Speaker 1Okay.
Speaker 3AMT Pre cower 41 Chicago Avenue will be adjourned to June 11th with no further notice. Finally, tillage zoning will be postponed until May 28th with no further notice. Mr. Chairman, that has been adjourned a number of times. You may want to authorize me to advise the applicant that if they're not ready to proceed at the next hearing, it may be dismissed.

26-DV-14V: Adele Ahmad - Pool Variance 26-DV-14V AI  00:01:45 – 00:05:00
Adele Ahmad requests variance to build residential pool on property. Applicant agrees under oath that all pool equipment (heater, pump, filter, gate) will be located 10 feet from property line. No public comment; board unanimously approves application with resolution to be memorialized and mailed.
Speaker 1You, Mr. Kaley. Thank you. Let's move on. Item number 6 26 DV dash 14 v. Abel. Ahmad.
Speaker 3Is Adele Ahmad present?
Speaker 0Yes.
Speaker 3I need to swear you in. Could you raise your right hand? Do you swear that the testimony you're about to give should be the truth?
Speaker 0Yes.
Speaker 3Thank you. Could you explain to the board why you're here?
Speaker 0I'm trying to build a pool in my house and I need the variance.
Speaker 1Okay. Mr. Ms. Rahi, do you have any comments on this?
Speaker 4Yes. I just have a question For the applicant. Can you explain the type of equipment that's required for the pool? Like a, a filter pump, et cetera? Heater,
Speaker 0Heater, pump filter. We're gonna have a, a gate that's gonna be opening towards the pool only.
Speaker 4Okay. For the equipment, we're going to need to know where that's to be located. The survey you provided only showed the pool itself, so that might require an additional variance depending on the location of the equipment. So we
Speaker 1No, I look back.
Speaker 2Hey, Jonathan might be
Speaker 4Able to, yeah,
Speaker 2Excuse me. I didn't mean to interrupt. As long as he says under oath that it's 10 feet off the property line there, there's not gonna be an issue.
Speaker 0It's gonna be 10 feet
Speaker 2There. You need the Yeah, as long as everything is 10 feet decking, filter, anything off the property line? He's Okay.
Speaker 0Thank you. Laura,
Speaker 4Is that, are you agreeable to that?
Speaker 0Yes.
Speaker 4Okay. It's a, a regularly shaped lot, Mr. Chairman. We, we think it's a, a best, best possible configuration for the pool.
Speaker 1Okay. Alright. Thank you. Any other members of the board of any questions or comments for this individual hearing? Now I'm gonna open it to the public. Anyone in the public have any comments or questions for this application?
Speaker 2You can either raise your hand. Rodney said he could hear us, but he can't talk. Okay. Anybody, if you're on your phone, you hit star six. We have quite a few public on today. Chairman Cahill, or you can raise your hand on the computer and I will unmute you for any application. Okay? No one chairman.
Speaker 1Okay. Close the public portion and I'd make a motion to approve this application testimony. I'll second. Please. Call roll.
Speaker 2Mr. Weisman?
Speaker 1Yes.
Speaker 2Mr. Tillery? Yes. Mr. Patel?
Speaker 1Yes.
Speaker 2Boy, didn't come on. Mr. Blo, raise your hand. Mr. Mitterando?
Speaker 1Yes.
Speaker 2Mr. Ellie? Yes. And Chairman Cahill?
Speaker 1Yes.
Speaker 3Your application has been approved. We'll memorialize this in a written document at our next meeting. You don't need to be here for that. We'll mail that document to you. Good luck.
Speaker 0Okay? Thank you. By the way, when is it gonna come? The document,
Speaker 3The next meeting is in two weeks, so it'll be mailed the day after that.
Speaker 0Okay. Yeah.
Speaker 2I'll email to you.
Speaker 1Sure. Thank you sir. Goodnight. Good
Speaker 0Luck. Sure. Thank, thank you.
26-ZB-13V: Ashhar Kumar Raj - House Addition Variance 26-ZB-13V AI  00:05:00 – 00:10:17
Ashhar Kumar Raj requests conditional approval for second-floor addition (2 bedrooms, 1 bathroom) with variances for building coverage, fence in easement, and existing front setback encroachment. Board requires memorandum of restriction for easement access, rear wall alignment with existing overhang, and proposed overhang capped at 18 inches. Board conditionally approves unanimously subject to revised drawings.
Speaker 126 dash ZB dash three or is that 13 v Ashhar Kumar Raj?
Speaker 6Yes.
Speaker 3Ak. AK Kim Raj present?
Speaker 6Yes. Present.
Speaker 3Okay. I, sir, I need to swear you in. Could you raise your right hand? Do you swear that the testimony you're about to give should be the truth? Do you swear that the testimony will be the truth?
Speaker 6Yes.
Speaker 3Thank you. Explain to the board why you're here, please.
Speaker 6Yeah, I'm going to addition on my house. Second, second floor, two bedroom, one bathroom.
Speaker 1Okay.
Speaker 6And I need the variance. I get the variance for the percentage of the building coverage and fence located in the easement area. And on the right hand side it should be eight foot proposed is 7.8 foot side yard setbacks.
Speaker 1Okay, sir, I believe my expert has some issues he needs to address with you. Jonathan, please jump in.
Speaker 4Alright, thank you. So Mr. Raj, do you, we've gone over the staff report. Do you agree to enter a memorandum of restriction that if we need to access the easement area, you'll remove and replace a fence or any other improvement in that area at your cost?
Speaker 6Yes.
Speaker 4Okay. For the addition, we are going to need to address the front yard setback. It's a, the overhang on the house is encroaching into the front yard setback. So that's an additional variance, but that's existing along with the location of the house relative to the north side property boundaries. So those are both existing nonconformities that'll need to get memorialized with this resolution. If it's passed by the, by the, the zoning board for the addition, would it be possible for you to pull in the, the back wall, the, the wall that's facing the backyard, align it with the exterior overhang. So it's gonna make that, it's gonna make that proposed second floor a little bit smaller, but it'll all be in line with the existing overhang that you have Now, does that make sense?
Speaker 6Yes.
Speaker 4Are you agreeable to that?
Speaker 6Yes.
Speaker 4And then any additional proposed overhang would be 18 inches or less, that's shown us 24 inches on your plan
Speaker 6In the
Speaker 4Plan, would you be okay with making the overhang the overhang more, more, more narrow in depth?
Speaker 6Yes, I'm agree. Okay.
Speaker 4So I would feel most comfortable with a, a new set of drawings so we can review and approve, but I, I see if the board would like, we could conditionally approve this application tonight with those stipulations
Speaker 3And Mr. Ms. Rahi, if he makes those changes, do you have a lot coverage calculation or, I'm sorry, a building coverage calculation?
Speaker 4So the existing building coverage calculation with the overhangs is nonconforming at 23%, 23.52%. If we move the rear wall in to align with the existing overhang and the proposed overhangs are less than 18 inches, it would result in no additional new building coverage. An additional variance would be required for what would then be considered an existing non-conforming overage on lock coverage.
Speaker 3Thank you.
Speaker 4Thank you.
Speaker 1Any other questions from the board? Hearing none, I'm gonna open it to the public. Anyone in the public have any questions or comments about this application?
Speaker 2I have everyone unmuted, so no one chairman.
Speaker 1Okay. Close the public portion. I make a motion to conditionally approve this with the language on the I second that was put put for tonight. Yes. So I'll take a roll call on that.
Speaker 2Cal Beck. Mr. Weisman? Yes. Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Blo. And raise his hand. Hold on. He says yes. Mr. Mitterando? Yes. Mr. Ali? Yes. And Chairman Cahill?
Speaker 1Yes.
Speaker 3You've been granted a conditional approval. You have to supply some revised drawings that show the changes that you agreed to with Mr. Rahi. We will memorialize this at our next meeting, but you need to get those drawings into him.
Speaker 1Okay? You good?
Speaker 8Yeah.
26-ZB-16V: Morgan Patel - Roof Over Patio Variance 26-ZB-16V AI  00:10:17 – 00:14:00
Morgan Patel (son Debs Patel testifying on his behalf) requests variance to build roof over existing patio with pavers. Current building coverage is 22.56%; proposed addition would increase to 26.27%, exceeding limits. Board expert recommends denial due to excessive coverage; board unanimously denies application and advises applicant to reapply with reduced coverage.
Speaker 1Alright. Okay. Thank you. Thank you sir. Let's move on to item number 9 26 dash ZB dash 16 v MAGA and Patel.
Speaker 3Igon Patel Present.
Speaker 1You gotta unmute yourself, sir. There you go. Okay.
Speaker 3I need to swear you in. Could you raise your right hand?
Speaker 8Right. Raise your right hand.
Speaker 3Do you swear that the testimony you're about to give is be the truth
Speaker 8Testimony? Yes. Yes. Will
Speaker 3Do you swear that the testimony shall be the truth?
Speaker 8Yes. Yes.
Speaker 3Thank you. Could you explain to the board why you're here?
Speaker 8Explain,
Speaker 1Yeah, Jim, I think there, there's two gentlemen there. So I want, why don't we swear him the other one if he's gonna be given testimony.
Speaker 3Sir, do you wanna swear testify as well.
Speaker 8Hi, good evening everyone. My name is Debs Patel. I am Morgan Patel's son.
Speaker 3Okay. Do you swear that the testimony you're about to give should be the truth?
Speaker 8Yes.
Speaker 3Thank you. Could you explain to the board why you're here?
Speaker 8The board if you allow on to speak behalf. On, on behalf of my father? Yes. So we, we would like to build a roof over our existing pavers patio that we have in the back of the house.
Speaker 1Okay. That's pretty straight and forward. Jonathan, we have some comments we need to add, right?
Speaker 4Yes. So this property was in front of the zoning board in 2014 for lot frontage, lot width and lot area. However, they were not previously granted a variance for building coverage. As it currently stands, the building is at 22.56% coverage, including the shed with the addition of the proposed roof that would bring the building coverage to 26.27. Yes. So I, it's, it's, you know, my opinion that if there's any additional coverage, granted it would be further exacerbating this, this overage and coverage. I, I, I wouldn't recommend the approval of this application.
Speaker 1Yeah, I, I agree at 26. That's a little, a little, a little steep at this point. Any other members of the board have any questions or comments? I'm hearing none. I'm gonna open it to the public. Anyone in the public portion have any questions or comments about this application?
Speaker 2Sorry, it's muted. No one chairman.
Speaker 1Okay. Close the public portion. Fortunately I'm gonna make a motion to deny this application. Can I get a second? I'll second this time.
Speaker 10Okay.
Speaker 1Please call the roll.
Speaker 2Mr. Weisman?
Speaker 1Yes.
Speaker 2Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Blanc?
Speaker 1There he is.
Speaker 2Mr. Mitterando? Yes. Mr. Ley? Yes. And Chairman Cahill?
Speaker 1Yes.
Speaker 3Mr. Patel, your, your application's been denied because of excessive lot coverage. You can always submit a new application with less lot coverage to the board.
Speaker 8Thank you very much to the board for the opportunity and for the time and for the meeting. Thank
Speaker 1You. We
Speaker 8Appreciate, we appreciate all that.
Speaker 3Thank you. Good luck.
Speaker 8Thank you very much.
Speaker 1On a separate note, Mr. Kamar, Raj, you don't have to stay on. We have to be here.
Speaker 6Be okay. No problem. Thank you. Thank you very much. Evening.
Speaker 1Have a beer on. Yeah.
Speaker 6Thanks. Thanks
26-ZB-18V: Sande Niha - Lot Area and Accessory Structure Variance 26-ZB-18V AI  00:14:13 – 00:26:52
Sande Niha requests variances for 221 Woff Avenue: lot area deficiency of 14 square feet (0.03% short of 43,000 sq ft required) and existing storage shed 8.5 feet from rear property line (10 feet required). Applicant plans new single-family home replacement; shed inspected by township in December 2025 and approved; applicant agrees to relocate shed if significantly reconstructed. Two neighbors testify with clarifying questions but no objections; board unanimously approves.
Speaker 1Everyone. 11. And that is 2026 ZB dash 18 v Sunde Han ni
Speaker 3Sunde ni. Yes. Present.
Speaker 10Present.
Speaker 3I need to swear you in. Could you raise your right hand? Do you swear that the testimony you're about to give should be the truth?
Speaker 10Yes, it is true.
Speaker 3Thank you. Could you explain to the board why you're here?
Speaker 10Sure. So good evening chairman and member of the boards. So my name is Sande Niha. I'm the owner and the applicant of the property at 2 2 1 Woff Avenue. I'm requesting approval for minor, minor bulk variance related to the lot area and an existing accessory structure, which is a storage shed. The property is shot by approximately 14 square feet from the required 43,000 square feet. And that comes out to be around 0.03%. And so, and currently it is in RR one zone. And, and in addition there is an existing storage shed, which is located about eight and eight and a half feet from the property rear, rear, I think rear property line when 10 feet is required. And these are all longstanding and very, very minor conditions. And, and they do not create any substantial detriment to the neighborhood and, and do not impair the intent of the zoning ordinance. So the proposed construction, which is gonna be building a new house, will remain consistent with the surrounding area here. So, so my request here is for both to concentration and approval of this variance.
Speaker 1Thank you, sir. Jonathan, you wanna jump in here?
Speaker 4Sure. Can you provide any testimony on the condition of the existing accessory structure that you're, you're seeking the variance for the shed?
Speaker 10That's for me. I'm sorry. Yes, that's
Speaker 1For you. Sorry. Condition is,
Speaker 10You mean what is the condition of X access structure?
Speaker 4Yes. Does it need repair? Is it in good shape? What what Yeah. Physical condition, so,
Speaker 10Sure. So that's X access structure, which we're talking, this was actually inspected by the township in December of last year. December 23rd of December, if I'm correct, in 2025. And, and everything was found well, so nothing wrong here. I would like to use it if the board of allows me to.
Speaker 4Okay. And and you would agree to, if this needs to be reconstructed significantly or replaced, you would relocate it in a conforming location?
Speaker 10Yes, sir. Definitely.
Speaker 4Okay. All right. That's, that's all I have, Mr. Chairman. Okay.
Speaker 1Thank you. Any other members of the board of any questions or comments? Okay, so I'm gonna open it to the public. Anyone in the public portion have any comments or questions for this application?
Speaker 2I forgot on mute. I'm again, Kathy DeVito.
Speaker 3Kathy DeVito present.
Speaker 11Yes.
Speaker 3I need to swear you in. Could you raise your right hand? Sure. Do you swear that the testimony you're about to give should be the truth?
Speaker 11Yes.
Speaker 3God, could we have your address please?
Speaker 11Four 10 Brentwood Drive.
Speaker 3Thank you. Go ahead with your questionary comment.
Speaker 11So the letter we received from the township states to construct a new single family home, which made me think was this to demolish the, the current home that's in place there. But then listening to the owner's statement, it sounds like it, this is just for a shed. It's not to take down the current existing structure of the actual, the home, not just the shed. The home.
Speaker 10Yeah, I can, I can take that. I don't know if I'm supposed to, but I'll take that. So this very answer request here is existing normal abnormality that's only related with the lock and the shed structure. This is not related with the new house.
Speaker 11Okay,
Speaker 2Well no, no. He is constructing a new single family home. He was short 14 square feet for his lot size for the new house. And then the shed was brought up 'cause he was doing, he has no variances for the new home, but he does have variances on the lot itself. So he has, so that was constructing a new house, but the shed happened to be there and he wants to keep the shed.
Speaker 11So then I I am guessing. So does that mean that we would re Sorry, does that mean we'd be receiving another letter at some point? No, if the house is gonna be getting like torn down and a new house gets rebuilt.
Speaker 2No, he is, he is, he is constructing a new house, but he's in front of the board because his lot is undersized by 14 square feet. That was in the notice also. He needs 43,000, he has 42 and change. So once you put up a new house, your lot's undersized, you automatically have to go for the variance.
Speaker 11Is this for an additional house on the property on the lot?
Speaker 4No, no, it's
Speaker 10Replacement.
Speaker 2Replacement. They're taking down the old house. Putting up a new house.
Speaker 11Okay. And,
Speaker 2And lots undersized by a whole 14 square feet. So if he was 43,000, he wouldn't be in front of the board or he'd have to just go for the shed. Can I, so that's what triggered it.
Speaker 11Okay. Can I ask just like how long the process will take as far as like coming from a noise pollution, what the timeframe would be for this
Speaker 10From pollution perspective? I mean, I I didn't get it. You're talking about the noise pollution from the, the construction which is happening?
Speaker 11Yes.
Speaker 10I mean that's just normal. Whatever happens, right? As per as state standards, municipality standards with any construction. So it's gonna be similar to it.
Speaker 4How long is it gonna take? The duration of construction isn't mandated by this board. That's going to be under general township of Piscataway ordinances for days and times of day when work is to be conducted. If there's anything happening outside of those times, you can follow up with our code enforcement department and they can investigate and pursue any incidences where their work is not conforming with the requirements for the town. But any sort of duration of construction isn't, this isn't the jurisdiction for that.
Speaker 11I'm just curious as to why the whole house would be getting demolished.
Speaker 2He wants
Speaker 11A new and rebuilt.
Speaker 1He is got a, he's got a right to do that. I'm,
Speaker 10Yeah. Okay.
Speaker 1He owns the
Speaker 10Property, right? You
Speaker 1Know, he could do what he wants at this point. To be honest with you, I don't, I don't know if there was an ill repair the home was in bad shape and I, I I don't have the right to ask him that question. He's before us trying to get a variance and that's it.
Speaker 10Okay. All right. Thank you.
Speaker 1Thank you Catherine.
Speaker 10Thank you for asking the question.
Speaker 12Ella Meyer? Yes. One more. Yes.
Speaker 3I need to swear you in. Could you raise your right hand? Yes. Do you swear the testimony you're about to give should be the truth?
Speaker 12Yes.
Speaker 3Could I have your name and address please?
Speaker 12My name is IA Myers. Ia Biji Myers and I live at 43 Cherrywood Drive.
Speaker 3Thank you. Go ahead with your question or comment.
Speaker 12Mr. Nish Wan, welcome to the neighborhood. I actually live behind the new home, so good luck. We did an extension a couple years ago and it's a lot of fun. It's just depends what your definition of fun is, but just real quick, I have no issue. Obviously, like you mentioned before, it's gonna go to the standards. The new home is gonna follow the new ordinance or whatever that are by the state in regards to the shed. The shed used to be a lot closer to the property line and you moved it to eight and a half feet. Is there a particular reason why it didn't get moved the whole 10 feet?
Speaker 10That's right. So when I tried to get the CEO after purchasing the house, right, so that there was a mandate that the, the, the paper, there was a printed page which was given to me by the township and that had bullet points checklist and that stated that shed has to be eight feet away and that's where, you know, to, to be in confirmation, you know, little bit movement was done so that it's away. And then that's where I, which I mentioned earlier, the inspector came and he did inspect the shed, checked the condition, he checked that it's actually away from the rear set as what rear setback and the certificate of occupancy was issued. So it's actually halfway more than what was written on the checklist right now. So again, this is a little confusing. If I would've gotten a right dimension at that point, probably we wouldn't be talking about this.
Speaker 12Exactly. That's what I was confused. I'm like it got moved from, it used to be only about three and a half feet and it got moved to eight and a half feet.
Speaker 10That was a certificate of occupancy requirement. So, gotcha. We need that. That was
Speaker 12Okay. And just to clarify, so you are keeping as is or are you building a new one in that place?
Speaker 10You mean the shed or or
Speaker 12House? Yes, the shed. The brown shed.
Speaker 10Well I'm keeping the shed.
Speaker 12Keeping the shed the same as it. Yeah. Okay.
Speaker 10That's right. And maybe like you've probably heard that, right? I don't know know what board will decide, right? If there's a significant development or changes made to the chair, then pro it will be moved as per our boards.
Speaker 12Understood. All right. And thank you ma'am. So you know there's groundhogs and foxes have lived there for the last 25 years, so don't be surprised when you moved them. Thank you. And thanks. Sorry fan
Speaker 10Forward looking forward. Good meet you all guys. Thank you.
Speaker 1Anyone else? Laura?
Speaker 2No, that's it, chairman.
Speaker 1Okay. Close the public portion. I make a motion to approve this application. Can I give a second? I second please Call a roll.
Speaker 2Mr. Wasteman? Yes. Mr. Tillery? Yes. Mr. Patel?
Speaker 13Yes.
Speaker 2Mr. Bla.
Speaker 14Hmm. We had more comments and nobody has chosen to, to listen
Speaker 2To it. No, nobody else was raising their hand at that time. I promise My
Speaker 14Husband raised his hand. He's sitting right here. I watched him do it.
Speaker 1Well it didn't show up on the screen here, ma'am. I'm sorry. Yeah.
Speaker 2What is it? Kevin Weeks? It just popped up now. Yes,
Speaker 13That
Speaker 14That's correct. He he was doing it from before when everyone else was working.
Speaker 13Yeah. Sorry. I don't know what was happening anyway, I, it, I understand about the shed. Hold
Speaker 3On sir. What's your name?
Speaker 13I'm sorry.
Speaker 3What's your name sir? My
Speaker 13Name is Kevin Weeks and I live at two 15 Wco Avenue in Piscataway. Literally one house away or two houses down. Could,
Speaker 3Could you raise your right hand? I need to swear you in. Do you swear that the testimony you're about to give should be the truth?
Speaker 13Yes.
Speaker 3Thank you. Go ahead with your comments.
Speaker 13My my comment is, if this is only about the shed and the 14 square feet, which is fine with me, I have no issue with that or, or getting a new home on the block. But my question is why is the line in there saying the applicant also request any and all other variance relief? You know that, that they need that, that
Speaker 3That line is in every notice that is necessary. Necessary just in case something comes up. Nothing came up in this application. The only thing the applicant is here for is the shed and the 14 square feet.
Speaker 13What about going forward?
Speaker 3If there are other variances that are identified going forward, he'd have to come back to the board and serve new notices.
Speaker 13Okay. 'cause I just didn't want to see this as like a carte blanche thing. And next me, I know I got a Taco Bell down the street.
Speaker 3Street, he has conforms with all the setback requirements. If he builds it in the wrong spot, he's gonna have to come back to the board.
Speaker 13Okay.
Speaker 1Thank you. Thank you Mr. Weeks. Okay. I still stand by my notice to approve this application. Same here. Okay. Please call the roll a little. Laura, you're muted. Princess muted
Speaker 2You Courtney. At the same time she's yelled from the other room. You're muted. We got up to Rodney. Mr. Mitterando? Yes. Mr. Ali? Yes. And Chairman Cahill?
Speaker 1Yes. Thank you.
Speaker 3Your application's been approved, sir, we'll memorialize this in a written document at our next meeting and send that document to you. Good luck.
