Speaker 4 Yes. Yes.
Jonathan Rahi (Planner) Okay. And you also agree to enter a memorandum of restriction, which basically, as it says in the memo, if the town needs to access the easement at your cost, you'll agree to move and replace.

Shawn Cahill (Chair) Okay. Thank you Jonathan. Same Joe.
Jonathan Rahi (Planner) Certainly the staff opinion is that the increase into the front yard setback from the overhang is a de minimis impact. Mr. Patel, would you agree to providing a five foot temporary construction easement along the frontage of Windmill Road? That's for the purpose of a road reconstruction project in the future?
Speaker 7 Yes.

Shawn Cahill (Chair) Have a good evening.
Speaker 8 Have a good night.
Shawn Cahill (Chair) Item number 8 26 ZB dash 57 V, Dr. Ahad Moore.
Speaker 8 Good evening Chairman. And the board Fresh professionals. My name's Mohammed Alala. I'm an attorney licensed in the state of New Jersey, and I'm here representing the applicant, Dr. Ahammed Mer, who is unfortunately on a plane traveling at this current moment and thus requested that I attend on his BHAs. Okay. Okay, welcome. Thank you. Okay. This is an application for 15 Ewing Drive. An existing single family residence located in the townships are 20 zone. The property is an existing substantially, substantially undersized lot for the R 20 zone. The zone requires a minimum lot of 20,000 square feet. While this property contains approximately 8,432 square feet, it's also only 60 feet wide, where 100 feet is required and approximately 110 feet deep where one 50 feet is required. The applicant is before the board seeking a bulk variance relief in connection with a proposed two story addition to the existing single family home.
Speaker 8 The principal relief we're seeking is 22% building coverage where 20% is permitted. Existing building coverage currently is approximately 17.7%. The family has owned and lived in this home since approximately 2002. The purpose of the addition is to provide the family with additional and more functional living space for their day-to-day needs. And for the extended family gatherings that regularly occur at the home. The property will continue to be used as a single family residence. Dr. Meh is traveling currently, but his son, Ahammed Ahammed Mu, who resides at the property is here and will testify briefly regarding the family's history at the property in use. We also have the project's architect, Mr. Ashraf Bja, who prepared the plans. He will testify regarding the existing conditions, the proposed two story edition, and the dimensional constraints of this undersized lot. We've also reviewed the township staff report, including the comments concerning the fence and the existing garage, and we're prepared to discuss those as well. With that, if it's all right with Mr. Chairman and the board, and unless there's any preliminary questions, I'd like to call Mr. Ahammed mu Ahammed Ahammed mu as our first witness.
Shawn Cahill (Chair) Yeah, please proceed.
Speaker 8 Ahammed Ahammed. Mr.
Speaker 9 Present? Yeah,
James Kinneally (Zoning Atty) Sir. I need to swear you in. Could you raise your right hand?
Speaker 9 Yeah.
James Kinneally (Zoning Atty) Do you swear the testimony you're about to give should be the truth?
Speaker 9 Yes.
James Kinneally (Zoning Atty) Your name and address please. You can put your hand
Speaker 9 Down. Ahammed Moore. 15 Ying Drive. Piscataway, New Jersey 0 8 8 5 4.
James Kinneally (Zoning Atty) Thank you.
Speaker 8 Go ahead. Thank you. Thank you. Mr. Mer, please state your full name and address for the record.
Speaker 9 My name is Mohammed Moore and I live at 15 Ying Drive, Piscataway, New Jersey 0 8 8 5 4.
Speaker 8 Okay. And what is your relationship to Dr. Merck?
Speaker 9 I am his youngest son out of five.
Speaker 8 Great. Approximately how long has your family lived at the property?
Speaker 9 They've been living since 2002, and I've been living here my whole entire life.
Speaker 8 Wonderful. Can you briefly explain to the board why your family's looking to add additional living space to the house?
Speaker 9 So the problem with our house is that back in the day when it was just me and my bro and my brothers and my parents, it was okay, there was enough space, but as my brother started to get married and my family got bigger, the house wasn't as comfortable as it was before. The problem was I have eight nephews and nieces and they're always trying to play, play in the house during the family functions. And they're running around and they're always getting hurt, hitting the walls and everything because of the tight space. And the adults are trying to find a comfortable place to sit and they can't find that place. And even if we do take the children outside, we still have the problem that they might run to the creek or they might run onto the road without us seeing. And that's why I, that's why it's important for us to expand our house and
Speaker 8 Yeah. How does the existing living space function when the family's together?
Speaker 9 It doesn't really function that well. Since we don't have that much room, the whole family's separated and we're not really building that connection that we're trying to build during the family functions.
Speaker 8 Okay. Great. And is there anything else that you would like to add?
Speaker 9 Yeah, my my, my father wasn't able to make it today, but he wanted to say something if that's okay with you,
Speaker 8 Go.
Speaker 9 Okay. All right. So this is, I'm gonna speak on behalf of my father. All right. Dear members of the Piscataway Township zoning Board, my name is Ahmed Moore. I have lived in Piscataway since 1994 and in this house since 2002. Aside from a be brief period away from for work, this community has been my home. We raised all five of our sons in ho in this house today. They and their families live nearby. All of them are within five minutes, and my youngest son attends Rutgers also just about five minutes away. Our family's Muslim and the Islamic Center is just a couple of minutes from our house. This house has become too small. When our children and grandchildren gather, we are not looking to move away. We simply wish to add a modest extension, including additional living space with one bedroom and one bathroom upstairs. This would help us remain in the, in the home where we raise our children and keep our family closed. We respectfully request consideration for the variance needed for this edition, and we're grateful for your time and service to our community. Sincerely, Ahammed Moore.
Speaker 8 Thank you. I don't have anything further for Mohammed, unless the board has any questions. Yeah.
Shawn Cahill (Chair) Does anyone on the board have any questions for this witness? No. You can proceed, Mohammed.
Speaker 8 Thank you. I'd like to invite Mr. Raf Rajab, the architect.
James Kinneally (Zoning Atty) Are you present?
Speaker 10 Yes.
James Kinneally (Zoning Atty) I need to swear you in. Could you raise your right hand? Do you swear the testimony you're about to give should be the truth?
Speaker 10 Yes, I do.
James Kinneally (Zoning Atty) Your name and address please?
Speaker 10 Usher Ragab, R-A-G-A-B. The address is two Division Street, week one, Somerville, New Jersey. 0 8 8 7 6.
Speaker 11 Thank you.
Speaker 10 Thank you. Thank
Speaker 8 You. Mr. Rajab. Are, are you a licensed architect in the state of New Jersey?
Speaker 10 Yes, I am.
Speaker 8 Can you briefly provide the board with your educational and professional background?
Speaker 10 I'm graduated from City College of New York in 1994 with a bachelor of architecture. I've been licensed in the state of New Jersey since 2001. And I have been principal of Amark Design Studio since 2001. And I am the architect of record of this project. Thank you. You qualify. You, you,
Speaker 8 Thank you. I, with the board's commission, I'm going to pull up the architectural plans that were submitted. Okay. And Mr. Rajab, if you can go ahead and explain to the board the property existing residence and what we're seeking relief for you.
Speaker 10 All right. So this is a single family house. We are proposing a two story right side addition on that property, on the house, on the single family, the property is undersized. So, and there are a few existing nonconformities and mainly the front yard setback and one of the side yard setbacks. The front yard is supposed to be 40, it's 30.4. The side yard is supposed to be 15. It's 1.4 from the left side. The property is undersized. It's supposed to be 20,000, but it is 84, 32. The width of the property is supposed to be a hundred foot, but it's only 60. The w the depth is supposed to be one 50 is only one 10. So it's all around and undersized property. The house is shifted on the property. So the left side and the front of it are outside of the setbacks, but there is plenty of space on the right side within the setbacks.
Speaker 10 And that's where we're proposing that addition, the maximum building coverage in that zone is 20%. Currently the house is 17.71 and we are proposing to bring it up to 22%. And that's the variance we're seeking. The addition is simply to add living space downstairs and dining room living, living room and dining room downstairs and a master bedroom upstairs, or actually a guest suite, you can call it upstairs. And we are, we have attempted to maintain the style and the roof line and all the characteristics of the existing house. So this addition does not look out of character, it's just a continuation of the house as it is. And that's all we're proposing at this point.
Speaker 8 Okay. And Ms. Raja, you're familiar with the township staff report? That was that?
Speaker 10 Yes. Yes. We, we went, yeah, I, I, I did review the staff report.
Speaker 8 Okay. Can you address the comments regarding the, the, the fenced with respect to the comment that they had about the it not showing on the report and what we are planning to do there?
Speaker 10 Yeah. The, the, the, the fence is not shown on my drawings, but I was made aware of a, a a, a zoning permit application that was submitted and approved in 2024 for this fence. However, the zoning officer contended that there were issues with that fence layout, that it goes into some easement spaces. So we are, we have agreed to bring it within the, all the allowable area. And the staff report does require me to detail the fence, which I intend to do. So I will be putting construction details for that fence. It's a six foot fence, three foot of masonry below, and three foot of vinyl or wood above.
Speaker 8 Thank you, Mr. Goomer. The last comment that I would like to address is with respect in the, the staff comments is with respect to the garage, they, in the staff comments they had requested the structural permits. And so we pulled those for the approval of the garage when it was done. This is a long time ago in 2008. And so we had the, the plan and it was approved with the, as it currently state stand in which here is the construction permit as well as the approvals.
Speaker 10 And so, and I, I can also testify that we documented this house, this project was started in 2015, believe or not. So we actually documented the existing conditions of this house in 2015 when we first started working on this project. And the garage was in this exact condition in 2015. Yes. And I believe this permit is dated 2008.
Speaker 8 This is 2008, correct?
Speaker 10 Yes. Okay. So it it, thank you Mr. Goomer. It appears that this gar, this area of the garage was approved and permitted back in 2008 and built accordingly.
Speaker 8 Okay. Thank you.
Speaker 8 So in summation, we, what we are looking for here is that the, you know, the testimony establishes the particular circumstances of this property, that it's on an undersized and constrained lot, and that we are looking for a 22% variance where 20% is of course allowable and it's gonna be a single family residence. We've heard from the, from the family as to the use that would be necessary. And hopefully we've addressed the staff's comments with respect to defense that will be added to the current plans. And I, I addressed the garage concerns as well with that. We, we see the board have any issues.
Shawn Cahill (Chair) Yeah. Jonathan, were there issue, you could take this off the screen please.
Speaker 8 Oh, sure. Sorry
Shawn Cahill (Chair) Jonathan, you ha you have some issues that you concerned about?
Jonathan Rahi (Planner) Yes. Thank you. If, if I could just get one or two points of clarification from the, the architect please. You, you mentioned three feet of masonry and then could you just confirm that the overall height and then the breakdown between the masonry and the fence, please. I
Speaker 10 Mean, I'm, I was going by the 2024 permit application because I never showed that on my drawings, but it does show a, a six foot, six foot fence with a three foot masonry base.
Jonathan Rahi (Planner) Yeah. The, the 2024 permit, we could provide you a copy that was for a four foot wood fence that was within the, the stream easement area as well as a municipal easement area. The maximum allowable height for a fence is six feet. When it's a combination of block wall and fence, we, we count both of those. Right. So a so in the combination needs to add up to six feet. So because it was a four foot picket fence on your, on your 2024 I believe fence permit. And now it's being shown as a six foot solid permit, six foot on, on, on the A oh one architectural drawing shown up to the property line, which is within those easement areas, which aren't shown on the site plan on sheet A oh one. So yeah, some clarification be much appreciated on that with revised
Speaker 10 Drawing. I mean, I don't, I mean, we don't, I, we did talk to the client today, Dr. Moore, before he departed, and we talked to also the attorney and we agreed that we will bring it in. It's not gonna be at the property line. We'll bring it into whatever the township is comfortable with us putting that six foot fence. And it will be three foot masonry and three foot, I believe it's vinyl or it might be board like a wood board. So the, the top three foot is still kind of up in there. But it could be PVC, like it could be a vinyl fence above.
Jonathan Rahi (Planner) Okay. And that's, that's great. And I think we'd request a revised set of drawings to be reviewed by the board at least 10 days before the next meeting. And then the architectural staff's gonna recommend architectural revisions to comply with the, with the building coverage requirement of 20%. And then just going back to the garage, I understand there was a 2008 approval for the rec room conversion, but the remaining parking space inside the garage is measuring less than the required 12 feet by 20 feet.
Speaker 10 Yes, it's 10 foot seven by 20.
Jonathan Rahi (Planner) Okay.
Speaker 10 I mean, I mean, yeah. And that's the existing condition is,
Jonathan Rahi (Planner) Okay. So that's, that's all the, that's all the comments I have. I, I, again, I, I think revised drawings for the board to review at the next meeting would probably be the, the best way forward.
Speaker 10 So no vote tonight.
James Kinneally (Zoning Atty) Yeah, Mr. Chairman, the board doesn't have enough information to go forward tonight. Your professionals want to see those revised drawings before they can make a recommendation to the board. It would also be helpful if the applicant himself was present so that he could agree or disagree with points made by the board.
Speaker 10 Got it. Understood. Okay. So, so Ahammed that I will, we put, I have a question because you're asking me to provide revised drawings before next hearing. Yes. What are you requesting me to revise?
Jonathan Rahi (Planner) The building coverage, the fence to be shown
Speaker 10 Building cover is, is the addition. I mean, if I take out the building coverage, there will be no addition. So I don't, I don't have to come back.
Jonathan Rahi (Planner) Well, you're at 17, 18% and now you're at 22. So a reduced, a reduced addition is, is what we were requesting the staff is requesting.
Speaker 10 Yeah, but without, without the 20%, I don't have a variance. I don't have to come back.
Jonathan Rahi (Planner) You would need a variance. You're an undersized lock.
Speaker 10 Oh,
Jonathan Rahi (Planner) So I, I mean
Speaker 10 We'll talk to the client.
Jonathan Rahi (Planner) Yeah. And the defense along with the stream encroachment line, as well as the sanitary sewer easement line that's present on the survey. We'd like to see that reflected on the site plan and the architecturals with the, the fence in reference to that. And we will, you know, I'll confer with the rest of the staff about the, the 2008 permits and how that relates to the remaining dimensions of the parking space.
James Kinneally (Zoning Atty) And, and counselor, I will point out that you have not put on any planning testimony by a professional planner to support any of the variance requests. This board takes the lot coverage variance very seriously and rarely grants those variances. So you should think about discussing this with your client and discussing it with a planner.
Speaker 8 I appreciate it.
Shawn Cahill (Chair) Laura. 22nd of October
Speaker 1 Second. They're, they're not gonna make it. Yeah,
James Kinneally (Zoning Atty) They're not gonna
Speaker 1 Make, make it and have that plans in by Monday. We're close. Oh yeah. Right, right. Yeah. November. Sorry. November 12th.
James Kinneally (Zoning Atty) All right. We're gonna put this on for 11 November 12th. Counsel, if your client or your client's experts have trouble complying with that, just let us know and we can announce a new date.
Speaker 8 Okay, sounds good. I'm okay.
Shawn Cahill (Chair) Perfect. Alright guys, so any
James Kinneally (Zoning Atty) Revised plan would've to be in 10 days before that. Okay. Anybody on the Moore application? It's gonna be carried to October 12th with no further notice by the applicant.
Shawn Cahill (Chair) November,
James Kinneally (Zoning Atty) November 12th. November 12th. The only notice you're receiving is my announcement here tonight.
Shawn Cahill (Chair) Okay. See you guys now month.
Speaker 8 Thank you. Thank you.
Shawn Cahill (Chair) Okay, let's move on to item number 9 26 dash ZB dash 52 V. Patricia Yuli.
James Kinneally (Zoning Atty) Is Patricia Yuli present?
Speaker 13 Yes, I am.
James Kinneally (Zoning Atty) I need to swear you in. Could you raise your right hand? Do you swear that the testimony you're about to give should be the truth?
Speaker 13 Yes.
James Kinneally (Zoning Atty) Thank you. Your name and address, please?
Speaker 13 Patricia Yuli. 60 Hamilton Boulevard, Piscataway, New Jersey 0 8 8 5 4.
James Kinneally (Zoning Atty) Thank you. Could you explain to the board why you're here?
Speaker 13 I'm trying to put a second story on my house for my 85-year-old father. He lives in South Plainfield, basically by himself and he can't take care of the house by himself and I can't take care of two houses and it would be better if we were here under one roof. He has issues with his legs swelling up, so he can't really cook for himself. And he's there all day and all night by himself. And he's getting lonely and depressed. And I felt it would be best if he was here with me and his granddaughters. And my lock coverage is a little over, so I'm trying to get a variance to put a second story on. I'm, I'm going up not out, so, okay. My lock coverage will be the same. Seem
Shawn Cahill (Chair) We can clear this up Mr. Pretty quick, Jonathan?
Jonathan Rahi (Planner) Yeah. Just for the, the board, the applicant is proposing remove a carport as well as a shed to reduce all building lot coverage besides the, the principal building. Yes. And then the addition going straight up will not create any new building coverage. No. Ms. Ula, can you provide some testimony on the building and zoning permits that may have been issued for the existing above ground swimming pool in the rear yard?
Speaker 13 Well, I'm working on that right now. My husband unfortunately passed away, but he was working on that a couple years ago and I know that he called a couple times for them to come out and inspect and he never got a call back. I actually have the paperwork right here that he was working on. So I know I have to get that done. And I think the electrician is coming tomorrow to the township to, to fill out the paperwork or start the permit for that. So I know I have to get that done.
Jonathan Rahi (Planner) Yeah. Okay. And before I continue, have you seen the staff report dated October 5th, signed October 5th, the above date? September 29th?
Speaker 13 Well I have something here from September 29th.
Jonathan Rahi (Planner) Yes. Yes. That's the one. The signature date on the bottom is ten five. So do you, do you agree with providing a five foot temporary construction easement along the front property line along Hamilton Boulevard?
Speaker 13 Yes. I'm not really quite sure what that means,
Jonathan Rahi (Planner) But when we do our curb sidewalk program and rotary construction, oftentimes the builder who's repairing the road will need temporary access to a small portion of your property so that way they can just better work around the construction site. Yeah. So it's temporary. It's only for the duration of construction and that's, that, that's what those generally entail.
Speaker 13 Okay. Yes.
Jonathan Rahi (Planner) Okay. And then the wet bar on the second story, can you provide some testimony on what will be in that space?
Speaker 13 Just like a kitchen sink where he can watch his dishes. Maybe like a microwave. He's not gonna be cooking 'cause he can't stand that long 'cause his legs get swollen. So I think that's one of the reasons why he wants to come here so I can cook dinner for him. 'cause he is losing a lot of weight and Okay. And he's gonna have his own bathroom 'cause he can't really walk up and down the stairs very easily.
Jonathan Rahi (Planner) Understood. Would you, would you be open to a deed restriction that would prevent a second kitchen from being a a second full kitchen? From being a part of the home?
Speaker 13 Yes. Yeah. He's not gonna have a stove 'cause he, he doesn't wanna cook. I think that's why. Okay. I'm
Jonathan Rahi (Planner) Here. Understood. We just wanna
Shawn Cahill (Chair) Make sure there's not gonna be another, a second kitchen on the
Speaker 13 No, no.
Jonathan Rahi (Planner) There's, that's all I, that's all I have for this application.
Shawn Cahill (Chair) Any other members of the board have any questions or comments? I'm gonna open it to the public. Laura, could you open it to the public? Any comments, questions? Nope.
Speaker 1 You can raise your hand. Done. I will unmute you. No one chairman.
Shawn Cahill (Chair) Okay. Public portion's closed and I'd make a motion to approve this application. Could I get a second? I second with, with the deed restriction that Jonathan,
Speaker 1 Mr. Tillery? Yes. Mr. Patel? Yes. Mr. Regio? Yes. Mr. Blo? Yes. Mr. Mitterando? Yes. Mr. Ali? Yes. And Chairman Cahill? Yes.
James Kinneally (Zoning Atty) Ms. Julich, your application has been approved. We'll memorialize this in a written document at our next meeting. We'll send that document to you. You don't need to be here at the next meeting.
Speaker 1 Alright? Thank you so much. Good luck. Have a good night.
Shawn Cahill (Chair) You, you're doing a good thing, ma'am.
Speaker 1 I, it's for my father.
Shawn Cahill (Chair) Understood.
Speaker 1 Thank you. Thanks. Bye Pat. Bless
Shawn Cahill (Chair) You. All right, let's move on to item number 10. Option of the resolutions from the regular meeting of September 24th.
