speaker 0Mr. Skolnik
Speaker 5Richard Skolnik on behalf of the applicant. Can you hear me okay?
Speaker 1Yes, sir. Lab clear, sir
Speaker 5Chairman, in regard to what you have to say, this is an application to add some antennas onto an existing cell tower. Mr. Chadwick issued a review letter confirming that we complied with the federal and state requirements for the zoning exemption. So I have my engineer on the line, but I don't think I need to put 'em on since we have the confirmation for Mr. Chadwick. So I know the board has heard these. I was in front of you a couple months ago. I see my esteemed colleague, Mr. Purcell, behind me. So we do have Mr. Chadwick's confirmation letter. We would request that the board confirmed that we complied with those exemption standards for the addition of new antennas and equipment. We're not exceeding the existing height and we're not going out more than 20 feet and we're putting the equipment in the compound. That's all I have. Chairman.
Speaker 1Awesome. Thank you so much for being concise and, and brief.
Speaker 4One comment. The site needs a little site maintenance. I left a message with Richard on that, and I believe you're also agree to comply with all the prior conditions on site.
Speaker 5Of course, we don't think that maintenance is the tower folks, but whatever it is, we'll work with the owner and, and we're agreeable to that
Speaker 1Condition. Thank you. Mr. Skolnik. Any other members of the board of any questions about this application? Hearing none, I'm gonna open it to the public. Anyone in the public have any questions or comments about this? Ms. Buckley?
Speaker 3No one's raising their hand. Chairman. Okay.
Speaker 1Hearing none. I'm gonna close the public portion and offer move, move to approve this application. Can I get a second?
Speaker 4I'll second.
Speaker 1Thank you. Kalpesh, please call roll.
Speaker 3Mr. Weisman?
Speaker 1Yes.
Speaker 3Mr. Tillery? Yes. Mr. Patel? Yes. Mr. O'Reggio? Yes. Mr. Dacey?
Speaker 1Yes.
Speaker 3Mr. Hidaka? Yes. And Chairman Cahill?
Speaker 1Yes. Chairman. Thank
Speaker 0Will more memorialize this at our next meeting.
Speaker 5Thank you so much. I'm on vacation. I appreciate you putting me in this spot on the agenda.
Speaker 1Go enjoy yourself.
Speaker 5Look, take it. Thank you. My family's waiting for me for cocktail hour.
22-ZB-91V - NYSMA/Verizon Wireless 22-ZB-91V AI  00:11:30 – 00:14:00
Verizon Wireless sought interpretation and reversal of a zoning officer denial to add one net antenna and ancillary equipment at 300 South Randolphville Road. The applicant stipulated that construction would not proceed until a required structural tower modification by AT&T was completed. The board approved with this stipulation.
Speaker 1Enjoy. Have one for me. Let's move on. Item number 6 22 dash zb dash 91 V n y s m a s a limited partnership doing business as Verizon.
Speaker 0Mr. Purcell?
Speaker 6Yeah. Thank you, Mr. Chairman. My name's Edward Purcell. Council Price, Shelman and dear here tonight from New York. Smsa, D B a Verizon Wireless. Like Mr. Skolnik, this is a very similar application. This is for at 300 South Randolphville Road, a tower where Verizon seeks to add a, a net of one antenna and some additional ancillary equipment. We just are requesting an interpretation and in reversing of the zoning officer at denial with respect to this matter, essentially just requesting a administrative direction for an administrative approval of this under the applicable state and federal law. Mr. Chadwick also sent a letter agreeing that this fell within that those, that that exemption. Just one particular condition that I'll mention with respect to this matter. There was a structural analysis which was provided to, to the board. There's one condition of that structural analysis. It was a modification to the tower. That modification is gonna be made by my understanding is at and t is part of its application that it's gonna be pending before this board very soon. So what we would stipulate to is that we would not construct, you know, AbbVie's additional antennas until that modification is made. That's a, that's a requirement of our structural analysis.
Speaker 0And I've discussed this with Mr. Purcell and that's acceptable from a legal standpoint for the zoning board.
Speaker 1Thank you. Mr. Kinneally. Does anyone on the board have any questions about this application? Hearing none. I'm gonna open it to the public. Does anyone on the public have any comments or questions about this application?
Speaker 3No. And
Speaker 1Chairman? Nothing. Okay. We've closed the public portion and make a motion to approve this application with the stipulation of that. Mr. Kinneally. Just, that was
Speaker 3The amend
Speaker 1The modification. Sorry. Yeah. Okay. Can I get a second?
Speaker 6A second.
Speaker 3I'm taking order.
Speaker 1Take one more.
Speaker 3Mr.. Dacey roll. Yes. Mr. Dacey. Mr. Tillery? Yes. Mr. Patel? Yes. Mr. O'Reggio? Yes. Mr. Dacey? Yes. Mr. Hay daca? Yes. And Chairman Cahill? Yes.
Speaker 0Mr. Priscilla will memorial this at our next meeting.
Speaker 6Thank you very much. Have a good evening.
22-ZB-92V - Jonathan & Nicole Stool 22-ZB-92V AI  00:14:02 – 00:18:38
The applicants at 10 Dunbar Avenue sought relief from front yard setback requirements to install a pool, shed, fence, and possibly a pavilion/gazebo. An unapproved right-of-way at the rear created setback issues. Applicants agreed to all conditions including permanent easement provisions and deed restrictions. The board approved the application.
Speaker 1Have a good evening, sir. Let's move on to item number 7 22 DB 92 V. Jonathan,
Speaker 0Is Jonathan present?
Speaker 7I am, yes.
Speaker 0Okay. Are you both gonna be testifying?
Speaker 7Yes.
Speaker 0Both of you in, could each of you raise your right hand? Do you swear that testimony you're about to give should be the truth?
Speaker 7Yes. Yes.
Speaker 0One at a time. Could I have your name and address please?
Speaker 7Jonathan Stool, 10 Dunbar Avenue, Piscataway, New Jersey,
Speaker 8Nicole 10 Dunbar Ave. Piscataway, New Jersey.
Speaker 0Thank you. Could one of you explain to the board what you'd like to do here?
Speaker 7Sure. So we had already applied for a variance for a pool. We have an existing unapproved right of way at the rear of our property, which creates a front yard setback in the rear of the property. We had applied for a variance to have a pool installed, and as part of moving forward with a project, we've decided we want to install a shed fence and possibly a pavilion or gazebo in that rear area that would violate this front yard setback. So we're requesting relief from that.
Speaker 0Have you had a chance to look at Mr. Hinterstein November 29th and January 12th memo?
Speaker 7Yes. I, I have the, the January 12th memo? Yes.
Speaker 0Okay. Can, can you address the items contained in that memo?
Speaker 7Sure. So number one, yes. We, we to meet the eight foot setback that was inadvertent in the application process. And then for number three, well number two just says that there's no issues, I believe so. We agree, correct?
Speaker 0Yeah. Number
Speaker 7Number three is about the, the permanent easement for the, the other side, the, because of the massive plan width of 50 feet. I mean, we generally agree with that. Whatever the process is, we would need to understand that, I guess. And then as far
Speaker 0As would take care of that process, you
Speaker 7Just have to sign. Okay. Okay. So we're just agreeing to that. Yes. So I mean, we agreed to number three and number four. The only thing about number four question that I had was about the timing. I understand that it's in process and the plans are being drawn. I, we saw the surveyors doing the work. So is it, is that gonna happen at the point in time when the Township comes up with that process? Is that, is that what we're agreeing to
Speaker 0Mr. Hinterstein?
Speaker 9Yeah, that process is really an unknown. Okay. Unfortunately, it's, they're doing the survey work for it now. It could be a year, it could be two years until they actually, you know, put a shovel in the ground to actually start construction again. That temporary construction easement is just when they actually do the construction. If a tire goes over the property line or leaves a rod or something of that nature, they'll repair it. But it's just, they want that comfort to know that if they do go over the line, that it's temporary. They're responsible for repairing damage that they create. And basically that's what the temporary construction is for case they're putting in sidewalk piping, new curbing, you know, materials. Really, that's what it's what it's about. But as far as timing, that's usually, you know, it's usually a one to two year window from the time you see the survey work. You could talk to Joe Herrera in the engineering department to try to get that clarified a little bit closer.
Speaker 7Okay. Like I said, we, we don't have any problem with it. The agreement, I, my time question about timing is we're just agreeing that when it comes up, we're gonna accept it. That that's what the, the comment is Correct. Okay.
Speaker 9Right. It's only during that construction of that project.
Speaker 7Okay. Yep. And then on number five, I wasn't certain about what that was.
Speaker 0I don't think you have to worry about number five. Okay. Mr. Chairman, those are all the issues raised in Mr. Henderson's letter.
Speaker 1Got it. Okay. Any other members of the board of any questions for this application or this applicant? Hearing none, I'm gonna open it to the public. Anyone in the public have any questions or comments for this applicant?
Speaker 3No one Chairman.
Speaker 1Okay. Hearing none, I'm gonna close the public portion and I'm gonna put a motion up there to approve this application. And I got a second. Thank you. Kalpesh, please call roll.
Speaker 3Mr. Weisman?
Speaker 1Yes.
Speaker 3Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Reggio? Yes. Mr. Bla?
Speaker 10Yes.
Speaker 3Mr. Hay Daka? Yes. And Chairman Cato?
Speaker 1Yes.
Speaker 0Your application has been approved. We will memorialize it in a written document at our next meeting and send that document to you.
Speaker 1Thank you. Thank you. Good luck. Good evening guys. Good luck.
Speaker 10Good evening.
22-ZB-84V - Frank Barber 22-ZB-84V AI  00:18:43 – 00:20:54
Frank Barber sought relief for a replacement fence on a property fronting three streets (significant hardship). The applicant agreed to provide a five-foot temporary construction easement along Seventh Street for future road improvements. The board approved the application.
Speaker 1Okay, let's shoot on down to number 8 22 dash ZB dash 84 V. Frank Barbara, Mr. Bar with us?
Speaker 3Yep. He has to unmute. There he is.
Speaker 0Mr. Barber, I need to swear you in. Could you raise your right hand? You swear the testimony you're to give should be the truth?
Speaker 10Yes.
Speaker 0Your name and address please?
Speaker 10Frank. Frank. A Barber three Jenny Place in Piscataway, New Jersey.
Speaker 0Thank you. Could you explain to the board what you'd like to do here?
Speaker 10Relief from a variance that affects the installation of a replacement fence,
Speaker 1Henry?
Speaker 9Yeah. This application's unique. It's property that fronts not only one street, but actually fronts three streets. So there's quite a hardship here. Don't have any issues with the fence locations that the there exist now and where the replacement fence is gonna go. The only issue similar to the last application is that we ask that you would provide us with a five foot temporary construction easement along seventh Street or something like that. Seventh Street for future road improvements. So if you're in agreement to that, I don't see any issues with this application.
Speaker 10Yes, I'm in, in agreement.
Speaker 1So item number two on the site report, you're in agreement with Mr. Barber?
Speaker 10Yes.
Speaker 1Okay. Awesome. Any other members of the board have any questions or comments for this application? Hearing none, I'm gonna open it to the public. Anyone in the public have any comments or questions for this application?
Speaker 3No. One
Speaker 1Chairman. Okay. We're gonna close the public portion and I'm gonna make a motion to approve this application. A second. Thank you. Kalpesh, please call the roll please.
Speaker 3Mr. Weisman?
Speaker 1Yes.
Speaker 3Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Reggio? Yes. Mr. Blan?
Speaker 1Yes.
Speaker 3Daca? Yes. And Chairman ca?
Speaker 1Yes.
Speaker 3Alright. Thank Uhrin Mr. Dacey
Speaker 1You Mr. Barbara memorialize in our next meeting and send you a copy. Thank you. Good luck. Luck Mr. Barbara. Thank you very much. Happy New Year. Happy New Year too soon. Goodnight. Frank. Let's go to item number 9 22 ZB dash 78 V. Kenneth Mazari here. Did I kill that last name, sir? No, no, you do. Well. All right. Thank you. Did Mr. Kaplan make it back?
22-ZB-78V - Kenneth Mazariegos 22-ZB-78V AI  00:21:20 – 00:25:07
Kenneth Mazariegos requested variances to retain an existing grill and gazebo at 132 Stelton Road on a corner lot with two front yards and an undersized lot (75 feet instead of 100-foot minimum width). Applicant agreed to comply with all planner-outlined requirements. The board approved the application.
Speaker 11I'm here. Can you see me? I've switched devices. Laura, are you able to
Speaker 3No, but we hear you.
Speaker 11You hear me? But you still can't see me.
Speaker 3No. That's kinda weird.
Speaker 1Yeah.
Speaker 11Do we need any visual? I went, I went in through the link.
Speaker 1Mr. Kaplan?
Speaker 11Yes.
Speaker 1Are you gonna provide us with any visuals tonight?
Speaker 11No, I'm
Speaker 1Not. Then you, you're fine where you are.
Speaker 11Okay. Thank you very much. Okay, so this is an application on behalf of Kenneth Mazariegos. It's for both Variance 1 32 Stelton Road. The application is to retain an existing grill and gazebo on the property. Apparently there's also an existing retaining wall that is been there for years. That's partially within the right of way. The property is on the corner of Stelton Road and Woodrow. Therefore, the property has two front yards. There are a number of variances, but looking at them, you can see that the lot is undersized. The lot is below the minimum lot width. It's 75 feet instead of a hundred feet.
Speaker 11The setback is slightly below. And we believe that there are considerable hardships here based on the lot. The grill was built approximately 40 feet from Woodrow. There is a fence surrounding the property and it's really not visible to any of the neighbors. There's a store across Woodrow, there's a neighbor behind. And Mr. Magos will, will testify to the particulars if you'd like. But we believe that the nature of the lot is such that there are considerable hardships and the grill is in the best possible position and it is not a detriment to any of the neighbors. Mr. Mazariegos has reviewed Mr. Stein's report. He's filed for the permits and he's prepared to comply with all of the requirements in the report.
Speaker 1That's good for us at this point, to be honest with you. Any other members of the board of any questions for this applicant or this application? Hearing none, I'm gonna open it to the public. Anyone in the public have any questions or comments for this application? You're not being held, held. Could you please mute your phones please? Anyone? Anyone? Laura?
Speaker 3I have no idea who that is. No Chairman. But for the public, if you need to speak or have any questions, bottom of your screen, there's a raised hand click raise hand, and then you could ask a question or give a comment. Okay. And there's no one
Speaker 1Chairman. Okay. So I'm gonna close the public portion and based on their, their ability to adhere to what Henry outlined in the side impact, I'm gonna make a motion to approve. Approve this application
Speaker 14On a second.
Speaker 1Thank you. Kalpesh. Laura, please call the roll.
Speaker 3Mr. Weisman?
Speaker 1Yes.
Speaker 3Mr. Tillery? Yes. Mr. Patel? Yes. Mr. O'Reggio? Yes. Mr. Blan?
Speaker 1Yes.
Speaker 3Mr. Hay daca? Yes. And Chairman Cahill?
Speaker 1Yes.
Speaker 0Mr. Kaplan. We'll memorialize this at our next meeting.
Speaker 11Thank you very much. Appreciate it. Sorry for the glitch. I don't know what happened, but I tried two
Speaker 1Devices. Make it up to us next time. Don't worry about it. Okay. Thank you very much Mr. Kaplan. Let's move on to item number 10 22 ZB 95 V. James Murray.
22-ZB-95V - James Murray 22-ZB-95V AI  00:25:08 – 00:26:56
James Murray requested a variance to install an 8-by-12 wooden shed in his backyard in an area covered by an existing easement. The applicant also sought approval for a 35-year-old fence in the same easement, acknowledging responsibility to remove both if the township required access. The board approved the application.
Speaker 0Mr. Murray, are you present?
Speaker 1Yes, I am.
Speaker 0Hello. I need to swear you in. Could you raise your right hand? Do you swear that the testimony you're about to give should be the truth?
Speaker 1Yes, I do.
Speaker 0Thank you. Could you explain to the board what you'd like to do here?
Speaker 1Yes. I would like to install an eight by 12 wooden shed in my, in a northeast corner of my backyard in an area that is currently an an easement that runs through my backyard. I also have a fence that's been there for roughly 35 years that I would like to also get the variance approved for that.
Speaker 0And do you understand that if the Township ever needs access to that easement, it would be your responsibility to remove the shed and the fence from that easement?
Speaker 1Yes, I do. And the, the shed is, is would be movable. I mean, it wouldn't be the easiest thing to move, but it's, it's not permanently attached to the ground or anything. It would be movable. So yes, that's not a problem. Good, good, good. Thank you. Any other members of the board of any questions for this application? Hearing none. Anyone? No one. Okay. I'm hearing now I'm gonna go to the public. Anyone in the public have any comments or questions for this application?
Speaker 3No. One
Speaker 1Chairman. Thank you very much. I'm gonna close the public portion and I'm gonna approve Mr. I'm gonna ask for an approval of Mr. Murray's application. Can I get a second?
Speaker 14Second

Speaker 0Both. This, this, this is in an easement, sir.
Speaker 15Yeah, that is.
Speaker 0And do you understand that if the Township ever needs access to that easement, it would be your responsibility to take the shed and whatever else is in the easement out at your own cost?
Speaker 15Yes, I do.
Speaker 0That's all I have. Mr.
Speaker 1Chairman. Thank you. That being said, any other members of the board of any questions or comments for this application? Hearing none, I'm gonna open it to the public. Anyone in the public have any comments or questions for this particular application?

22-ZB-98V - Prash Stan 22-ZB-98V AI  00:29:04 – 00:30:49
Prash Stan requested a variance to keep an existing six-foot fence in the rear of his property at 194 Brewster Avenue, located in a township right-of-way or easement. The applicant acknowledged responsibility to remove the fence at his own cost if the township needed access. The board approved the application.
Speaker 0Is Chesh present?
Speaker 3You have, you have to, you're
Speaker 1Muted, sir?
Speaker 16Yes, I'm
Speaker 0Okay, sir, I need to swear you in. Could you raise your right hand? You swear the testimony you're about to give should be the truth?
Speaker 16Yes,
Speaker 0I do. Your name and address please.
Speaker 16My first name, Prash. Last name Stan. 1 94 Brewster Avenue. Piscataway.
Speaker 0Thank you. You can put your hand down and explain to the board what you'd like to do.
Speaker 16There is an existing six foot high fence in the back of my house. And that is in the right, in this some kind of Township land or right of way, whatever you have. And I would like to keep that fence.
Speaker 0And do you understand that if the Township ever needed access to that easement, it would be your responsibility to remove that fence at your own cost?
Speaker 16Yes, I do.
Speaker 0That's all I have. Mr.
Speaker 1Chairman. Okay. Any other members of the board have any questions or comments about this application? Hearing none. I'm gonna move it to the public. Anyone in the public have any questions or comments about this application?
Speaker 3No. One
Speaker 1Chairman. Okay. Thank you. I'm gonna close the public portion and make a motion to approve this application. Can I get a second? Laura, please call
Speaker 3Mr. Weisman? Yes. Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Regio? Yes. Mr. Dacey? Yes. Mr. Hay daca? Yes. And Chairman Cahill?
Speaker 1Yes.
Speaker 0Your application has been approved. We will memorialize it in a written document at our next meeting and send that document to you. Good luck.
Speaker 16Thank you very much. Thank thanks to the board.
Speaker 1Good luck, sir.
Speaker 16Okay. Thank you
Speaker 1Mr. All right. We're gonna shoot on down number 1322 ZB 96 V. Gary Summar. Me. Hey, me Mr.. Dacey,
22-ZB-96V - Gary Summar 22-ZB-96V AI  00:30:58 – 00:33:47
Gary Summar requested a variance to build a larger shed eight feet from a paper street on Hancock Road, rather than the required 60 feet. The applicant agreed to provide a five-foot roadway easement to allow for potential future street widening. The board approved the application.
Speaker 0I need to swear you in. Could you raise your right hand? You swear the testimony you're about to give should be the truth.
Speaker 17I do.
Speaker 0Your name and address please.
Speaker 17Smar for Avenue, Piat, New Jersey.
Speaker 0Thank you. Could you explain to the board what you would like to do here?
Speaker 17I guess it's a south southwest side of my property that's, and it's a place under road area. And I have all shared eight feet from that line. And I want to build a bigger shed. And because it's higher, I guess it just goes with different situation and requires, I guess, 60 feet from that line that I'm asking you to allow me to keep the place and build a shed eight feet from that line.
Speaker 0And do you understand that if the Township ever needs access to that easement, it would be your responsibility to move the shed and the fence from the easement?
Speaker 17Yes.
Speaker 0That's all I have. Mr.
Speaker 1Chairman. Thank you. Mr. Dacey.
Speaker 9Mr. Chairman? Sure. Henry Chairman. Just to go back, circle back on this one. I believe this one wasn't an easement. It was a front yard.
Speaker 17It's not front yet. It's a, it's a,
Speaker 9It's, yeah, it's a paper street. Unfortunately not. Not an easement. I'm
Speaker 0Sorry, I was looking at the wrong one.
Speaker 16No
Speaker 17Problem. Okay. I mean, so
Speaker 9This one had a condition of, if you were in agreement that if you, I don't know if you heard the other applications regarding the five foot temporary construction easement or permanent easement in this case for Hancock Road because the road doesn't meet the master plant half width. So in this particular case, we're looking for a roadway easement for five feet. So if we widen the street, okay,
Speaker 17Yeah, sure. But will be great because of it, you know, kind.
Speaker 9Yeah. It's a small, yes. So hopefully they'll, they'll work on that in the future.
Speaker 17But I would agree, kind of whatever Township wants me to do afterwards, because it's said it's sort of house. I can't even, but it's expensive.
Speaker 1Anything else, Henry?
Speaker 9Nope, that's it.
Speaker 1That's good. Okay. Any other members have questions for this application? Hearing none, I'm gonna open it to the public. Anyone in the public have any questions or comments for this application?
Speaker 3No. One Chairman.
Speaker 1Okay. Close the public portion. I'll make a motion to approve this application again. A second. I'll second.
Speaker 3All right. Open Ms. Mr. Weisman? Yes. Mr. Tillery? Yes. Mr. Patel? Yes. Mr. O'Reggio? Yes. Mr. Blan?
Speaker 1Yes.
Speaker 3Mr. Hidaka? Yes. And Chairman Kale?
Speaker 1Yes.
Speaker 0Your application's been approved. We will memorialize it in a written document at our next meeting and send that document to you. Good luck. Thank
Speaker 17You.
Speaker 9Bye.
Speaker 1Good luck, sir. Let's move on to item number 1422 ZB 100 V. Sammy, I'm not even gonna go there. Abdul
Speaker 0Ab. Abdul Ramen.
22-ZB-100V - Abdul Ramen 22-ZB-100V AI  00:34:00 – 00:36:25
Abdul Ramen requested approval to build a fence in an easement area at 1803 Den Avenue where a fence had previously existed. The applicant confirmed that one of two sheds was removed as stated on the survey. The board approved the application.
Speaker 1Okay. Is
Speaker 0Mr. Abdul Ramen present? Does anyone see the applicant?
Speaker 1I do not. There he is down the bottom. He just unmuted himself. You there sir? Yes, I'm here. Awesome. Sorry,
Speaker 0I need to swear you in. Could you raise your right hand? Sure. Do you swear the testimony you're about to give should be the truth?
Speaker 1Yes. True.
Speaker 0Your name and address please?
Speaker 1Seman 180 3 Den Avenue Piscataway 8 8 4.
Speaker 0Thank you. Could you explain to the board what you'd like to do
Speaker 1Here? I'm trying to just build a fence in easement area and it was existing and I just need to innovate it and build it on my, by my own name.
Speaker 0And do you understand that if the Township ever needs access to that easement, it would be your responsibility to remove that fence?
Speaker 1Sure. Yeah.
Speaker 0That's all I have Mr. Chairman.
Speaker 1Okay. Thank you very much. Any other members of the board of any questions or comments for this application?
Speaker 9Yeah, Mr. Chairman, just quickly, can the applicant confirm that the shed was removed as he stated on a survey?
Speaker 1Yes. We, one, once I bought that house, there were two sheds, one of them being removed. And the old one is still existing.
Speaker 9Is it shown on the plan though? Okay. So the one on the left is shown on the planet, correct?
Speaker 1Correct. Yeah.
Speaker 9And that one's staying there, right?
Speaker 1Correct.
Speaker 9Okay. And is that three feet off of the side property lane?
Speaker 1Yes.
Speaker 9Okay.
Speaker 1No other questions? That's it. Okay. Thank you Henry. Anyone else questions? No. Can open it to the public. Anybody in the public have any questions or comments about this application? You're muted. Laura.
Speaker 3I don't know where I
Speaker 1Read. I read your lips anyway. I figured we're gonna close the public portion and I'll make a motion to approve this application. Can I get a second?
Speaker 3I second.
Speaker 1Thank you. Kalpesh, please call the roll.
Speaker 3Mr. Weisman? Yes. Mr. Tillery? Yes. Mr. Patel? Yes. Mr. O'Reggio? Yes. Mr. Blo?
Speaker 1Yes.
Speaker 3Mr. Hay daca? Yes. And Chairman Cahill?
Speaker 1Yes.
Speaker 0Your application's been approved. We will memorialize it in a written document at our next meeting and we'll send that document to you. Good luck.
Speaker 1I appreciate. Thank you so much. Have a good night, sir. You too. Bye-bye. We're skipping 15 and moving towards 1622 ZB 97 V Hugo Tezo
22-ZB-97V - Hugo Toso 22-ZB-97V AI  00:36:37 – 00:43:07
Hugo Toso sought to retain a backyard fence, pool, and shed at 198 Brewster Avenue, all in township easements for 32+ years. The planner required a building permit for the pool and a deed restriction stating that if the pool or shed is removed in future, replacements must be in conforming setback locations or require new board approval. The board approved with these conditions.
Speaker 0Is Mr. Dacey present.
Speaker 3Okay. Mr. Tezo does not have email. I don't know if somebody was helping him. If there's any attendee that is helping him with this application, raise your hand. There we go. Okay. One minute.
Speaker 1See the Galaxy tab A seven. Can we unmute?
Speaker 3Yeah, you could. You could unmute. There you go. And you're muted again.
Speaker 1Whoever's on the Galaxy tab A seven today. You, you're unmuted there. Go Steve. I can hear us. Hello?
Speaker 18Toso Here.
Speaker 3There we go. Hello. Mr.. Dacey.
Speaker 0Who? Who's speaking please?
Speaker 18Yes.
Speaker 0Yes. What's your name?
Speaker 18Hugo Toso. 1 98 Brewster Avenue. Mr..
Speaker 0Dacey, I need to swear you in. Could you raise your right hand? Do you swear that the testimony you're about to give shall be the truth?
Speaker 18I do.
Speaker 0Thank you. Could you explain to the board what you would like to do here?
Speaker 18I tried to get a variance for the backyard fence. I received a letter from the Township a while back and told me I have to go through the motions. So that's what I'm doing. Plus a little sh I have a she on the other side.
Speaker 0And you know that one of the reasons you're here is because you wanna put this fence in an easement.
Speaker 18Well, it's been there for 32 years.
Speaker 0Yes. And we understand that. But you understand that if the Township ever needed access to that easement, you would be responsible for the removal of the that fence. Yes.
Speaker 18I was told that 32 years ago.
Speaker 0Okay. It remains true today. Mr. Hinterstein, I'm not sure Mr. Torano received your report. So could you touch on the other items in your report?
Speaker 1Yes. Mr. Torano, not, not only the fence, but also
Speaker 9If for some, some reason we needed to gain access into that easement. You're shedding the pool are also in that easement. So you would be responsible for removing anything on the easement if we ever needed to do work in that easement. You understand that
Speaker 18Now the, the pool is over the easement in the back or the one coming from the other street.
Speaker 9The, the pole's in the easement. Your fence is in the easement. And your shed's in the easement. So, okay, if for some reason we ever, the, the problem is, is the easement goes across the back, but you also have an easement that runs down the side of your property as well.
Speaker 18Right? It goes, it comes from black all the way
Speaker 9Through. Right? So if that's what I'm saying is any work needs to be done in any of those easements and they require you to move the pool, the fence or the shed, that's gonna be your responsibility to do so.
Speaker 18Okay. I haven't used the pool in 15 years.
Speaker 9Why don't you take it down?
Speaker 18I've got grandsons.
Speaker 9Oh, okay. Well, the other, the other item too is that, again, this pool and, and the shed, the, the variance that's gonna be given to you is gonna be given to you for those particular items. Cuz I believe they've been there for a while. They're, they're pretty well screened with the fencing, but they're not in a conforming location. So I think there should be a caveat that says that, you know, once the pool comes down, whether it needs to be replaced or if he takes it down that, you know, any new pool or any replacement shed would have to be in a conforming location. As far as to the setbacks. I, I think that you might also need to put that in a deed. A deed.
Speaker 18Deed restriction.
Speaker 9Deed restriction. Thank you Mr. Kinneally for that. Just in case the property's ever sold the new owner, I think we'll know that if the pool or shed needs to be replaced, that may have to go into a conforming location or, or appear before the zoning board on, on that case again. And then the only other thing is, is did you ever get a, a permit for that pool?
Speaker 18Not that I know.
Speaker 9Okay. Then you, you really should get a permit for the pool from the building department just to make sure it, it meets code and that there's no issues with bonding or electrical that could cause somebody to be electrocuted. Really, all poles need to be that are installed, need to be permitted through the building department. They could do it after the fact and come out and inspect it and make sure that it, it, it meets code as far as, you know, to the safety issues that, that a company pools. So my recommendation would be is we could approve this, but I think you're gonna need to get the building permit. So we know that the, the pool is again, safe and the deed restriction stating that if the pool comes down or the shed needs to be replaced, that those two items will be replaced in conforming locations. Or an application will be made to the zoning board of adjustment for any new setback requirements that they may be seeking.
Speaker 18Once the pool comes down, it will not go up against,
Speaker 1Fair enough.
Speaker 18And to all.
Speaker 1Okay.
Speaker 0Members,
Speaker 1Any other members of the board have any questions or comments for this application? Hearing none, I'm gonna bring it over to the public. Anyone in the public have any comments or questions about this application?
Speaker 3No. One Chairman.
Speaker 1Okay. Hearing none. I'm going to make a motion to approve the application with the restrictions that Henry put on it, with the documentation of, of the permits if he needs to, he wants to proceed with this. So I, I'm, I'll make it affirmative of proving this application. Can I get a second? I'll second it. Please Call the roll.
Speaker 3Mr. Weisman?
Speaker 1Yes.
Speaker 3Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Regio? Yes. Mr. Dacey?
