Speaker 3The flag,
Speaker 2And to the republic for which it stands. One Nation under God, indivisible, with liberty and justice world. Mr. Kinneally, are there any changes to the agenda? Yes,
Speaker 3There are a number of changes. Heather Fam 2 81 Grandview Avenue is not going to be hurt tonight. Laura, do we have a new date for that?
Speaker 1I'm sorry, Jim. Which one?
Speaker 3Heather Fam. 2 81 Grandview Avenue.
Speaker 1We're gonna do July 10th. I still haven't gotten ahold of them. They haven't responded, but I'm gonna give them time 'cause they did not notice the newspaper.
Speaker 3Okay. So a, anybody hearing this announcement? They're gonna be off until July 10th with no further notice if you're a property owner near them, but they do have to notice the newspaper. Okay. VO Roy 9 73 East Lincoln Avenue. It's postponed to June 26th, 2025. They must notice Delta Black 1717 South second Street postponed until July 10th, 2025. They must notice playing field. And those are all changes that I have.
Speaker 2Thank you Mr. Kinneally. Let's move on to item number 6 25 dash zb dash 33 V-N-Y-S-M-S-A, Verizon Wireless.
Speaker 3Is Ms. Britton or anybody from her office present?
Speaker 4Yes. Ms. Britton's here.
Speaker 3Okay, Ms. Britton, let we just talk board for a minute. Ms. Board has heard a lot of these applications before the applicant has submitted all of the required information with the exception of the RF report, which they have not yet received. So if the board looks favorably on this request, that would be a condition of approval.
Speaker 4Okay.
Speaker 2Please proceed, Ms. Briton.
Speaker 4Good evening. I'm gonna be quick 'cause I know you guys have seen tons of these. So I do have Mr. Gary Lucas, our engineer here with us. If you guys have any questions, he's more than happy to answer them. But in summary, Verizon is proposing to remove and replace one small cell cell antenna with one new small cell antenna. Install another antenna on a new tripod sled mount and remove and replace one remote radio head with two remote radio heads and install certain ancillary equipment onto the existing base station. This is an already operating small cell, small wireless facility. So we are moving under the federal statute 64 0 9 A. I don't know if the board has any questions
Speaker 2And members of board of any questions. Okay. You can proceed.
Speaker 1Okay.
Speaker 4Mr. Lucas, are you on? Yes.
Speaker 3Yeah, I'm not sure if the, the board needs any testimony from Mr. Lucas. Okay. You have, you have submitted all of the required information except for the RF report, and you understand that that's going to be a condition of approval and when that comes in, you'll have satisfied your conditions and you can proceed. Absolutely. Mr. Chairman, open it to the,
Speaker 2I think, I think we can move ahead on this right now. Do any other members of the board have any questions or comments? Hearing none, I'm gonna open it to the public. Anyone in the public portion have any questions or comments about this application? Lord, just shake your head if it's No,
Speaker 1I was talking to Courtney, honestly. Chairman, I was not listening to you. No, there's no one from the public. I'm sorry.
Speaker 2That's fine. Not a problem at all. Close the public portion and I'd make a motion to approve this application based on the Mr. Kaley's recommendation about the RF findings. I'll second Thank you. Please call role
Speaker 1Mr. Weisman? Yes. Mr. Tillery?
Speaker 2Yes.
Speaker 1Mr. Patel? Yes. And Roy's not here? Correct. Okay. Mr. Bla?
Speaker 2Yes.
Speaker 1Mr. Hika? No, he's absent. Mr. Mitterando? Yes. Mr. Ali? Yes. And Chairman Cahill?
Speaker 2Yes.
Speaker 3Mr. Britton, we will realize this is our next meeting.
Speaker 4All right, thank you very much. I appreciate your time. Good night. Good evening. Have
Speaker 1A good night.
Speaker 2Let's move on to item number 7 25 dash ZB dash 27 V. Michael Cruz.
Speaker 3Is Michael Cruz present? Yes. Okay. Mr. Cruz, you were sworn in at the last hearing. You remained sworn in to tell the truth. I know that you met with Mr. Ms. Rahi and you discussed some alternative plans. Can you tell the board where you are now?
Speaker 5Yes. So what we discussed was going out from a, I guess the perimeter. I don't, I don't know if you have the plans in front of you, but what we did discuss was having, instead of a four foot picket around the perimeter, was more around a four foot solid. And I was satisfied with that given, given the mandate and that
Speaker 3That and, and that four foot solid fence would be in the front setback of Ellis?
Speaker 5Yes. From the property line on the Ellis side, forefoot. And then, you know, on the back, the back of the property where the shed is, it's more of a six foot that goes across with one section of a foot.
Speaker 3The back. Yeah. Let, let me, let me stop you there. The diagram that Mr. Raki gave me showed that front, when you're in the front yard setback of Ellis Parkway, you're gonna have a four foot solid fence. And from Ellis Parkway it would be set off three feet from the property line. Is that your understanding?
Speaker 5I wasn't understanding at three feet I was the setback, but I, I was going based off of my original permit that I did with a four foot, no one said anything but a four foot setback. They, the original said that I can go all the way up to the property line.
Speaker 3Okay. The diagram that Mr. Ms Rahi gave me shows a three foot setback from the property line with four foot solid fence along the Ellis Parkway frontage,
Speaker 1Mr. Kinneally, Mr. Cruz, your first permit you got was a four foot picket fence. You can't go by the original permit 'cause you decided not to do that. This one's a solid fence. So I believe Jonathan asked you to go back three feet from your property line. Since it is a solid fence,
Speaker 5I'm okay with that. I'm okay with going back three feet from the, okay. And
Speaker 3The, the diagram that Mr. Mizrahi gave me showed that once you leave the Ellis Parkway frontage, you go from a four foot solid fence to a six foot solid fence for the rest of the fence along the rear of your property, the side of your property on the right side.
Speaker 5I don't know what you're, what you're seeing, but from the last I left the office, if it's the same from the back then yes, from the corner of Ellis there's a eight foot drop with the, from, from the six foot going around my property to drop into a four foot and then a sections around to the Ellis side. So I'm aligned with that.
Speaker 3Okay. Mr. Chairman, I, I have a diagram that was prepared by Mr. Rahi after consulting with the, the Pplicant. Mr. Cruz. I believe that Mr. Cruz is in accordance with that and Mr. Rahi has signed off on that as well. So I think the board can move forward on this after hearing from the public.
Speaker 2Agreed. Thank you. Any other members of the board have any questions for this applicant? Hearing none, I'm gonna open it to the public. Anyone in the public have any comments or questions about this application?
Speaker 1No. One chairman.
Speaker 2Thank you. Close the public portion. I'd make a motion to approve this application. A second. Thank you. Hold the roll please.
Speaker 1Mr. Weisman? Yes. Mr. Tillery?
Speaker 2Yes.
Speaker 1Mr. Patel?
Speaker 2Yes.
Speaker 1Mr. Blot?
Speaker 2Yes.
Speaker 1Mr. Mitterando?
Speaker 2Yes.
Speaker 1Mr. Ellie?
Speaker 5Yes.
Speaker 1And Chairman Cahill?
Speaker 2Yes.
Speaker 3Mr. Cruz, your application as amended has been approved. We will more utilize this in a written document in our next meeting and send that document to you.
Speaker 5Awesome. Thank you. I have one question around it. Right. So my shed and everything, the shed and everything, the four foot solid, everything, it's still stands no, no other, you know, clauses or so within that?
Speaker 3Correct.
Speaker 5Okay.
Speaker 2Have a good night, sir.
Speaker 5Thank you.
Speaker 2Okay, bye. Laura, this brings us to number 11, I think.
Speaker 1Yes, chairman.
Speaker 2Okay. Item number 1125 dash ZB dash 36 VJ Patel.
Speaker 3Is j Patel present? Yes.
Speaker 5Good evening all. And my wife Evening
Speaker 3Patel is also here. Okay. Are you booked to be testifying
Speaker 6Mr. Kinneally? It's Greg Wagga architect. I'll be, I'll be testifying on their behalf. They're here as the homeowners, but I'll be representing them architecturally.
Speaker 3Good evening, Mr. Wagga. Mr. Wagga, could you raise your right hand? Do you swear that the testimony you're about to give your be the truth?
Speaker 6I do.
Speaker 3Your name and address, please?
Speaker 6Yes, Gregory Middle initial j Waga, WAGA 2 1 0 9 St. George Avenue Railway, New Jersey oh 7 0 6 5.
Speaker 3Mr. Chairman, Mr. Wagga has appeared as a registered architect for this court of prior occasions, and I think as long as his credentials remain in full force and effect, he can be accepted.
Speaker 2Okay.
Speaker 6And Mr. Chair, I just to acknowledge that for Mr. Keneally Yes. My licenses in good standing in this state and eight others. Yes sir. Thank you.
Speaker 2Thank you, sir. Please proceed.
Speaker 6You're welcome. So what we're looking to do here, we've got a situation where we're on a very irregular shaped lot. If you have the drawings, the drawings that I have, I can share with you if you'd like or you have in front of you and I can explain and then, and then bring to light whatever questions you have. It's a pie shaped lot. It's probably the seven slice in a pizza pie. Okay. And what we've run into is we've run into a situation where, as we've built back to comply with the owner's requirements, we're encroaching on the left side about just over 10 square feet total, but about a foot and a half off to the right left side yard and about 23 square feet, a total of about 13.33 feet over the setback line that's required at 15 feet. We are in an R 20 zone and we've complied with every other bulk variance that we're looking to achieve.
Speaker 6So we're looking to add on two single story additions with a, a patio that's going to be centered within the proposed sitting area and a proposed ground floor master bedroom. We do have slab on grade construction here, so there's no, for those of you who, who might be familiar with this location slab on grade, there are really no basements in this area, this development. And we satisfy every other obligation, even our bulk in building coverage where we're increasing it by three, roughly 3.84% from 14 to 17.84, still well under the 20% that's required. If you'd like, if any of the board members alike, I can share the documents to bring more specific specifics to light.
Speaker 3I believe the board members have those documents in their packages.
Speaker 2Yeah, we have them back, sir.
Speaker 6And, and there are no, again, the board, the documents that you have in front of you. I have no special exhibits this evening that, that require any additional substantiation.
Speaker 2Okay. Thank you.
Speaker 6You're welcome.
Speaker 3Mr. Ms. Drug? Yes. That they explain why they are doing what they're doing. I believe that Mr. Logger's testimony about the pie shaped lock establishes that it is an odds shaped lock and it explains why they would have to do this.
Speaker 2Okay. Any other members of the board of any questions or comments? I'm gonna throw it to a vote at that. Okay, Mr. Lagger,
Speaker 6That is great. Thank you.
Speaker 2Perfect. All right. I'm open. Did you
Speaker 3Open it to the public Mr. Chairman,
Speaker 2Open it to the public. Anyone in the public portion of any questions or comments about this application?

It's meaning 10 foot in my property and 10 foot in his property. I apply, I take a permit for fence and when I take the permits, I told me I have to go. I go back 10 foot from the property line. I did that. I go back 10 foot from the property line, I get approved for the fence and everything is all right. From months ago, I received a notes that says the survey, it was wrong and that 20 foot isman, it was in my property.
Speaker 3You're looking to put the fence over the easement?
Speaker 8It's already, the fence is in.
Speaker 3Okay. And and do you understand if the app, if the township ever needs access to that easement, you would be responsible for removing that fence and replacing it? Yes
Speaker 8Sir. Yes sir. I responsible for anything for
